4 ` VILLAGE OF LAKEVILLE COUNCIL MEETING--DECEMBER 7, 1970 The meeting was called to order by Mayor Jensen. Flag pledge was given. .Present; Taft, Mako and Sullivan-Absent; Friedges. Also present; Pat Farrell and Bob Frigaard, 470. Motion by Sullivan seconded by Taft to accept the minutes of the Nov.lb, 1970; meeting as corrected. Mako, Jensen, Sullivan and Taft "aye'", motion carried. 471. Motion by Taft seconded by Sullivan that the minutes mf the special Nov. 18, 1970, meeting stand as read. Jensen, Sullivan and Taft "aye", motion carried. 472. Motion by Taft seconded by Sullivan that the minutes of the special Nov. 23, 1970, meeting stand as read. Sullivan, Taft, Mako & Jensen "aye", motion carried. 473. Motion by Taft seconded by Mako that the minutes of the special Nov. 30, 1970, meeting stand as read. Taft, Mako, Jensen and Sullivan."aye*, motion carried. Jerome Clay read the minutes of the Nov. 25, 1970, Planning Commission meeting. 474. Motion by Sullivan seconded by Taft to follow the Planning Commission recommendation and issue a special use .permit for a gravel pit to Elezabeth Seeley and Bury & Carlson. Mako, Sullivan and Taft."aye", .Jensen disqualified himself because he is an adjoining property. owner.. Motion carried. Bury & Carl on stated that they would like to have an asphalt mixing operation here also but they were referred back to the Planning Comm. 475. Motion by Mako seconded by Sullivan to follow the Planning Commission recommendation and grant a building permit to Maynard Johnson and Airlake Park for a building 100 X 150 for Granse Corp. Wholesale Plumbing Supplies. Sullivan, Taft, Mako and Jensen "aye", motion carried. 476. Motion by Sullivan seconded by Mako to follow the Planning Commission. .recommendation and change Sec. 4.24 Mining of the present Village Ordinance X42 from 400 yards to 10,000 yards. Taft, Mako, Jensen and Sullivan "aye", motion carried. Paul Oxley, Civil Defense Director for Lakeville, read a letter he had received from the County Civil Defense Director. Herb Lambert of the Park & Recreation Committee said that they were waiting .for two bids for .the lights at the Valley Park skating rink. Mr. Daytons from Jesca Inc. appeared to request that the council reconsider its decision on the trailer permit.He would like to place s~ trailer on the Jackson farm to protect the premises. He was told to get the land rezoned properly or get a special use permit. It was recommended he return to the Planning Commission for this. Russ Streefland appeared before the council to request a special club liquor license as they now have articles of Incorporation .for the Chart House. Mr. Farrell will study the articles and give his opinion on them. Mr. Farrell presented the new ordinance re. licensing sales of liquor and Sunday liquor sales. Several changes were recommended be-fore adoption. 477• Motion by Taft seconded by Sullivan to adopt the ORDINANCE LICENSING AND REGULATING THE SALE OF INTOXICATING LIQUOR BY CERTAIN CLUBS WITHIN THE VILLAGE OF LAKEVILLE AND PROVIDING FOR THE LICENSING OF SUNDAY ` ~ FAGE TWO--VILLAGE OF LAKEVILLE,COUNCIL MEETING--DEC.7,1970 LIQUUR SALES BY CLUBS with the changes as discussed. Mako, Jensen, Sullivan and Taft "aye", motion carried. Mr. Frigaard reported that he had examined the depth of the sewer line for Todd's apartments. He said that the manhole is only 4 1/2 ft. deep and that eventually the sewer service would be extended behind this building. Mr. Todd felt that- he could wait until the sewer program is instituted before building his apartments. 478. Motion by Mako seconded by Taft to authorize the transfer of the sewer plant. to the Metro Sewer Board and authorizing the mayor and clerk to sign the agreement as of the 1st of Dec., 1970. Jensen, Sullivan, Ta€t and Mako "aye", motion carried. It was suggested that the .engineer request that the contracter who is awarded the bid for the Airlake Project extend his bid until after the 12th of Jan. The reason for this is that the sale of bonds cannot be made until after the election on the 12th. X79. Motion by Jensen seconded by Mako to award the contract for the Airlake Project= to the low bidder, Erickson & Erickson. Their bid was for $55,0:11.25. Sullivan, Mako and Jensen "aye", Taft opposed, motion carried. Gt80. Motion by Jensen seconded by Taft to accept the resolution re Valley Park annexation as prepared by Mr. Farrell. Resolution attached. Taft, Mako, Jensen and Sullivan "aye", motion carried. Mr. Taft reported that they could rent space for the b~~tde from Wren cheaper than from Austad. It was reported that the skating rink in Park Terrace had been fixed. It was agreed that Richard Nordling should schedule his 40 hours of weekly work to cover all phases of his work. A meeting was set up with the employees for the 17th of this month. Mr. Mako reported that he would like; to see a petition circulated for the sidewalk into Park Terrace Park as to how many are in favor, b. how many are neutral, c. and how many are opposed to the sidewalk. It was decided to publish the paragraph in the zoning ordinance in regard to parking cars in residential areas. Two bids were received for .the snow removal on Holyoke Ave... for snow removal X81. Motion by Taft seconded by Mako to award the bid.l{~to Fredrickson.. excavating Co. Bids attached. Mako, Jensen and. Taft "aye", Sullivan opposed, motion carried. X82. Motion by Sullivan seconded by Taft that the wages Mr. Martin had been paying the liquor store--employees be ©k'd. They are:$2.75 per hour for part time employees and X561.50 for Holst and Hanson. Adjustments will be made for any overgayments or any underpayments .on overtime. Jensen, Sullivan, Taft and Mako "aye", motion carried. 483• Motion by Taft seconded by Mako to issud a duplicate check number 5978 in the amount of $10.00 to Elizabeth Broad and. waiving the bond. A stop payment. for check nr. 5978 will be filed at the bank. Sullivan, Taft, Mako and Jensen "aye", motion carried. 484. Motion by Taft .seconded by Mako to pay the bill for repairing the lock on the safe at the liquor store." Taft, Mako,. Jensen and Sullivan "ale", motion carried. 485. Motion by Taft seconded by Sullivan authorizing the building inspector to attend the Fifteenth Annual Institute for. Building Officials. Motion by Mako seconded by Sullivan to grant Lakeville Sanitation a renewal license for picking up garbage. Jensen, Sullivan, Taft and Mako "aye", motion carried. 487. Motion by Sullivan seconded by Taft to renew the garbage license of Dick's Sanitation. Sullivan, Taft, Mako and Jensen "aye", motion carried. 488. Motion by Sullivan seconded by Taft to grant the on and off sale beer licenses for Minnreg's Inc. Taft, Mako, Jensen and Sullivan "aye motion carried. 489. Motion by Taft seconded by Sullivan to grant Minnreg's Inc.. a special .club license. Mako, Jensen, Sullivan and Taft "aye", motion carried. 490. Motion by Sullivan seconded by Mako to grant Minnreg's Inc. a Sunday liquor license sub3ect to their compliance with the adopted ordinance and the additional fee. of $10 for the remainder of 1970 and $200 for 1971. Jensen, Sullivan, Taft and Mako ''aye", motion carried. 491. Motion by Taft seconded by Mako to renew the gravel pit permit for Oscar Ramberg. Sullivan, Taft, Mako and Jensen."aye", motion carried. 492. Motion by Sullivan seconded by Taft t© renew the gravel pit permit for Northwest Bituminous. Taft, Mako, Jensen and Sullivan "aye", motion carried. 493. Motion by Sullivan seconded by Taft to issue an excavating permit to Airlake Industrial Park (legal description attached). Mako, Jensen, Sullivan and Taft-"aye", motion carried. 494. Motion by Taft seconded by Mako to issue and on and off sale beer license to Seagirt Ballroom. Jensen,_Sullivan, Taft and Mako "aye", motion carried. 495. Motion by Taft seconded by Mah® to issue an on sale beer license to Old Piper Inn Again, Inc. Sullivan, Taft, Mako and Jensen "aye', motion carried. 496.. Motion by Taft seconded by Sullivan to grant off sale beer licenses to Enggren's and Tom thumb Grocery Store. Taft, Mako, Jensen and Sullivan "aye", motion carried. 497. Motion by Taft seoonded by Mako to grant Orchard Lake Tavern on and off sale beer licenses. Makes, Jensen, Sullivan and Taft "aye", motion carried. 498. Motion by Sullivan seconded bq Mako to approve the permit Job S-22Q from the Minneapolis Gas.vCompany. Jensen, Sullivan, Taft and. Mako "aye", motion carried. 499. Motion by Taft seconded by Sullivan authorizing the endorsement of the Village Council on check cashing rules at the liquor store. Copy attached. Motion by Taft seconded by Sullivan to reduce the rent of the Village pumphouse to $20 per month with the Village using the extra room for the utility dept.. Taft, Jensen and Sullivan "aye", Mako opposed, motion carried. 50I. Motion by Taft seconded by Mako to adopt the resolution relative to state aid to streets and authorizing the. mayor and clerk to sign the resolution. Mako,. Frigaard reported that the assessment rolls for the Valley Park • PAGE FOUR--VILLAGE OF LAKEVILLE COUNCIL MEETING--DEG. 197p project had been prepared. 502. Motion by Taft seconded by Mako to adopt resolution which will be prepared by Mr. Farrell calling for an assessment hearing on the 28th of Dec. at 8 P.M. for storm sewer, curb & gutter and street paving in Valley Park 3rd and .Valley Park 4th Addition and directing the clerk to publish and mail notice as required by law. Jensen, Sullivan, Taft and Mako "aye",motion carried. 503. Motion by Taft seconded by Sullivan amending resolution 424 re improvement bonds 5791 and 5792 erroniously released. and releasing improvement bonds 4788 and 4789 instead. Sullivan, Taft, P4ako and Jensen "aye", motion carried. 5041. Motion by Mako seconded by Taft adopting the resolution as prepared by Mr. Farrell. accepting improvements in College Park lst and 2nd Addition. Maintenance bonds are not required.- Taft, Mako, Jensen and Sullivan "aye", motion carried,. 505. Motion by Sullivan seconded by Mako to .accept the water m;~ol.~ ,house service.. and sanitary sewer in Valley Park 3rd Additon and releasing bonds #6559,6558, and 6557.. Mako, Jensen, Sullivan and .Taft "aye", motion carried. 506. Motion by Taft seconded by Sullivan approving the lease and authoriging the proper signatures on the contract with R. Berres. Jensen, Sullivan, Taft and Mako ','aye", motion carried. 507. Motion by Mako seconded by Taft to adopt the state statute by reference regarding snowmobiles and concerning operation of same. Sullivan, Taft, Mako and Jensen "aye", motion carried. 508. Motion by Taft seconded by Sullivan to rent space in Wren's garage for the blade. Taft, Mako, Jensen and Sullivan "aye", motion.: carried. Various pieces of .correspondence was read to the council. Clint Cross' J.P. report was reviewed. X09 Motion by Sullivan seconded by Taft to revoke resolution 4~ 452 and to allow Jesco Inc. a trailer permit for six months effective immediately pr~sv~d.ed that steps are taken to get this land rezoned properly or a special use permit obtained. In event proper zoning or use permit are not obtained in six months, the trailer permit will not be renewed. Jensen,'Sullivan and Taft "aye", Mako opposed, motion carried.
