Planning Commission Meeting Minutes
JUNE 19, 2008
The June 19, 2008 Planning Commission meeting was called to order by -Chair
Drotning in the City Hall Council Chambers at 6:00 p.m.

ITEM 3. APPROVAL OF MEETING MINUTES:
The June 5, 2008 .Planning Commission meeting minutes were approved as
presented.
The June 5, 2008 Planning Commission work session notes were approved as
amended.
ITEM 4. ANNOUNCEMENTS:
Mr. Morey reminded the Planning .Commission that .the July 3rd Planning
Commission meeting will be cancelled and the next meeting is scheduled for July
17~.
Mr. Morey presented a short summary of the June 16, 2008 City Council decision
regarding the Comfort Inn sign variance request.
ITEM 5. PERFORMANCE OFFICE PAPERS
Chair Drotning opened the public hearing to consider the application of
Performance Office Papers for the following, located at 21565 Hamburg Avenue:
A. Building setback variance from the north property line to allow an
addition to the west side of an existing industrial building.

B. Vacation of public drainage and utility easements.
The Recording Secretary attested that the legal notice had been duly published in
accordance with State Statutes and City Code..
Jack Matasosky and Heidi Winsor from APPRO Development, Grant Jacobson from
Jacobson Engineers and Surveyors, and Jim Kyne from Performance Office Papers
were in attendance. Ms. Winsor presented an overview of their request.
.Associate Planner Frank Dempsey presented the June. 13, 2008 planning report,
which included the following:
• Background summary.
• Three existing drainage and utility easements that must be vacated
• Variance analysis
• -Site Plan review, including roads, rail access, parking, loading dock,
landscaping, exterior lighting, and theemergency fire lane..
Mr. Dempsey stated that staff recommends approval of the Performance Office
Papers variance and easement vacations, subject to the 9 stipulations listed in the
June 13, 2008 planning report.
Chair Drotning opened the hearing to the public for comment.
There were no comments from the audience.
- 08.60 Motion was made and seconded to close the public hearing at 6:16 p.m.
Ayes: 5 Nays: 0
Chair Drotning asked for comments from the Planning Commission. Discussion
points were:
• Rail Service. Safety concerns with the rail service and how many rail cars
were inside the building at a time. There are OSHA and railroad guidelines
to regulate the rail service. With the proposed addition, .Performance Office
Papers will be able to unload three rail cars from both sides simultaneously.
The railroad tracks will be four feet lower than the floor of the building..
• Variance. Government action regarding the County Road 70 right-of-way
and the pre-existing building setback was the main reason the variance was
granted in 2001. Now, due to the fact that Performance Office Papers is
proposing to expand their building onto property that was not part of the

legal description in 2001, a new variance is required incorporating the
additional property into the legal description.
• Parking Deferment. Per the Zoning Ordinance, a business is allowed to
defer construction of up to 50% of their required parking spaces. .The
parking deferment is an administrative permit.
• Easements. Three public drainage and utility easements are proposed to be
vacated to accommodate the building addition. Mr. Matasosky explained
the private easements, including the rail spur easement to be vacated. No
formal action is required by the City to vacate the private easement.
08.61 Motion was made and seconded to recommend to City Council: 1) approval of the
Performance Office Papers building. setback variance based upon the Findings of
Fact dated June 19, 2008, and 2) approval of the easement vacation, all subject to the
following stipulations:
1. The site shall be developed in compliance with the plans approved by the .City
Council and Zoning Ordinance requirements.
2. A minimum of five, two inch caliper ornamental trees shall be installed along the
north boundary line as shown on the landscape plan approved by the City
Council A $2,000.00 landscape security shall be submitted to guarantee the
installation and maintenance of the trees and seed or sod.
3. A minimum of 318 parking spaces shall be available for construction on the subject
property. A minimum of 166 parking spaces shall be constructed subject to the
administrative approval of a parking deferment of 152 parking spaces. The parking
lot shall be striped according to the site plan approved by the City Council.
4. Exterior lighting shall be installed consistent with the approved lighting plan.
5. The building exterior material shall be identical to the existing exterior building
material. The exterior masonry shall. remain integrally colored and shall not be
painted.
6. A building permit shall be issued by the Building Inspections Department prior to
beginning work on the building addition.
7. A 10 foot wide boundary drainage and utility easement shall be dedicated prior to
the issuance of a building permit.
8. Prior to the issuance of a building permit, documentation shall be submitted
showing that a temporary easement has been obtained between the owner of PID
No. 22-10375-011-01 (JBT Real Estate, LLC) to complete the fire apparatus access
road and hammerhead turnaround and associated grading.

9. A development agreement shall be signed and submitted to allow enforcement of
the required improvements and landscaping.
Ayes: Manikowski, Lillehei, Drotning, Glad.
Nays: Grenz. Commissioner Grenz was not convinced that a hardship was
demonstrated to justify this variance request.
There being no further business, the meeting was adjourned at 6:42 p.m.
