~ ~' • CITY OF LAKEVILLE CITY COUNCIL, WORK SESSION MINUTES JUNE 6, 2000 The meeting was called to order by Mayor Zaun at 5:00 PM in the City Hall North Meeting Room. Members present included: Mayor Zaun; Council Members Mulvihill and Johnson; Robert Erickson, City Administrator; Jeff Lueders, Cable Coordinator; John Hennen, Administrative Assistant; Roger Knutson, City Attorney; Brian Grogan, Attorney; Greg Stattman; Robin Selvig and Greg Maliszewski of the Telecommunications Commission Franchise Subcommittee; M. Olson, Hickory Technologies; and Frontier Communications Representatives. Absent were Council Members Sindt and Luick. ITEM #1 and #2: Discuss additional Cable TV franchise agreement with WideOpenWest, Inc. and review proposed right of way ordinance amendment. • Council Members originally discussed an additional proposed Cable TV franchise agreement with WideOpenWest, Inc. (WOW) at the May 25, 2000 City Council Work Session along with a proposed timeline for processing the request. WOW is requesting to provide data (internet), digital TV and telephone service to Lakeville residents. At the meeting, Council Members recommended modifying the schedule by two weeks to allow the City Council the opportunity to review the item in greater detail at a future work session. Mr. Lueders highlighted the revised timeline for processing the request for a cable television franchise agreement with WOW. Prior to the execution of an agreement with WOW, the company will have to provide documentation that they have the legal, technical and financial qualifications in place to move forward. Once approved, WOW would be allowed to begin trenching in right-of--ways to install the infrastructure such as conduit for cable, new pedestals, .etc. The final .franchise agreement with WOW would be very similar to the City's. existing franchise agreement with Charter Communications. Mayor Zaun proceeded to direct the Council's. attention to the draft Right of Way Ordinance. Mr. Knutson indicated that in 1997 the Minnesota Legislature granted all telecommunications companies the right to place their equipment in the public right-of- i ways. The amendments to Minnesota Statute Chapter 237 gave. local units of ,~ , CITY COUNCIL WORK SESSION MINUTES JUNE 6, 2000 Page -2- government the authority to regulate and manage their right-of--ways and to recover the costs of managing the right-of--ways. Cities however must adopt aright-of--way ordinance to assert this authority. Mr. Knutson mentioned the draft ordinance would allow the cities to require anyone working or maintaining utilities in the right-of--ways to go through an advanced registration process. Cities could also require construction performance bonds, insurance coverage, establish installation and construction standards, establish and define location and relocation requirements for equipment and facilities, and establish project coordination, timing and requirements. Mr. Grogan recommends that the right-of--way ordinance be in place prior to WOW installing any of their infrastructure. Mayor, Council Members. and staff discussed the possibility of requiring WOW to install additional vacant conduit so future companies could utilize the conduit which would prevent additional disturbance/digging of the city's right-of--ways/homeowners yards. Mr. Erickson asked if it would be cost beneficial to install one larger conduit and require all future companies to utilize the conduit which would prevent additional disturbance/digging. and preserve area in our right-of--ways for any future installation of utilities/infrastructure. Mr. Grogan believes .telecommunication companies would be very hesitant to share conduit because they will want their own conduit so maintenance work/repairs can be done without worrying • about other companies' infrastructure. Council Members recommended the City consider the possibility of having companies share trenches/conduits (i.e., WOW and Hickory Technologies) to prevent additional disturbance/digging in the right-of--ways/homeowners yards. ITEM #3. Discuss additional Telecommunication Vendor -Hickory Technologies. Mr. Lueders indicated that Hickory Technologies recently met with City staff to review their plan to install a Telecommunications System in the City, which would do the following: 1. Provide voice and data services to Lakeville similar to other service areas in the communities of Mankato, Owatonna, Farmington, Northfield, etc. 2. Provide competitive local exchange carrier telephone service which would compete with Frontier Communications for local telephone service and provide Internet access. Hickory Tech Representative Mike Olson distributed a handout entitled, "Bringing Broadband Services to the Community of Lakeville "dated May 31, 2000. (See attachment.) Mr. Olson proceeded to review and highlight the document with Council Members. He also presented a video of their proposed system. After the presentation, Council members and staff discussed Hickory Tech's timeline, construction of a switch- CITY COUNCIL WORK SESSION MINUTES JUNE 6, 2000 Page -3- house to allow their network into our community and the amount of funding provided by Hickory Tech to the City to cover staff's (Cable Coordinator) time in administering the project. Staff has also been informed that Frontier Communications would also like the opportunity to come before the Council to discuss the new services their company offers. Under other business, Mayor Zaun informed Council Members that he attended the May 30, 2000 Environmental Affairs Committee meeting and shared with the group the Council's direction on creating an Environmental Affairs Subcommittee of the Planning Commission that would address significant environmental issues and meet on an as- needed basis. Mayor Zaun indicated that Committee Members were hesitant on the proposal. He felt the Council might want to consider inviting the Environmental Affairs Committee to a work session to discuss the proposal.
