PLANNING COMMISSION MEETING MINUTES
MARCH lb, 1995
The meeting was called to order by Chair Luick at 6:00 p.m. in the City Hall Council
Chambers.
Roll call of members was taken. Present: Holberg, Amborn, Luick, Reib, Miller.
Absent: Steigerwalt, Skipton.
Also present: Robert Erickson, City Administrator; Michael Sobota, Community and
Economic Development Director; 7irn Walston, Assistant City Attorney; Daryl
Morey, City Planner; Frank Dempsey, Associate Planner; Tim Hanson, Assistant City
Engineer; Mira Holliday, Recording Secretary.
The minutes of the March 2, 1995 Planning Commission meeting were approved as
printed. -
ITEM 4
The public hearing to consider the application of Faith Lutheran Church for a
conditional use permit to allow a day care facility was opened. The City Attorney
attested that all legal notices had been duly published and mailed.
• Frank Dempsey presented an overview of the proposed conditional use permit,
outlining the planning report dated March 8, 1995. His review included the following:
• Background
• Zoning
• Zoning Ordinance requirements
• Comprehensive Plan
• Surrounding land uses and zoning
~ Lot requirements and setbacks
• Sewer and water
• Screening
• Parking
• Loading
• Signage
• Day care facility
• Outdoor play area
• Sign -non conforming
• Marcus Cable parking lot encroachment
• .Right of way encroachment in church parking lot
Mr. Dempsey stated that staffrecommends approval of the proposed conditional use
permit amendment request for Faith Lutheran Church subject to four stipulations listed
in the planning report.
Representatives of the church and day care provider were present to answer questions
of the Commission and public.

The Commission held a discussion which included:
• Right of way encroachment
• Future outdoor play area (safety in regard to shared area with Marcus Cable)
• Future access onto Cedar Avenue for Marcus Cable
There was no public comment.
An amendment to the stipulations listed in the planning report was made as follows:
5. A shared access easement between the church and Marcus Cable should be
recorded and the Cedar Avenue excess right of way encroaching into the Faith
Lutheran Church parking lot should be vacated.
95.29 Motion was made by Holberg, seconded by Amborn to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
95.30 Motion was made by Holberg, seconded by Miller to recommend approval of the
• application of Faith Lutheran Church for a conditional use permit to allow a day care
facility subject to the planning report dated March 8, 1995 as amended and the findings
of fact.
Roll call was taken on the motion. Ayes: Unanimous.
ITEM 5
The public hearing to consider the application of Winkler Development for the
preliminary plat of 100 single family residential lots to be known as Lakeview Estates
and a minor Comprehensive Plan amendment to bring the property into the Year 2000
Urban Service Area was opened. The City Attorney attested that all legal notices had
been duly published and mailed.
Daryl Morey presented an overview of the proposed preliminary plat, outlining the
planning report dated March 10, 1995. His review included the following:
• Background
• Zoning and adjacent land uses
• Consistency with the Comprehensive Plan
• Phasing
• Density
• Lots/blocks
• Outlots
• Setbacks
• Streets and access to 205th Street

• • Berming/landscaping
• Grading, drainage, erosion control, and utilities
• Engineering recommendations
• Dakota County Soil and Water Conservation District recommendations
• Environmental Affairs Committee recommendations

• Park and trail dedication
• MUSA
Mr. Morey stated that staff recommends approval of the proposed preliminary plat
subject to the stipulations listed in the planning report.
Bart Winkler, Winkler Development, was present along with Joel Cooper, James R.
Hill and Associates, and Dale Pexa, adjacent property owner.
The Commission held a discussion which included:
• Future development of adjacent Pexa property
• Screening of lots adjacent to commercial use to the south
• Tree protection fencing during grading
• Outlot B (proposed acquisition by City for neighborhood park)
• Temporary cul-de-sac adjacent to Pexa property
• Length of blocks
• Spruce trees in addition to cedar and pine trees and dogwood shrubs for screening
Public comment:
Stan Morentz, 20312 Jupiter, questioned if there would be a trail along 205th Street.
He also expressed concern over construction traffic in the neighborhood.
Tim Hanson stated that a trail along 205th Street is planned to be constructed in the
future when the road is upgraded. No date has been set for the upgrade. Joel Cooper
discussed construction traffic.
Steve Munchow, 20503 Juno Trail, questioned the depth of the pond in the northeast
corner of the plat and what measures will be taken for preservation of trees. He stated
he was pleased with the revised plan that will preserve more trees in the drainage
easement area near his home.
Staff responded.
• Amendments to the stipulations of the planning report were recommended as follows:
14. The tree preservation and planting details sheet shall be revised to list the required
minimum plant sizes for the proposed oak trees and dogwood shrubs. In
addition, the developer shall add spruce trees to the proposed pine and cedar trees

for bufferinglscreening purposes consistent with Zoning Ordinance
recommendations. Landscaping shall be installed consistent with the approved
tree preservation and planting plan and the tree preservation and planting details
sheet.
16. All prospective owners of lots in Phase III of Lakeview Estates shall be informed
of the adjacent BC zoned Fairfield Business Campus to the south.
95.31 Motion was made by Holberg, seconded by Miller to close the public hearing.
Roll call was taken on the motion.. Ayes: Unanimous.
95.32 Motion was made by Holberg, seconded by Amborn to recommend approval of the
application of Winkler Development for the preliminary plat of 100 single family
residential lots to be known as Lakeview Estates and a minor Comprehensive Plan
amendment to bring the property into the Year 2000 Urban Service Area subject to
the planning report dated March 10, 1995 as amended, the engineering report dated
March 10, 1995, and the Dakota County Soil and Water Conservation District report
dated March 9, 1995.
Roll call was taken on the motion. Ayes: Unanimous.

ITEM 6
The public hearing to consider the application of the City of Lakeville for a major
Comprehensive Plan amendment to revise the generalized land use plan for the I-
35/C.R. 46 freeway interchange was continued from the January 5, 1995 Planning
Commission meeting.
Michael Sobota provided background information and discussed issues raised by the
City of Burnsville regarding the access of Dupont Avenue/Kent Trail connecting with
Co. Rd. 46. He stated that staff recommends approval of the revised alignment and
proposed land uses.
Mr. Sobota also stated that. residents present at the January 5, 1995 Planning
Commission meeting and adjacent property owners were notified of the continued
public hearing and no comment had been received.
There was no public comment.
The Commission held a discussion which included City zoning requirements for
screening between the commercial and residential areas. Planning Commission
• members expressed concerns regarding the Burnsville City Council's resolution
pertaining to commercial uses next to in place residential properties in Burnsville. The
members indicated the current Zoning Ordinance requirements were adequate. The
Commission also discussed access onto County Road 46 between Kenyon. Avenue and

• County Road 5. Staff indicated no other access would be allowed at County Road 46
by Dakota County.
95.33 Motion was made by Miller, seconded by Holberg to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
95.34 Motion was made by Miller, seconded by Amborn to recommend approval of the
application of the City of Lakeville for a major Comprehensive Plan amendment to
revise the generalized land use plan for the I-35/C.R. 46 freeway interchange subject
to the memorandum dated March 10, 1995.
Roll call was taken on the motion.. Ayes: Unanimous.
Michael Sobota discussed upcoming Planning Commission agenda items and
summarized recent City Council actions.
There being no further business, Chair Luick adjourned the meeting at 7:30 p.m.
