FEBRUARY 16, 1995
The meeting was called to order by Chair Luick at 6:00 p.m. in the City Hall
Council Chambers.
Chair Luick introduced and welcomed newly appointed Commission member
Laurie Rieb.
Roll call of members was taken. Present: Holberg, Amborn, Steigerwalt, Luick,
Skipton, Reib. Absent: Miller.
Also present: Robert Erickson, City Administrator; Michael Sobota, Community
and Economic Development Director; Tim Walston, Assistant City Attorney;
Daryl Morey, City Planner; Tim Hanson, Assistant City Engineer; Mira Holliday,
Recording Secretary.
The minutes of the February 2, 1995 Planning Commission meeting were approved
as printed.
ITEM 4
• The public hearing to consider the application of Trinity Evangelical Free Church
for a conditional use permit to allow the construction of an off-site parking area on
land located in the northwest corner of Kenwood Trail (C.R. S) and Klamath Trail
was opened. The City Attorney attested that all legal notices had been duly
published and mailed.
Chair Luick stated that he is a member of Trinity Evangelical Free Church and
would be abstaining from all discussion and action on the issue. He turned the
meeting over to Vice Chair Skipton.
Daryl Morey introduced Dave Zech, Dakota County Highway Department who
discussed how the County Road 5 improvement project impacted the church. Mr.
Zech stated that the need for the parking lot expansion was driven in part by the
County Road 5 project.
Mr. Morey presented an overview of the proposed conditional use permit,
outlining the planning report dated February 9, 1995. His review included the
following:
• Background
• Traffic congestion at Klamath Trail
• • Proposed off-site parking lot

• • Inability to combine lots due to parcels being in two different sections
(Sections 1 and 2, Township 114, Range 21)
• Ordinance requirements for off-site. parking
• Lighting of parking lots
• Screening adjacent to property owner to the north
• Security for landscaping
• Engineering Department recommendations
• Dakota County Soil and Water Conservation District recommendations
• Environmental Affairs Committee recommendations
Mr. Morey stated staff recommends approval of the proposed conditional use
permit subject to ten stipulations listed in the planning report.
Jerry Rypkema, Chairman of the Board of Trustees for Trinity Church, was
present and stated the church had lost many parking spaces that were previously
used along County Road 5 before the reconstruction project.
Holberg questioned why no tree preservation plan had been prepared. Staff
explained that only the platting process requires a formal tree preservation plan,
however the County Highway Department located the significant trees on site with
• the help of the City Forester, -Mick Higgins. Strgar, Roscoe, Fausch, the City's
consulting engineer prepared a plan showing the identified significant trees to be
saved.
Holberg also questioned the effect the relocation of the parsonage driveway would
have on the trees.
Tim Phenow, Strgar, .Roscoe, Fausch, addressed the tree survey and stated he
pursued several alternatives utilizing the various factors including driveway grades,
parking lot grades, screening of the property to the north, traffic circulation and
access to Klamath Trail in the design of the proposed parking lot.
The Commission held a discussion which included the following:
• Design and grade of driveway
• Tree protection fencing
• Color of block to be used on retaining walls
• .Drainage
• Possible oil skimmer
Robert Erickson explained to the Commission that Trinity Church had approached
the City for technical assistance in dealing with the parking design in recognition of
condemnation action between Dakota County, the City of Lakeville, and the

• Church. He went on to state that Strgar Roscoe Fausch, the City's consulting
engineer evaluated the parking plan submitted by the church and presented design
alternatives, taking into consideration the significant trees in the area. Mr.
Erickson also stated that the consultant has met with the adjacent property owners
to the north, the Holloways.
PUBLIC COMMENT:
Mike Dougherty, attorney representing Mr. and Mrs. Holloway, expressed
opposition to the proposed parking lot, stating an appraisal had been done on the
property and should the parking lot be constructed, an estimated $50,000
devaluation to the Holloway property would occur. Mr. Dougherty also stated the
parking lot would. not be compatible with the surrounding area. He also
questioned future expansion of the church. Mr. Dougherty submitted a letter to
the Commission dated February 16, 1995, outlining the concerns of the Halloways.
Don Reigstad, Pastor of Trinity Church stated there are no plans to expand the
church in the future.
Mike Halloway, adjacent property owner, expressed concern over the loss of trees,
potential drainage problems, and lights in the parking lot. He also expressed
• concern over safety of entrance/exit to the parking lot and possible use of the
parking lot by the Y.M.C.A.
Tim Bergerson, 16508 Kingsley Court, stated he felt the church could eliminate the
need for an additional parking lot by having three services spaced thirty minutes
apart. He also. stated that construction debris had been left at the church site after
construction of the sanctuary and questioned future upkeep of the property. Mr.
Bergerson went on to state that he felt one exit to the parking lot would be
sufficient and that too many trees would be lost with the project as proposed.
Tim Hanson addressed the traffic concerns in the area and the need for improved
circulation.
.Pastor Reigstad extended an invitation to any one interested, to attend a Sunday
morning, 11:00 service o see all the congestion onto Klamath Trail
The Commission further discussed traffic circulation, lighting of the parking lot,
and tree preservation.
Jerry Rypkema addressed the issue of building materials to be cleaned up at the
church site. He stated that siding will be completely installed before the proposed
. conditional use permit is reviewed by City Council. He also stated that there were
some bricks left over from sanctuary construction that were intended to be used

• for a sign. Mr. Rypkema stated that the church signage will be completed by mid
spring.
Amendments to the stipulations of the planning report were proposed by the
Commission as follows:
7. The two proposed shoe box parking lot lights shall be no more than 20 feet in
height. When there are activities at the church, the parking lot lights shall be
turned offby 10:00 pm. and when there-are no activities at he church, the
parking lot lights shall not be lit.
11. Tree protection fencing shall be installed at the drip lines around all trees
designated to be saved prior to construction of the parking lot expansion.
95.19 Motion was made by Steigerwalt, seconded by Amborn to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
95.20 Motion was made by Steigerwalt, seconded by Amborn to recommend approval of
the application of Trinity Evangelical Free Church for a conditional use permit to
allow the construction of an off-site parking area on land located in the northwest
• corner of Kenwood Trail (C.R. 5) and Klamath Trail subject to the planning report
dated February 9, 1995 as amended, the engineering report dated February 10,
1995 and the Dakota County Soil and Water Conservation District report dated
February 10, 1995 and the findings of fact.
Roll call was taken on the motion. Ayes: Amborn, Steigerwalt, Skipton, Reib.
Abstain: Luick. Nay: Holberg.
The reason Holberg voted nay was she felt significant trees had not been identified
and there should be more planning alternatives considered.
ITEM 5 and 6
The public hearing to consider the application of the City of Lakeville for a
rezoning from R-2, Single Family Residential District, B-4 General Business
District and I-1, Limited Industrial District to BC, Business Campus District; the
preliminary and final plat of Fairfield Business Campus; and a minor
Comprehensive Plan amendment to bring the property into the Year 2000 Urban
Service Area, all on land located north of 210th Street and east of Kenrick Avenue
was opened. The City Attorney attested that all legal notices had been duly
published and mailed.

The public hearing to consider the application. of New Morning Windows for a
conditional use permit to allow a light manufacturing use in a BC, Business
Campus District on land located north of 210th Street and east of Kenrick Avenue
was opened. The City Attorney attested that all legal notices had been duly
published and mailed.
Michael Sobota stated that staff and Cary Richman, President of New Morning
Windows, are requesting that he items be tabled pending revised plans for the
project which will incorporate all details required in the staffreport.
95.21 Motion was made by Steigerwalt, seconded by Skipton to continue the public
hearing for item number 5.
Roll call was taken on the motion. Ayes: Unanimous.
95.22 Motion was made by Holberg, seconded by Skipton to continue the public hearing
for item number 6.
Roll call was taken on the motion. Ayes: Unanimous.

A presentation/discussion regarding Coping With Infill Development was given
by Ann Perry, former Director of Planning with the City of Minnetonka.
There being no further business, Chair Luick adjourned the meeting at 10:15 p.m.
