Present; Friedges; Clay, Mako and Sullivan. Absent; Taft, Also present; Pat.Farrell,.Village attorney and Robert Frigaard, Village engineer. 801. Motion by Sullivan seconded by Friedges that the minutes of the May. 10, 1971, meeting stand as read. Friedges, Clay, Mako and Sullivan "aye", motion carried. 802.. Motion by Friedges seconded by Mako to pay the liquor bills. G1ay, Mako, Sullivan and Friedges "aye", motion carried. $03. rTotion by Sullivan seconded by Clay to hold check X16746 of the Village bills. .and pa~x~hs~.remainder. The clerk is to check the Midwest Planners bill before paying the same. .Mako, Sullivan, Friedges and Clay "aye", motion carried. The Planning Commission minutes of May 13 1971, were-read. 804. Motion by Friedges seconded by Sullivan to follow the Planning Commission recommendation and grant Art Pettis a special use permit which must be reviewed by the Planning Commission in two years and to grant him a building permit. Sullivan, Friedges, Clay and Mako "aye", motion carried. 805. Motion by Sullivan seconded by Friedges to follow the Planning Commission recommendation and grant John H. Wallin a variance of the ordinance to bhild a garage. Friedges, Clay, Mako and Sullivan "aye", motion carried. ~a1e Happy, representing property owners at Lake Marion asked the council to reaffirm the recommendation of the Planning Commission in regards to leopard Bentson's property. 806. Motion by Mako seconded by Sullivan to follow the Planning Commission recommendation and deny the rezoning of land from R-1C to R-3C to Lenonard Bentson. Clay, Mako, Sullivan and Friedges "aye", motion carried. 807. Motion by Sullivan seconded Clay to table Enggren's request to erect a canopy ester the sidewalk until after the hearing on lights.. Mako., Sullivan, Friedges and Clay "aye", motion carried. Mr. Harold Malmanger and Gene Jacobson were advised to apply for a rezoning as the council did not feel it advisable to approve their plat without this being done. Francis Hagen and Rollie Kruger appeared with the final plat of Valley Park 5 th Addition. 808. Motion by Clay seconded by Friedges to table this request"until Donnay's bills with the Village are paid. Sullivan, Friedges, Clay.. and Mako "aye", motion carried. The public hearing on closing parts of Hughes Avenue West was opened 9:OS P.M. PAGE ONE ~ ~ VILLAGE OF LAKEVILLE COUNCIL MEETING , MAY 17, 1971 809. Motion by Clay seconded by Sullivan, resolved to vacate portions of Hughes Ave. West in Overland 2nd Addition as it is in the public interest that these portions of said road=be vacated. Friedges, Clay, Mako and Sullivan "aye°', motion carried. 810. Motion by Clay seconded by Friedges to approve the final plat of Overland 2nd Addition. Clay, Mako, Sullivan and Friedges "aye", motion carried. A letter of credit £uat $12,000 and an escrow check for $1,200 were presented. Tom riohr of Kosemount Sanitation appeared before the council to explain why he did not have a garbage hauling license. Mr. Nfo}~r felt that the ordinance should be rewritten. He objected to the $100 bond and and felt that the license should be for 5 years renewable every year, 811. Motion by Friedges seconded by Sullivan that Mr. Mohr comply with the ordinance within 30 days by obtaining a 100 dollar cash bond or equi~rilant and a copy of his certificate of insurance along with the $35 for permit.. Mako, Sullivan, Friedges, and Clay "aye", motion carried. Louis Helkenn advised the council that Mr. Lyden had plugged up the natural water way at 173rd St. by the Acorn Lodge Motel and felt something should be done about this matter. It was decided that some members of the council and Mr. Frigaard would go out there and see what can be done. 812. Motion by Sullivan seconded by Clay to accept the offer of $1000 worth of playground equipment from Mr. Tillges. Sullivan, Friedges, Clay and Mako "aye", motion carried: The clerk was. instructed to send a thank you letter to Mr. Tillges. 813. Motion by Clay., seconded by Friedges to .authorize Ray Henry to secure adequate: part time hlep-to take care of park maintenance. Friedges,. Clay, Mako and Sullivan "aye", motion carried. 814. Motion by Friedges seconded by Clay to authorize the engineer. to go ahead with the request of Felice Tillges for engineering and legal costs as per attached letter. Clay, Mako, Sullivan and Friedges "aye", motion carried.. 815. Motion by Clay seconded by Sullivan .authorizing the park committee to purchase up to $500 worth of trees for the Orchard Lake Park. Clay, Mako, Sullivan and Friedges "aye", motion carried. 816. Motion by Clay seconded by Friedges to accept the claim from Mrs. Paul Braaten and refer it to the insurance company for payment. Mako, Sullivan, Friedges and Clay ".aye", motion carried. 817. Motion by Clay seconded by Sullivan to grant an excavating permit. to Natural Pipeline Company with the condition that the road be restored to its present condition... Sullivan, Friedges, Clay, and. Mako'"aye", motion. carried. 818. Motion by Mako seconded by Friedges to accept the petition from property owners in Clay's Acres re main sewer and water trunklines. Friedges, Clay, Mako and Sullivan "aye", motion carried. 819. Motion by Clay seconded by Sullivan, resolved to direct the county board to investigate taking. over the Minnreg Road from 35W to the Scott County line. Clay, Mako, Sullivan and Friedges "aye", motion carried. A meeting was set for 8 P.M.~on Monday the 24th of May.
