Roll call of members was taken. Present: Whitehouse, Steigerwalt, Holberg, Skipton, Miller. Absent: Luick, Smith.. Also present: Robert Erickson, City Administrator; Michael Sobota, Community and Economic Development Director; Jim Walston, Assistant City Attorney; Daryl Morey, City Planner; Frank Dempsey, Associate Planner; Tim Hanson, Consulting Engineer; Mira Holliday, Recording Secretary. The minutes of the May 5, 1994 Planning Commission meeting were approved as printed. ITEM 4 The public hearing to consider the application of David and Barbara Arens for a building setback variance from the Ordinary High Water Level of Orchard Lake to allow the construction of a garage on an existing single family residential dwelling was opened. The City Attorney attested that all legal notices had been duly published and mailed. Frank Dempsey revised the proposed variance, outlining the planning report dated May 10, 1994. His review included the following: • Two site plan options representing different shoreline setbacks from Orchard Lake • Background • Zoning • Minimum setbacks • Building height • Surrounding land uses • Comprehensive plan • History. • DNR comments • Zoning Ordinance requirements Mr. Dempsey stated that staff recommends approval of the variance proposed as Option I provided minimal impact to the shoreline and setback is achieved through • four stipulations listed in the planning report. i PLANNING COMMISSION MEETING MINUTES MAY 19,1994 PAGE 2 Mr. And Mrs. Arens were present. The Commission held a discussion which included: • Additional living space in the loft • Possibility of loss ofoak tree and consultation with forester • Future use of property if sold • Elevation of existing house in relation to ordinary high water level • Shed to be removed at time of certificate of occupancy rather than when building permit is issued • Storage location of fishhouse There was no public comment. Amendments were made to the stipulations listed in the planning report as follows: 3. The existing shed and. lean-to shall be removed from the site prior to issuance of a certificate of occupancy. 5. A forester shall be consulted regarding the oak tree. 94.50 Motion was made by Miller, seconded by Whitehouse to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 94.51 Motion was made by Miller, seconded by Skipton to recommend approval of the application of bavid and Barbara Arens for a building setback variance from the Ordinary High Water level of Orchard Lake to allow the construction of a garage on an existing single family residential dwelling subject to the planning report dated May 10, 1994, the DNR report dated May 13, 1994 and the findings of fact. Roll call was taken on the motion. Ayes: Steigerwalt, Holberg, Skipton, Whitehouse. Nay: Miller. The reason for Miller's nay was he felt there were too many unanswered questions regarding the usage of the building and the elevation from the ordinary high water level. The City Y q Attorney attested that all legal notices had been duly published and mailed. Frank Dempsey presented a review of the proposed special home occupation permit, outlining the planning report dated May 11, 1994. His review included the following: • Background • Surrounding. land uses • No customer traffic • Spray finishing products cannot be permitted • City Fire Marshal determination • Zoning Ordinance requirements Mr. Dempsey stated that staff recommends approval of the special home occupation permit request subject to seven stipulations listed in the planning report. Mr. Skara was present to answer questions of the Commission and public. The Commission held a discussion which included: • Storage of fabric • Wood finishing operation conducted off site • Possibility of installing a spray booth for the wood finishing There was no public comment. 94.52 Motion was made by Miller, seconded by Steigerwalt to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 94.53. Motion was made by Steigerwalt, seconded by Miller to recommend approval of the application of Robert Skara for a special home occupation permit to allow the operation of an upholstery repair business in a single family residence located at 17299 Jonquil Avenue subject to the planning report dated May 11, 1994 and the findings of fact. Roll call was taken on the motion. The City Attorney attested that all legal notices had been duly published and mailed. The public hearing to consider the application of Arcon Development, Inc. For the vacation of existing drainage, ponding, street, and utility easements on land located south of 165th Street West at Jaguar Avenue was opened. The City Attorney attested that all legal notices had been duly published and mailed. Daryl Morey reviewed the proposed preliminary and final plat and drainage, ponding, street, and utility easement vacation, outlining the planning report dated May 13, 1994. His review included the following: • Background • Zoning and adjacent land uses • Consistency with the Comprehensive Plan • Phasing • Density • Lots/blocks • Outlot • Setbacks • Streets • Prohibited driveway access onto 165th Street (Lot 1, Block 1 and Lot 1, Block 7) • Berming/landscaping • Grading, drainage and erosion control • Engineering recommendations • bakota County Soil and Water Conservation District recommendations • Environmental Affairs Committee recommendations • Utilities • Tree .preservation • Conservation easement • Park and trail dedication • MUSA • Neighborhood meeting • PLANNING COMMISSION MEETING MINUTES MAY 19, 1994 PAGE 5 Mr. Morey stated that staff recommends approval of the Lynwood North 7th Addition preliminary and final plat and easement vacations subject to 14 stipulations listed in the planning report. Scott Johnson, Arcon Development was present and displayed a landscape plan for the subdivision. He stated he was in agreement with staff recommendations. The Commission held a discussion. which included: • Timeframe for landscaping around the pond • Dakota County Soil and Water Conservation District report regarding sedimentation to be removed from the storm water pond • Security for tree preservation /mass grading • Parks and open space in surrounding areas • Left turn lane on Jaguar Avenue to County Road 46 • Traffic flow on Jaguar Avenue • Hammer head driveways at intersection of minor collectors • Grade of driveway on Lot 2, Block 3 • Street .names • Tree inventory Paul Wachtler of 10139 165th Street uestioned street li is and traffic control q ~ signs proposed to be installed at the intersection of 165th Street and Jaguar. Staff responded. Amendments to the stipulations in the planning report were made as follows: 11. Prior to November 1, 1994, the developer shall- install landscaping around the storm water pond located on Outlot A consistent with the approved landscape plan. The city will reimburse the developer for the cost of landscaping the pond. 15. Driveway turnarounds shall be installed on Lot 10, Block 4 and Lot 1, Block 6. 94. 54 Motion was made by Steigerwalt, seconded by Skipton to close the public hearing for the preliminary and final plat. Roll call was taken on the motion. Ayes: Unanimous. 94.55 Motion was made by Steigerwalt, seconded by Whitehouse to close the public hearing for the easement vacations. Roll call was taken on the motion. Ayes: Unanimous. Roll call was taken on the motion. Ayes: Unanimous. 94.57 Motion was made by Steigerwalt, seconded by Whitehouse to recommend approval of the application of Arcon Development, Inc. For the vacation of existing drainage, ponding, street, and utility easements on land located south of 165th Street West at Jaguar Avenue subject to the planning report dated May 13, 1994 as amended and the engineering report dated May 16, 1994. Roll call was taken on the motion. Ayes: Unanimous. ITEM 7 The public hearing to consider the application of Town and Country Homes for a rezoning from R-A, Single Family-Agricultural Residential District to R-2, Single Family Residential District on land located south of 175th Street and west of Highview Avenue was opened. The City Attorney attested that all legal notices had been duly published and mailed. The public hearing to consider the application of Town and Country Homes for the preliminary plat of 196 single family residential lots to be known as Town and Country First Addition and a minor comprehensive plan amendment to bring the property into the Year 2000 Urban Service Area on land located south of 175th Street and west of Highview Avenue was opened. The City Attorney attested that all legal notices had been duly published and mailed. Daryl Morey reviewed the proposed rezoning and preliminary plat, outlining the planning report. dated May 13, 1994. Country First Addition preliminary plat and R-A to R-2 rezoning requests subject to 15 stipulations listed in the planning report. Kevin Von Reidel and Tom Ryan of Town and Country Homes along with Alan • Kretman of RLK were present. They discussed the tree preservation plan. and addressed the farm dump issue. Jim Walston stated that the legal description which was published in the public hearing notices included Outlots F and G, but that these outlots should not be included in the rezoning and preliminary plat.. He further stated that the subdivision ordinance requires that all lots be final platted into lots and blocks within two years from the time of preliminary plat approval. The Commission held a discussion which included: • Setbacks and building pad on Lot 17, Block 7 • Landscaping • Screening from school building and softball fields • Cul-de-sac • Barricades at stub streets (to be discussed at time of final plat) Irene Mowery of 17750 Iberia expressed her concern over the snowmobile trails. Robert Erickson indicated a committee is being formed to address this issue. Terry Grady of 17740 Icon Trail commended the developers on the layout of the development. He expressed concern over the view from his backyard into adjacent lots. He stated he would like to have screening between his property and the ,1 PLANNING COMMISSION MEETING MINUTES MAY 19, 1994 PAGE 8 proposed plat. He also questioned grading and drainage in the area. Staff responded. Amendments to the stipulations listed in the planning report were as follows: 4. All phases of the proposed preliminary plat must be final platted into lots and blocks, not outlots, within two years after the preliminary plat has been .approved by the City Council or the .preliminary plat of all phases not so final platted within the two year period ,shall be void. 6. Outlots F and G shall be removed from rezoning and preliminary plat consideration and the rezoning and preliminary plat plans shall be so modified. 94.58 Motion was made by Whitehouse, seconded by Steigerwalt to close the public hearings. Roll call was taken on the motion. Ayes: Unanimous. 94.59 Motion was made by Whitehouse, seconded by Steigerwalt to recommend approval of the application of Town and Country Homes for a rezoning from R-A, S Single Family-Agricultural Residential District to R-2, Single Family Residential District on land located south of 175th Street and west of Highview Avenue subject to the planning report dated.May 13, 1994 as amended, the engineering report dated May 13, 1994 and the Dakota County Soil and Water Conservation District report dated May 12, 1994. Roll call was taken on the motion. Ayes: Unanimous. 94.60 Motion was made by Steigerwalt, seconded by Whitehouse to recommend approval of the application of Town and Country Homes for the preliminary plat of 196 single family residential lots to be known as Town and Country First Addition and a minor comprehensive plan amendment to bring the property into the Year 2000 Urban Service Area on land located south. of 175th Street and west of Highview Avenue subject to the planning report dated May 13, 1994 as amended, the engineering report dated May 13, 1994 and the Dakota County Soil and Water Conservation District report dated May 12, 1994. Staff requested that the Kenwood Oaks proposed final plat and easement vacations be tabled pending a revised submittal by the developer. 94.61 Motion was made by Whitehouse, seconded by Steigerwalt to table action on the application of Render Development,. Inc. for the vacation of an existing drainage and utility easement on land located at 11215 Kenora Way and consideration of the final plat of Kenwood Oaks Second Addition. Roll call was taken on the motion. Ayes: Unanimous. Under unfinished business, Michael Sobota discussed plans for expansion of commercial uses north of downtown.
