HomeMy WebLinkAbout05-05-94 CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES MAY 5, 1994 The meeting was called to order by Chair Holberg at 7:00 p.m. in the City Hall Council Chambers. Roll call of members was taken. Present: Whitehouse, Steigerwalt, Holberg, Skipton, Smith, Miller. Absent: Luick. Also ppresent: Robert Erickson, City Administrator; Jim Walston, Assistant. City Attorne ;Michael Sobota,, Community and Economic Development Director; Jeff Oliver, Consulting Engineer; Daryl Morey, City Planner, Mira Holliday, Recording Secretary. The minutes of the Apri17, 1994 Planning Commission meeting were approved as printed. ITEM 4 The public hearing to consider the application of Plymouth Land, Inc. for the preliminary and final plat of 25 single family residential lots to be known as Creek View Estates and a minor comprehensive plan amendment to bring the property into the Year 2000 Urban Service Area on land located on the east side of Highview Avenue, north of 16$th Street West was opened. • The City Attorney attested that all legal notices had been duly published and mailed. Daryl Morey reviewed the proposed preliminary and final plat, outlining the planning report dated Apnl 29,1994. His review included the following: - Background - Zoning and adjacent land uses - Consistency with the Comprehensive Plan - Phasing - Density - Lots/Blocks - Outlots Setbacks - Streets - Berming/landscaping along Highview Avenue - Grading, drainage and erosion control - Environmental Affairs Committee recommendation - Engineering recommendations - Dakota County Soil and Water Conservation District recommendations - Utilities and removal of City utility building - Tree preservation - Wetlands - Park and trail dedication - MUSA PLANNING COMMISSION MINUTES MAY 5, 1994 PAGE 2 Mr. Morey stated that staff recommends approval of the preliminary and final plat of Creek View Estates subject to 10 stipulations listed in the planning report. John Peterson of Plymouth Land, Inc. was present and stated he is in agreement with the recommendations of the planning report. He stated that he does not agree with the new lot size requirement which was implemented January 1,1994, however he noted that grading is easier for larger lots. He asked for clarification regarding the cash escrow for Highview Avenue, tree preservation plan security and trail charges. Staff responded. The Commission held a discussion which included: - Future access to the civil defense siren when moved and minimize time when siren is inoperable - Signage far wetland conservation area (4x4 posts) - Surface water - draintile - Tree protection fencing - Removal of trees in swale - Tree preservation plan • _ Cost savings on grading due to large lot sizes Possibility of trailway between Lots 10 and 11 Public comment: Mark Bedning of 16790 Hersey Court expressed his concern over possible drainage onto his property. He also expressed his concern over the need for a park in the area. He stated the nearest park is one mile away and there is no trail. access. He also questioned who would be responsible if trees on his property die during the construction process of the new. subdivision. Staff responded. Walter Michaels of 18657 Hamilton Drive expressed his concern over the possibility of drainage into his backyard in the event of heavy rains. Staff responded. Jill Jacobson of 8246166th Street questioned when the other vacant land in the area would be developed. Staff indicated it was up to the property owner. After discussion, amendments to the recommendations listed in the planning. report were made as follows: 4. Outlot B shall be deeded to the City. Outlot C shall be assessed for storm sewer area charges. • PLANNING COMMISSION. MINUTES MAY 5, 1994 PAGE 3 6. The tree preservation plan shall be revised to reflect the required Black Hills Spruce or Colorado Blue Spruce for the berm/landscape screen located along Highview Avenue. The berm/landscape screen shall be installed prior to the issuance of any building permits in this ..plat. The tree preservation .plan shall be revised to include tree protection fencing along the north side of the drainage Swale located at the rear of Lots 1- 7, Block 1. 7. The City utility building, excluding the utility equipment, must be demolished and the civil defense siren must be moved to a location acceptable to the City prior to the issuance of .any building permits in this plat. 94.45 Motion was made by Steigerwalt, seconded by Smith to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 94.46 Motion was made by Smith, seconded by Whitehouse to recommend approval of the application of Plymouth Land, Inc. for the preliminary and final plate of 25 single family residential lots to be known as Creek View Estates and a minor comprehensive plan amendment to bring the property into the Year 2000 Urban Service Area on land located on the east side of Highview Avenue, north of 168th Street West subject to the planning report dated Apri129,1994 as amended, the engineering. report dated April 28, 1994 and the Dakota County Soil and Water Conservation District report dated April 29, 1994. Roll call was take on the motion. Ayes: Unanimous. ITEM 5 Daryl Morey presented an overview of the proposed final plat of Country Pond South 7th Addition, outlining the planning report dated Apri129, 1994.. His review included the following: - Background - History - Zoning and adjacent land uses - Consistency with. the approved preliminary plat - Lats/blocks - Outlots - Setbacks - Streets - SidewalksJtrailways - Grading, drainage and erosion control • _ Tree preservation Wetlands - Park and trail dedication - MUSA PLANNING COMMISSION MINUTES MAY 5,1994 PAGE 4 Mr. Morey stated that staff recommends approval of the Country Pond South 7th Addition final plat subject to 12 stipulations listed in the planning report. Ralph Wagner of GRQ Development was present and stated he is in agreement with staff recommendations. The Commission held a discussion which included: - Street names - The Dakota County Soil and Water Conservation District report dated April 5,1994 was inaccurate - Design speed at 174th Street and Gage Avenue Amendments to the stipulations listed in the planning report were as follows: 2. Delete stipulation number 2 and replace with: Warning signs for sharp turns must be installed on 174th Street south of the wetland in both directions. 94.47 Motion was made by Steigerwalt, seconded by Skipton to recommend approval of the final plat of Country Pond South 7th Addition subject to the planning report dated April 29,1994, as amended and the engineering report dated Apri128, 1994. Roll call was taken on the motion. Ayes: Unanimous. ITEM 6 Michael Sobota reviewed the proposed final plat and site plan of Crystal Lake Club House, outlining the planning report dated April 26, 1994. His review included the following: - Planned unit development and site plan - Replat of outlot - Setbacks - Future building height - Building materials - Building expansion - Parking - Landscaping/screening - Signage - Lighting - Trash receptacles - Beer and wine license. • - Laud speaker Mr. Sobota stated that staff recommends approval of the final plat of Crystal Lake Club House subject to 11 stipulations listed in the planning report. PLANNING COMMISSION MINUTES MAY 5,1994 PAGE 5 Jeff Hultgren, Freeborn Mower, Ltd. was present and stated he is in agreement with staff recommendations. The Commission held a brief discussion. 94.48. Motion was made by Miller, seconded by Skipton to recommend approval of he final platof Crystal Lake Club.House subject to the planning report dated April 26,1994 and site plan approval. Roll call was taken on the motion. Ayes: Unanimous. ITEM 8 Mary Liz Holberg provided a report to the .Commission on the final recommendations of the Parks and Recreation Bond Referendum Task Force. 94.49 Motion was made by Steigerwalt, seconded by Smith to support the recommendations of the Parks and Recreation Bond Referendum Task Force. Roll call was taken on the motion. Ayes: Smith, Whitehouse, Steigerwalt, Holberg, Skipton. Nay: Miller.
