PLANNING COMMISSION MEETING MINUTES
JULY 7, 1994
The meeting was called to order by Chair Holberg at 7:00 p.m. in the City Hall Council
Chambers.
Roll call of members was taken. Present: Whitehouse, Luick Steigerwalt, Holberg,
Skipton, Miller. Absent: Smith.
Also present: Robert Erickson, City Administrator; Michael Sobota, Community and
Economic Development Director; Jim Walston, Assistant City Attorney; Daryl Morey,
City Planner; Mira Holliday, Recording Secretary.
The minutes of the June 16, 1994 Planning Commission meeting were approved as
..printed. '
ITEM 4
The public hearing to consider the application of Frederic E. Haas for the preliminary and
final plat of seven single family residential lots to be known as Beachside on land located
on the west side of Judicial Road, north of 175th Street. was opened. The City Attorney
• attested that all legal notices had been duly published and mailed.
Daryl Morey presented an overview of the proposed plat, outlining the planning report
dated July 1, 1994. His review included the following:
• Density
• Lots/blocks
• Outlots
• Setbacks
• Streets
• Grading, drainage, erosion control and utilities
• Engineering report dated July 1, 1994
• Dakota County Soil and Water Conservation District report dated June 24,
-1994
• Environmental Affairs Committee recommendation
• Tree preservation
• Wetlands
• Park and trail dedication
• MUSA -amendment to Comprehensive Plan not needed

Mr. Morey stated that staff recommends approval of the preliminary and final plat of
Beachside subject to the stipulations listed in the planning report.
Fred Haas was present to answer questions of the Commission and public
The Commission held a discussion .which included:
• Wetlands
• Previous vacation of Lynch Path
• Tree preservation on cul-de-sac lots
• Possibility of settlement of fill on same lots
• EAC recommendation (approval)
• Conservation easement /possible future need of drainage and utility easement
• Removal of debris dumped on the site
• Outlots G & F, Liberty heights
• Speed limit on Judicial Road
• Screening along Judicial Road
Andrew Wardrop of 17328 Judicial Road questioned the driveway access for Lots 1, 6
• and 7. He also questioned drainage and possible covenants for the plat. Staff and Mr.
Haas addressed the issues.
The amended recommendations listed in the planning report were agreed to as follows:
1. Implementation of the recommendations listed in this report and the
July 1, 1994 engineering report.
9. Delete.
(New) 9. Recommend conveyance of City owned property and the proposed
transfer of said property is in compliance with the Comprehensive Plan
of the City.
5. Driveway access for Lots 1, 6 and 7, Black 1 shall be off of Liberty
Beach Court.
8. The developer shall dedicate to the City a 35 - 45 foot wide
conservatian easement located at the rear of Lots 1-4, Block 1 as
shown on the final plat.

94.77 Motion was made by Miller, seconded by Skipton to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
94.78 Motion was made by Steigerwalt, seconded by Luick to recommend approval of
the application of Frederic E. Haas for the preliminary and final .plat of seven single
family residential lots to be known as Beachside on land located on the west side
of Judicial Road, north of 175th Street subject to the planning report dated July 1,
1994 as amended, the engineering report dated July 1, 1994, and the Dakota
County Soil and Water Conservation District report dated June 24, 1994.
Roll call was taken on the motion. Ayes: Unanimous.
There being no further business, the meeting was adjourned at 7:50 p.m.
