Minutes City of Lakeville City Council Work Session Monday, August i3, 200 5:0o p.m. .Marion Conference Room Lakeville City Hall C • In attendance: Council Members Laurie Rieb, Wendy Wulff, Mark Bellows, and Kerrin Swecker. Also in attendance: .City Administrator Steve Mielke, Assistant to City Administrator Brian Anderson, Parks and Rec. Director Steve Michaud, Finance Director Dennis Feller, Community and Senior Planner Brian Kempa along with several community members. i. Smoking in the Parks Ordinance/Policy (Michaud) Mr. Michaud addressed the City Council by providing feedback to the two questions that City Council-raised at the April i~ Work Session. Question is How many school sites boundaries abut existing park sites where signs and regulations against smoking already exist? Answer: In District i94 there are two sites (Kenwood Junior High and Orchard Lake Elementary School) .where the school and city park boundaries abut each other. Both schools abut smaller neighborhood parks and are connected by trails only. Other City properties such as Lakeville Ames Arena connects to Lake Marion Elementary School and Lakeville North High School, while Lakeville.. Arena 3 abuts McGuire Junior High and Kennedy Elementary School. There are no signs posted at any of these sites. Question 2: What has the experience been of other cities that have implemented no smoking policies? Answer: Staff contacted Eagan and Savage. At both cities, staff informed us that signs had been installed and no official enforcement action .has taken place. Staff felt at both cities, the signs have provided a public awareness which may have influenced people's choices to smoke. Mr. Michaud went on to state that nearly ioo cities in Minnesota had adopted some type of :regulation or policy addressing tobacco use in parks: Regulations ranged from a few cities adopting actual ordinances banning smoking with misdemeanor penalties to cities establishing policies or park rules banning smoking in parks and public places. Many of the policies in place are using a voluntary compliance regulation with no penalties. Some cities have established policies that request volunteer compliance where and when children are present at park facilities, such as athletic complexes and/or playgrounds. The City of Lakeville Parks, Recreation, and Natural Resources Committee recommended approval of a voluntary compliance no smoking in the parks ordinance. City Council discussed the proposal and stated that there was more of an issue with littering of .cigarette buts, pop bottles, candy wrappers, etc. in the parks than there was with smoking as the .City hasn't received any smoking complaints. In addition, the majority of the cities that have passed an ordinance don't enforce it or have the resources to enforce it. City Council felt that it would defeat the purpose of passing an ordinance on anon-issue, especially without the resources of enforcement. City Council directed staff to table the topic indefinitely. 2. Nich Mahowald -Historical Society Dedication Mr. Michaud informed the City Council that the Lakeville Historical Society has completed the bronze memorial plaque in honor of Nicholas Mahowald that was discussed at the April l~h Work Session. Mr. Mahowald was an employee of the City for 45 years and held several positions, including Lakeville's first Chief of Police. The date for the dedication program is Tuesday, September 4th, 200 at 6:0o p.m. prior. to the scheduled .City Council meeting. The event will take place at Pioneer Plaza in downtown Lakeville. In addition, they are asking that the City proclaim September 4tn as Nicholas Mahowald Day.. City Council directed staff to proceed with the dedication as discussed and made no changes to the program. 3. 2008-2009 Budget Review Mr. Feller presented to the City Council the 2008-2009 Proposed Budget and outlined the salient components in each of the major funds. After discussing the general, special revenue, internal. service, capital projects and enterprise funds, Mr. Feller outlined the tax narrative. The City Council made some general comments and inquired about a few items but made no changes to the funds. Likewise, the City Council discussed the tax levy, tax rate and the proposed impact to the residential properties but made no changes to the 2008-2009 Proposed Budget. City ..Council directed staff to bring .forth the 2008-2009 Proposed Budget at an upcoming City Council meeting in order to certify the tax levy which needs to occur prior to September 15tH, 4. Other a) This Week Newspaper Office Location Mr. Mielke informed City Council that the This Week Newspaper will be leaving their office in Lakeville and consolidate their operations with their office in Burnsville. After some discussion, City Council directed staff to continue printing Messages in the This Week newspaper but to consider the lowest bidder ..for publishing the City's legal notices. b) Luick Committee Assignments i. Personnel No decisions were made regarding committee assignments other than TAB. ii.
