Planning Commission Meeting Minutes
JUNE 4, 2009
The June 4, 2009 Planning Commission meeting was called to order by Chair Davis
in the City Hall Council Chambers at 6:00 p.m.

ITEM 3. APPROVAL OF MEETING MINUTES:
Commission Lillehei requested bullet four on page 6 be revised to be read: "Mr.
Miler indicated that he would prefer to keep the current shed. He was told by the
City that he did not need a building permit for the shed if it was not larger than 40=
120 square feet
The May 21, 2009 Planning Commission meeting minutes were approved as
amended.
ITEM 4. ANNOUNCEMENTS:
Mr. Morey stated that the following items were distributed to the Planning
Commission at tonight's meeting:
A. The June 3, 2009 Parks, Recreation and Natural Resources Committee
meeting motion regarding the Cedar Avenue Park and Ride preliminary
and final plat.
Mr. Morey asked the Planning Commission if they would consider switching the
July meeting dates from the 2nd and 16th to the 9th and 23rd.
Mr. Morey explained that the reason for this is due to July 3rd being a City holiday
and traditionally the first Planning Commission meeting in July is cancelled due to

the Independence Day holiday. In order to keep moving forward on the Zoning
Ordinance update, which cannot be scheduled for discussion at the June 18
meeting due to the absence of Planning Consultant Daniel Licht, Mr. Morey would
like to schedule the next work session discussion as soon as possible, which would
be July 9th.
The Planning Commission agreed to re- schedule the meetings to July 9 and July 23.
ITEM 5. METROPOLITAN COUNCIL (METRO TRANSIT)
Chair Davis opened the public hearing to consider the application of the
Metropolitan Council for the following, located east of Cedar Avenue (CSAH 23)
and south of 179th Street; A. Preliminary and Final Plat of one lot to be known as
Cedar Avenue Park and Ride; B. Zoning map amendment to rezone proposed Lot 1,
Block 1, Cedar Avenue Park and Ride from RM -1, Medium Density 'Residential
District to P -OS, Public Open Space District; C. Conditional Use Permit to allow
an automobile parking lot as a principal use in the P -OS, Public Open Space
District; D. Variance to allow a bus shelter to be set back less than 30 feet from the
Cedar Avenue (CSAH 23) right -of -way. The Recording Secretary attested that the
legal notice had been duly published in accordance with State Statutes and City
Code.
Lindsey Sheppard from the Metropolitan Council and Dan Bower from EVS
Engineering presented an overview of their request. Ms. Sheppard indicated that
this proposed park and ride is a part of the Urban Partnership Agreement (UPA)
project that is a Federal grant given to the metro region to help with congestion
reduction, and bus service is a part of this.
Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey
stated that Planning Department staff recommends approval of the Cedar Avenue
Park and Ride preliminary and final plat, zoning map amendment, conditional use
permit, and variance subject to the 5 stipulations listed in the May 29, 2009 planning
report.
Chair Davis opened the hearing to the public for comment.
There were no comments from the audience.
09.27 Motion was made and seconded to close the public hearing at 6:24p.m.
Ayes: Glad, Adler, Davis, Pattee, Grenz, Drotning.
Nays: Lillehei. If the public hearing would get tabled, he wanted it left open.

Chair Davis asked for comments from the Planning Commission. Discussion points
were:
Planned extension of 181St Street and likelihood of a traffic signal at 181St
Street and Cedar Avenue.
Location of the proposed bus shelter. Some Commissioners indicated a
preference to have the bus shelter in a more centrally located spot within the
combined Phase 1 and 2 parking lot.
Safety concerns for parked cars having to back out into the bus drive aisle.
Handicapped patrons having to cross the bus drive aisle to get to the bus
shelter.
If the Planning Commission recommended approval of Phase 1 at tonight's
meeting would they also be approving the parking lot expansion for Phase
2? Mr. Morey indicated that historically conditional use permits that include
a conceptual future expansion do not require an amendment provided the
expansion is constructed according to the approved plans. He stated that it
would be at the Planning Commission's discretion if they would require a
CUP amendment for the Phase 2 construction.
Dan Bower explained the design factors involved with the Cedar Avenue
Park and Ride plans. Consideration of the future Cedar Avenue BRT was a
determining factor.
Discussion on why the buses would have to pull into the park and ride lot to
load rather than loading off of Cedar Avenue or 181St Street. Metro Transit
responded that this park and ride will be the end of the line for now, so the
buses will need to turn around to head back downtown. Metro Transit
prefers the buses turn around off- street and loading off of 181St Street instead
of the park and ride site is not acceptable.
What would the construction timing for Phase 2 be if only Phase 1 is
completed at this time? Ms. Sheppard indicated that Phase 2 would be
constructed when funding was available and when demand warranted the
expansion.
How many buses will serve this park and ride? Metro Transit responded
that there would be three or four buses initially, spaced about 15 -20 minutes
apart in the morning and evening rush hours.

Mr. Morey made some comments on possible site plan design modifications to
address the concerns raised by the Planning Commission. The buses could enter at
the east end of the site, load in the central drive aisle between Phases 1 and 2, and
exit at the westerly proposed access off of 181St Street. Under this scenario, the bus

shelter would be more centrally located. Metro Transit and EVS Engineering will
work with City staff to address the site plan modifications.
Mr. Morey suggested that if the Planning Commission decides to table the planning
applications so Metro Transit can address the concerns raised by the Planning
Commission, he recommended that it not be date specific.
The Planning Commission agreed that Metro Transit should consider revising the
plans to address the following concerns:
Relocate the bus shelter so it is more centrally located within the site.
Minimize the number of parking stalls that are accessed directly off of the
bus drive aisle to improve site circulation and traffic safety.
Minimize handicapped patrons having to cross the bus drive aisle to access
the bus shelter.
09.28 Motion was made and seconded to table action on the planning applications to a
future Planning Commission meeting so Metro Transit can address the concerns
raised by the Planning Commission.
Ayes: Adler, Lillehei, Davis, Pattee, Grenz, Drotning, Glad.
Nays: Glad. Commissioner Glad felt this project was ready to bring to a vote at
tonight's meeting.
ITEM 6. NEW BUSINESS
Chair Davis asked the Planning Commission if they were available on June 25, 2009
to attend a presentation by City Attorney Roger Knutson pertaining to a training
session on the role of the Planning Commissioner. He felt it would be very
beneficial given the number of relatively new commission members.
After polling the Planning Commissioners this date would not work.
There being no further business, the meeting was adjourned at 7:27 p.m.
