HomeMy WebLinkAbout05-22-06 WSMinutes City of Lakeville Council Work Session Monday, May 22, 2006 / 4:30 PM In attendance: Mayor Robert Johnson, Council Members David Luick, Mark Bellows, Laurie Rieb, and Wendy Wulff. Also in attendance: City Administrator Steve Mielke; Community and Economic Development Director Dave Olson; Parks and Recreation Director Steve Michaud; City Engineer Keith Nelson; Assistant to City Administrator Brian Anderson. Item #1. Krause/LaFavre Property Land Purchase and Sinclair Property Clean-up. Community and Economic Development Director Dave Olson had provided Council with an ofhcial map of the County Road 50/35W area, which showed additional right of way that would be required for the ultimate improvement project for the interchange. It is important to preserve land that will be needed for future rights of way before it is developed further. Current business owners who will be affected have also been made aware of the need for land to accommodate future improvements. Appraisals have been completed and . negotiations have occurred for the City to purchase portions of two parcels of undeveloped commercial property owned by Paul Krause and Adam LaFavre. In addition, the Sinclair site has a limited amount of soil contamination on the portion of the property which needs to be conveyed. The site is still considered an active leak site by the MPCA, which indicates it either has or had petroleum contamination on the. site. The cost would be approximately $250,000 if the site needed to be excavated to prepare for development. The properly owners are working on a medical clinic proposal with an attached parking structure. Under the agreement with Sinclair, it is their obligation to obtain a closure letter from the PCA. The State Petro Fund has been discussed but is only a possible funding source for those responsible for the contamination. Dakota County will work with the City of Lakeville in the acquisition and cleanup of this right of way for the ultimate interchange improvements. Council members felt it was essential for Sinclair to take as much cleanup responsibility as possible and instructed staff to inform the MPCA of the proposed development plans for the site. Creation of a Soils Condition Tax Increment Financing District might also be a possibility to pay for the cleanup. The development of the property would then pay for the cleanup of the property. There are several challenges and restrictions that would apply. Another idea for the proposed roadway alignment was suggested by one Council Member and will be looked at by Engineering to see if it is feasible. Council directed staff to continue to work with the Pollution Control Agency and Sinclair on the cleanup of this site. Council • indicated they could agree with the property owners' proposed settlement amount for the proposed roadway right of way for the ultimate improvements. Fields Invento and Anal sis. rN Y Parks and Recreation Director Steve Michaud provided Council Members with an athletic field inventory spreadsheet. In addition to the traditional sports of baseball, softball, soccer, etc., fields are needed for lacrosse, which has recently been designated as a varsity sport for ISD 194. All fields are maintained by the City with the exception of those used for varsity play at the schools.. Mr. Michaud also showed a field map, a tool for maintenance purposes. The LBA is interested in lighting some fields in the future as well as installing irrigation systems on some of the fields, if/when there are funds available. Airlake Airport has been approached to consider leasing open land to the City to be used for additional soccer fields. The site being considered is 30 acres and Airlake is being asked to contract with the City at the farmland lease rate. Staff will keep Council apprised of any progress in attaining additional fields to accommodate growth in the athletic programs and to replace the soccer. fields lost as a result of the McGuire site being chosen for the ice arena. The City is working with the School District on cost share for fields and providing adequate parking for soccer and for the ice arena. Item #3. FIG Well Project. • City Engineer Keith Nelson stated that the City's growth and water usage will result in the need for construction of Well #18. Due to past well interference complaints and difficulty obtaining an appropriation permit for Well #17, the DNR placed several requirements on the City of Lakeville before another well permit would be issued. The DNR is requesting that the City explore the Franconia-Ironton-Galesville (FIG) aquifer, which is below the Prairie duChein-Jordan aquifer, from which Lakeville's water is currently drawn. It may be necessary to drill to a depth of 200 feet to reach an adequate water supply. The new well is intended to be a high peak-only well, and not be used for daily production of water. There are three locations that could be used for the wells where an adequate radius exists around the existing wells. Possible locations would be the Water Treatment Facility, Valley Park, and North Park. City staff and the DNR would closely monitor the test results. Council directed staff to place preparation of plans and specifications for a FIG observation well on the next Council agenda for consideration. Item #4. Recreational Uses on Outlots All Saints Catholic Church and Hosanna! Lutheran Church wish to construct private softball and soccer fields and running tracks on outlots adjacent to their respective church campuses. Lakeville ordinances do currently allow fences and retaining walls in outlots, however, building permits for structures are not available unless the property is platted. Churches are reluctant to plat the property since storm sewer and development fees would apply. Council directed staff to allow minimal recreational uses on outlots so long as they • pay the required building permit fees. City Council Work Session Minutes May 22, 2006 Page -3- Item #5, Lakeville Dump Investigations The former dump site on 205th Street in downtown Lakeville has never been formally closed by the MPCA, although an environmental review completed by Barr Engineering in 1994 did not indicate any contamination. Dakota County would like to take additional water samples in deeper groundwater zones on the property and conduct further investigations into potential methane gas, tests which were not previously done. Dakota County will fund the study 100%, however staff is concerned that trees and brush will need to be removed in the process, eliminating the buffer between the park and the neighbors. Any cleanup costs would be the City's responsibility. Council directed stafF to proceed with a cooperative effort with Dakota County to investigate possible public safety hazards at the former Lakeville dump site. Item #6. Strategic Plan: First Quarter Report 2006 Assistant to City Administrator Brian Anderson provided an update on accomplishment of goals of the 2006-08 Strategic Plan and the progress which has been made on several tasks. Item #7. Lakeville Policy Manual • The purpose of the Policy Manual is to consolidate all existing City policies into one document. Several new policies are also being proposed for Council consideration. The document will allow greater efficiency for staff and assist in responding to inquiries concerning policies. Phase two will include additional policies for Council consideration. Item #8. 'One State One Future" Video Council Members received a DVD produced by John Kaul and Lightshed Productions entitled, °One State One Future" which highlights traffic and transportation in the state of Minnesota. The video points out the problems with the highway system and supports the constitutional amendment which the City of Lakeville also endorsed, appropriating funding in a more equitable manner. Council Members may support showing the video on Cable TV, but would like to see the Dakota County video piece first. Item #9. Four-year Term for Mayor A recent survey determined that most Minnesota cities now elect Mayors to four-year terms. The Council feels there are many benefits to four-year mayoral terms. Public comments on the proposed change will be solicited and public input will be sought in the coming months. The ordinance change is proposed to take effect with the 2008 election. Council directed staff to begin seeking public input on the proposed change from atwo-year to a four-year Mayoral term. City Council Work Session Minutes May 22, 2006 • Item #10. Other Business Page -4- City Administrator Steve Mielke updated the Council on the proposed ice arena. The City Administrator and Finance Director are working on a formula which would allow use of .the new arena by groups other than the Lakeville School District and the LHA. Provisions will be made in the Joint Powers Agreement for use of the facility by other athletic groups. It is anticipated that Council will review and discuss a draft of the JPA at their June work session. The possibility of adding dry-land activities to one of the Ames Arena rinks in the summer is also being examined. This could be a potential revenue source for the arena. Item #11. Adjourn.
