Review -Ground Lease for the proposed King's Park Athletic Club.
City Attorney Roger Knutson presented the Outline of the Ground Lease and Development
Agreement (redlined version) to the City Council. Mr. Knutson then stated the agreement
is ready for concept approval by City Council, awaiting input from ISD i94, youth soccer
association, Community Center ad hoc Committee and other user groups. Council Member
• Luick inquired about the vehicle access to the club's i,ioo stall parking lot. Mr. Erickson
stated that vehicles would be able to ingress/egress from two driveways off Dodd Blvd with
a future access that would allow customers to ingress/egress from Ipava Ave.
Mr. Knutson then outlined each article of the detailed Ground Lease and Development
Agreement for the City Council. Mr. Mielke inquired about the City's liability pertaining to
the way Article 2.0~ was currently written. It was agreed that Mr. Knutson would site the
State Statute that KPAC LLP would have to abide by, thus eliminating any City liability.
Council Member Wulff inquired about the City's share of costs for the club. Mr. Feller
outlined the green sheet titled King's Park Athletic Club City of Lakeville Share of Cost,
which outlines the three major ways Lakeville will finance their portion of the clubs costs.
Council Member Rieb inquired about the types of memberships and pricing. Mr. Erickson
referred to the Rochester Athletic Club Membership Types & Pricing website printout and
stated that memberships and fees will be similar to those of the Rochester Club, except
Lakeville residents will pay half the "joining" membership fee.
One final issue addressed regarded an email by a resident who owns a house just north of
the site, several hundred yards away from the site. This particular individual expressed
their concern over the noise they feel would be generated from the outdoor water park.
Council felt this particular resident lives far enough. away and should not be bothered by
noise generated from this use.

. Councils Direction:
^ City Council directed Mr. Knutson to revise the contract with the discussed changes and
receive feedback from attorney Bill Ryan of KPAC LLP.
^ City Council directed staff to bring forward by resolution the Ground Lease and
Development Agreement contract as a concept approval agreement at the June list
Council Meeting.
^ Council direct staff to notify the Community Center ad hoc Committee and schedule a
meeting for July 12~' at the Rochester Athletic Club with KPAC LLP.
