VILLAGE OF LAKEVILLE COUNCIL MEETING --MARCH 15.,1971
The .meeting was called to order at B:OO P.M. by Mayor Mako. Flag pledge
.followed. Present; Friedges, Clay, Mako, Sullivan and Taft. Also present;
Pat Farrell, Village attorney.
674. Motion by Taft seconded by Friedges to accept the minutes of the March 8, 1971,..
meeting as read. Friedges, Clay, Mako .Sullivan and Taft "aye", motion carried.
675. Motion by Friedges seconded by Clay to pay the Liquor store bills. Clay, Mako,
Sullivan, Taft and Friedges "aye", motion carried.
676. Motion by Sullivan and seconded by Taft to pay the Village bills. Mako,
Sullivan, Taft, Friedges, ''aye", Clay abstained, motion carried.
The Planning Commission minutes of March 11,1971, were read.
677. Motion by Friedges seconded by Sullivan to follow the Planning Commission
recommendation to grant rezoning of Brad Johnson property from B3 to R3-C.
Sullivan, Taft and Friedges "aye", Clay and Mako opposed. Motion failed due
to 4/5th vote required to pass rezoning changes.
.678. Motion by Mako seconded by Friedges to table. recommedation regarding-the
variance request for Brad Johnson until the engineer considers the sewer
and drainage problem on the property. Taft, Friedges, Clay, Mako and
Sullivan "aye", motion carried.
679. Motion by Taft seconded by Friedges to table .the new plans for the
proposed restaurant until after the hearing on the 22nd of March.
Friedges, Clay, Mako and Taft "aye", Sullivan opposed, motion carried.
At this time the attorney advised the Village council that they would not
be able to have another hearing on the rezoning for six months.
68U. Motion by Mako seconded. by Taft to reconsider the motion #677., on the
rezoning of the Brad Johnson property. Mako, Sullivan, Taft and Friedges
"'aye" Clay opposed, motion carried.
6$l. Motion by Taft seconded by Sullivan to follow the P.C recommendation
and rezone the Brad Johnson property from B3 to R3-C. Mako, Sullivan,
Taft, and Friedges "aye", Clay opposed, motion carried.
682. Motion by Mako seconded by Clay to table recommendations B & C on Brad
Johnson property until the first meeting in April for the purpose of checking
the drainage and sewer and water connections. Clay and Mako "aye", Sullivan,
Taft and Friedges opposed, motion failed.
683. Motion by Friedges seconded by Taft to follow the recommendation of the P.C.
to grant a variance to Brad Johnson from minimum lot and area size subject
to the approval of the Village engineer. Taft, Friedges, Clay, Mako
and Sullivan "aye", motion carried.
684. Motion by Sullivan seconded. by Friedges to follow:~the P.C. recommendation
:and grant Brad Johnson a building permit subject to the engineer's approval.
Friedges, Clay, Mako, Sullivan and Taft "aye", motion carried.
The Park and Recreation minutes. of March 20, 1971 were read.
fi85. Motion by Clay seconded Bar=Friedges to follow the recommendation of the
Park and Recreation committee and have them work with Midwest Planners
to draw up a long range overall plan for the new land acquired by the.
Village., Clay, Mako, Sullivan, Taft and Friedges "aye", motion carried.
rlr. Friedges and Mr. Emond will check with Bud Berres and come back to
the council. with a recommendation for seeding land.

Mr. Mako will discuss the .park maintenance with Mr. Henry and report back
to the .council next Monday, the 22nd of March.
686. Motion by Clay seconded by Taft to apply for the permits to treat the
two lakes. Mako, Sullivan, Taft, Friedges, and Clay "aye", motion carried.
Mr. Don ;Tatge appeared before the council to request that something be
done to a pit filled with water on the Dennehy and Marrinan land. He said
that achild had almost drowned in this pit a few days before this.
Mr. Farrell. said that the council could declare this a nuisance area and
contact the property owners to fence this pit.
Mr. Antolik mentioned the fact reported that there was a situation in
Oak Shores Addition that was similar.
687. Mote~e by Sullivan seconded. by Taft to send letters to Mr. Dennehy and,
John Marrinan to fence in this pit on their properties. Sullivan, Taft
Friedges, Clay and Mako "aye", motion carried.
The clerk was instructed to have the Village engineer look at the water
situation in Oak Shores.
Mr. Farrell advised the council that there is no road easement on Irene
St.
688. Motion by Clay seconded by Taft to authorize the mayor and the clerk
toacceptthe easement deed and construction easement for the Airlake project.
and to authorize the sig~sing of the same. Taft, Friedges, Clay, Mako and
Sullivan "aye", motion carried.
The matter of a bill from Jemm Electric for wiring at the liquor store
in 1968 for an ice machine was brought to the attention of the council.
The clerk was instructed to look. up the minutes for the matter and report
back to the council.
the Village inspector advised the council that he had a plat for Overland
First Addition but it had no signatures. He was advised to check with
the county to see if this plat is ok before the signatures would be applied.
He also asked what should be .done .about granting permits for building
houses as he felt that .sewer and water could be a problem.
Father Rowan and Vic Kohlnhofer appeared to ask the council check into
the possibility of obtaining the old Lakeville Auto Sales building for a
youth center in the fall.` Father Rowan advised that it was no longer
feasible to use the basement at the rectory.. He reported that the children
had taken good care of the facilities. They were referred to the Park and
Recreation Committee.
Mr. Kohlnhofer also reported that he had not been able to acquire the
additional liability for the liquor store at the price that had been quoted.
He said that the premium would be an additional $1,000 for the $500,000 limit
and that this was based on the gross. receipts of the store.
689. Motion by Taft seconded by Sullivan to pay the additional premium for the
liquor store liability insurance. ..Friedges, Clay, Mako, Sullivan and Taft
'Faye", motion carried.
690. Motion by Friedges seconded by Sullivan to have r1r. Mako contact Mr. Frank
Gallagher in regards to the municipalities carrying their own .insurance and
to urge the state legislature to look into the Dram Shop .law. Clay, Mako,
Sullivan, Taft and .Friedges "aye", motion carried.
691. Motion by Friedges seconded by Clay to instruct the clerk to write the
.county and state highway departments to see if the fiches in County Road ~~70
and Highway #50 could be filled. Mako, Sullivan, Taft, Friedges and Clay
"aye", motion carried.

692. Motion by Sullivan seconded by Taft to instruct the clerk to write
a letter to the senator and. representative that the Lakeville Village
Council is opposed to the Municipal judge system. Sullivan, Taft,
Friedges and Mako "aye", Clay opposed, motion carried.
A letter of appreciation from Walter Miller in regard to help given him
by the Lakeville Police Dept. was read.
693. Motion by Clay seconded by Taft to, set a hearing on the 5th of April
for the .sidewalk improvements on the west side of the street from the
.Variety Store to the narth end of the block on Iiolyoke Avenue. Taft,
Friedges, Clay, Mako and .Sullivan "aye", motion carried.
694. Motion by Sullivan seconded by Friedges to have Mr. Ackerman contact
Don Parrott that they could use electricity from lines at the lift station
at Airlake Parkas per Mr. Parrott's written request. .Friedges, Clay,
Mako, Sullivan and Taft "aye", motion .carried.
695. Motion by Taft seconded by Clay to accept the claim of Mr. & Mrs: Duane
Hauge for repair of their mailbox hit by the Village snowplow.
Clay, Mako, Sullivan, Taft and Friedges "aye", motion carried.
Motion by Friedges .seconded by Clay carried unanimously. Meeting adjourned.
