PLANNING COMMISSION MEETING NIINUTES
SEPTEMBER 8, 1994
The meeting was called to order by Chair Holberg at 7:00 p.m. in the City Hall
Council Chambers.
Roll call of members was taken. Present: Whitehouse, Steigerwalt, Holberg,
Smith, Miller. Absent: Luick, Skipton.
Also present: Robert Erickson, City Administrator; Michael Sobota, Community
and Economic Development Director; Jim Walston, .Assistant City Attorney;
Daryl Marey, City Planner; Frank Dempsey, Associate Planner; Tim Hansen,
Assistant City Engineer; Mira Holliday, Recording Secretary.
The minutes of the August 18, 1994 Planning Commission meeting were approved
as printed.
ITEM 4 -CONSENT AGENDA
94.102 Motion was made by Miller, seconded by Steigerwalt to recommend approval of
the consent agenda as listed:
• 1. The final pat of Bracketts Crossing Third Addition.
2. The final plat of Crystal Lake Country Club.
Roll call was taken on the motion.. Ayes: Unanimous.
ITEM 5
Jim Walston presented a brief overview of the findings of fact regarding the
application of Kwik Trip, .Inc. for a conditional use permit to allow a Kwik Trip
convenience store and gas station in a B-4 District.
94.103 Motion was made by Steigerwalt, seconded by Smith to receive and adopt
findings of fact regarding the application of Kwik Trip, Inc. for a conditional use
permit to allow a Kwik Trip convenience store and gas station in a B-4 District.
Roll call was taken on the motion. Ayes: Unanimous.
Consideration of the final plat of Kwik Trip Lakeville remains tabled from the
Augustl8, 1994 Planning Commission meeting.

The public hearing to consider the application of Stampings of Minnesota,
Incorporated for a conditional use permit to allow a loading berth to be located on
a corner lot, facing 220th Street, located at 21980 Hamburg Avenue was opened.
The City Attorney attested that all legal notices had been duly published and
mailed.
Frank Dempsey presented an overview of the proposed loading berth, outlining the
planning report dated August 29, 1994. His review included the following:.
• Background and revised plan submitted September 6, 1994
• Zoning
• Comprehensive Plan
• Building height
• Building exterior
• Lot requirements
• Surrounding land uses
• Screening/landscaping
• • Off-street parking
• Total number of employees
• Storm sewer area charges
Walter Schmidt representing Stampings of Minnesota was. present to answer
questions of the Commission and public.
The Commission held a discussion which included:
• Number of employees per shift
• Parking
• Timeline for completion date of landscaping and pavement of the parking
areas
There was no public comment.
The stipulations listed in the planning report were amended as follows:
1. The site shall be developed according to the site grading and landscape plan
dated September 6,.1994.
• 2. Pavement of parking areas and landscaping shall be installed as per the site
grading and landscape plan dated September 6,1994 and shall be installed no

• later than November 1 1994. If the avement and landsca in are not

.installed by November 1, 1994, a cash escrow or letter of credit in the sum of
$10,000 shall be submitted to the City of Lakeville and the pavement and

94.104 Motion was made by Smith, seconded by Miller to close the public hearing.

94.105 Motion was made by Smith, seconded by Steigerwalt to recommend approval of
the application of Stampings of Minnesota, Incorporated for a conditional use
pernut to allow a loading berth to be located on a corner lot facing 220th Street,
located at 21980 Hamburg Avenue subject to the planning report dated August 29,
1994 as amended and the findings of fact.

ITEM 7
The public hearing to consider the application of Tollefson Development, Inc. for
the preliminary and final plat of 58 single family residential lots to be known as
Greenwood Estates and a minor Comprehensive Plan amendment to bring the
property into the Year 2000 Urban Service Area on land located on the south side
of 165th Street, west of Ipava Avenue was opened. The City Attorney attested
that a111ega1 notices had been duly published and mailed.
Daryl Morey presented. an overview of the proposed preliminary and final plat,
outlining the planning report dated September 1, 1994. His review included the
following:
• .Background
• Zoning and adjacent land uses
• Consistency with the Comprehensive Plan
• Density
• Lots/blocks
• Outlots
• Setbacks
• Streets
• Berming/landscaping
• Grading, drainage and erosion control
• Utilities.

Mr. Morey stated a neighborhood meeting was held September 1st and that staff
recommends approval of the Greenwood Estates preliminary and final plat and
minor Comprehensive Plan amendment subject to 17 stipulations listed. in the
planning report.
Carl Tollelfson, developer of the proposed plat was present. He stated he was in
agreement with the recommendations of City. staffi
The Commission held a discussion which included:
• Tree preservation
• Conservation easement
• Fencing
• Barricades on Island Terrace
• Time frame for development of adjacent property.
• Neighborhood meeting
• Public comment:
Dave Lindquist, 16771 Jacksonville Court, expressed concern over oak wilt in the
area:
Tom Olmsted, 16791 Jacksonville Court, questioned the future development of
The Boulders property. He stated he would like to see a connection to Ipava
Avenue for the twin homes constructed with the first phase of the Boulders. He
also requested that a temporary stop sign be installed at Jackpine Way and
Jackpine Trail in an effort to control the speed of construction traffic.
Tom Ryan, adjacent property owner, discussed the current use of his property
which is agricultural. He stated he does not plan to develop his property within
the next ten years. He went on to discuss his concerns regarding he future water
tower, future townhomes to the north, stating the area should remain R-2 and not
PUD. He also discussed his use of an electric fence to keep his cattle on his
property, stating that debris from construction sites to the south blow onto his
property. Mr. Ryan reviewed a report prepared by Northwest Associated
Consultants on alternate concepts for his property. He stated he does not think the
NAC plan is in his best interest and .did not have adequate time to further develop
his own concepts. He was concerned over the proposed street connection of
Island Terrace.

Robert Erickson addressed the issues raised by Mr. Ryan. He further stated that
the design of 1VIr. Tollefson's plat is commendable for an environmentally sensitive
area and that the concepts for Mr. Ryan's property would be further reviewed
when. Mr. Ryan proposed development of his property. Mr. Erickson stated the
Greenwood Estates subdivision road connections were based on extensive staff
analysis.
94.106 Motion was made by Miller, seconded by Smith to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
The Commission amended the stipulations of the planning report as follows:
6. A street segment shall be constructed on the east side of Island Terrace, as
shown on the grading, drainage and erosion- control plan. A street barricade
shall be placed at the east end of this street segment until it is extended when
the property to the east develops.
18. The City Council shall review the issue of construction traffic and temporary
• installation of a stop sign at Jackpine Way and Jackpine Trail
94.107 Motion was made by Steigerwalt, seconded by Smith to recommend approval of
the application of Tollefson Development, Inc. for the preliminary and final plat of
58 single family. residential lots to be known as Greenwood Estates and a minor
Comprehensive Plan amendment to bring the property into the Year 2000 Urban

The public hearing to consider the application of Henry and Florence Lau for the
preliminary and final plat of two single family residential lots to be known as Lau
Addition, a lot area variance for each of the two. proposed lots, and a lot width
variance for one of the two proposed lots on land located at 12072 and 12079
168th Street West was opened. The City Attorney attested that all legal notices
had been duly published and mailed.

Mr. Morey stated that staff recommends approval of the Lau Addition preliminary
and final plat and variance requests subject to five stipulations listed in the planning
report.
Mr. and Mrs. Lau were present. Mr. Lau requested that he be allowed to keep the
shed which currently exists on the property for storage. He further .stated that the
person planning to purchase one of the proposed lots was present. Mr. Lau stated
that a setback variance had been granted in 1967 or 1968 for his current residence
• on the lake.
Staff requested that the item be tabled to later in the meeting. to allow time to
discuss plans of the person purchasing the property.
ITEM 11
Robert Erickson presented a brief overview of the proposed resolution regarding
TIF District 15. He discussed the Century Refining operation and stated that staff
recommends adoption of the resolution.
The Commission held a brief discussion.
94.108 Mation was made by Smith, seconded by Whitehouse to adopt a resolution of the
Lakeville Planning Commission finding the proposal for modification of Airlake
Redevelopment.Project No 1, Establishment of Tax Increment Financing District
No. 15 (Century Refining) located within the redevelopment project No. 1 and
proposal for approval and adoption of the financing plan relating thereto to be
consistent with the Comprehensive Plan of the City.
Roll call was taken on the motion. Ayes: Unanimous.

Consideration of the Lau Addition was continued. The Commission held a
discussion which included:
• Existing variances on the property
• Retaining wall
• Installation of driveway on north lot
• Possible bluff
Robert Erickson stated he would research Planning Commission and City Council
minutes from 1967 and 1968 to determine if a variance had been granted for Mr.
Lau's property. The proposed owner that was present also agreed tot he
stipulations of the planning report.
There was no public comment.
94.109 Motion was made by Smith, seconded by Whitehouse to close the public hearing.

94.110 Motion was made by Steigerwalt, seconded by Smith to recommend approval of
the application of Henry and Florence Lau for the preliminary and final plat of two

Whitehouse, Miller.
The reason Whitehouse and Miller voted nay was they felt research on the
variances granted in 1967 or 1968 should. have been completed prior to
recommendation on this application.
ITEM 9
The public hearing to consider the application of Richard Hindt for. a building
setback variance to allow an existing. garage addition to remain on an existing
single family residential dwelling, and the vacation of a portion of a drainage an
• utility easement, .all located at 6655 Upper 167th Street West was opened. The
City Attorney attested that all legal notices had been duly published and mailed.

Frank Dempsey presented an overview of the proposed variance and easement
vacation, outlining the planning report dated August 29, 1994. He stated that Mr.
Hindt purchased the property in 1984 without knowledge of the non-conforming
addition. In selling the house in 1994, it was discovered that the garage addition
was constructed over the easement. Mr. Dempsey's review further included the
following:
• Zoning
• Zoning Ordinance requirements
• Surrounding uses
• Existing fence and swirnrning pool installed in 1975
• Third stall on west side of garage constructed over drainage and utility
easement
• City Attorney review and recommendation
• Engineering review and recommendation
Mr. Dempsey stated that staff recommends approval of the variance and easement
vacation subject to five stipulations listed in the planning report.
Mr. Hindt was present and stated he had been. required to place $5,000 is escrow
with the title company that is handling the sale of his home until the variance and
easement vacation has been processed with the City. Therefore, he requested that
the security amount of $2,500- required by the City. be waived.. Mr. Hindt also
stated that he would attempt to submit the signed letters prior to City Council
consideration from the three adjacent property owners stating that they have no
problem with the existing fence being located on their property..
The Commission held a discussion which included the following:
• Reconstruction of garage addition in the event it were destroyed
• Contact of private utility companies regarding easement vacation
• .Gravel driveway in front of third garage stall
Jim Walston and Robert Erickson recommended-that the issue be tabled pending.
notification of the current property owner.
94.111 Motion was made by Smith, seconded by Miller to continue the public hearing to
consider the application of Richard Hindt for a building setback variance to allow
an existing garage addition to remain on an existing single family residential
dwelling and the vacation of a portion of a drainage and utility easement, located
• at 6655 Upper 167th Street.

The public hearing to consider the application of Dennis G. Leisten for a building.
setback variance from the Ordinary High Water Level of Orchard Lake and a front
yard building setback variance to allow .the construction of a garage addition on to
an existing non-conforming single family residential dwelling, on anon-conforming
lot located at 12300 168th Street West was opened. The City Attorney attested
that all legal notices had been duly published and mailed.

planning report dated August 29, 1994. His review included the following:
• Background
• Zoning
• Zoning Ordinance requirements
• Lot area
• Impervious surface area
• Front yard wetback
• • OHWL
• Conversion of existing garage into living space
• Minnesota Department of Natural Resources recommendation
• Dakota County Soil and Water Conservation District recommendation
Mr. Dempsey stated that staff recommends approval of the variance subject to six
stipulations listed in the planning report.
Mr. Leisten was present to answer questions. of the Commission and public.
The Commission held a discussion which included:
• Elevations
• Outside access to deck (stairs not shown on plan)
• Location of proposed stairs
• Future structure outside of double doors leading from garage
• Width of concrete slab located on lower level
The Commission and staff agreed that detailed drawings should be submitted prior
to recommendation of the Commission.

94.112 Motion was made by Smith, seconded by Miller to continue the pubic hearing to
consider the application of Dennis Leisten for a building .setback variance from the
Ordinary High Water Level of Orchard Lake and a front yard building setback
variance to allow the construction of a garage addition on to an existing non-
conforming single family residential dwelling, on anon-conforming lot located at
12300 168th Street West.
Roll call was taken on the motion. Ayes: Unanimous.
There being no further business, Chair Holberg adjourned the meeting at 10:45
p.m.
