Roll call of members was taken. Present: Whitehouse, Luick, Steigerwalt, Holberg, Skipton. Absent: Smith, Miller. Also present: Robert Erickson, City Administrator; Michael Sobota, Community and Economic Development Director; Jim Walston, Assistant City Attorney; Frank Dempsey, Associate Planner; Mira Holliday, Recording Secretary. The minutes of the October 27, 1994 Planning Commission meeting were approved as printed. ITEM 4 The public hearing to consider the application of Cooperative Power Association for a conditional use permit to allow the installation of a 115 kilovolt overhead electrical transmission line along Dodd Boulevard between 160th Street West and Cedar Avenue was opened. The City .Attorney attested that all legal notices had been duly published and mailed. Frank Dempsey presented an overview of the proposed installation of a 115 kilovolt overhead electrical transmission line, outlining the planning report. dated November 9, 1994. His review included the following: • Zoning Ordinance provisions for transmission lines • Comprehensive plan • Zoning/land uses in corridor • Transportation plan • Facility needs for electrical power • Existing overhead electrical distribution lines • Pole locations and proximity to existing homes • Electromagnetic field (EMF's) • Possible impact on property values • Proposed comdor • Alternate power pole locations • Neighborhood meetings held Mr. Dempsey stated that staff recommends approval of the conditional use permit • .subject to two stipulations listed in the planning report. .i PLANNING COMMISSION MEETING NIINUTES NOVEMBER 17, 1994 PAGE 2 Will Kaul, Director of Environmental and Regulatory Services for Cooperative Power, stated they are in agreement with the recommendations of City staff. The Commission held a brief discussion regarding the closest distance of the proposed transmission line to existing homes,. the impact of EMF's and the voltage on each of the proposed three lines. Public Comment: Ed McMenomy, 15782 Chipendale, Rosemount, MN, stated his parents own 60 plus acres in the Dodd/Cedar area which they plan to develop in the near future. He expressed his concern over damages to property value andthe effects of EMF. He questioned if the transmission line could be buried and asked if consideration had been given to the transmission line being placed on the north side of Dodd Boulevard. Mr. Kaul stated that to bury the transmission line would bean 800 percent cost increase. Mr. Kaul also stated that if the line were buried, aheat reduction system would require above ground structures and oil cooling systems. Robert Erickson stated. that staffwould not object to a portion of the transmission line being placed • on the north side of Dodd Boulevard. He further stated Cooperative Power had proposed placement of the line where they felt it would have the least impact. He went on to state there would be no impact on the pond in Cedar Highlands Park and that a study conducted by the City indicated there had been no devaluation of property in other. areas of the City where transmission lines were. in existence. Mr. Cecil Hoover, 17067 Gage Avenue, presented a petition signed by area property owners opposing the transmission line over existing homes.. He also expressed concern over the possible effects of EMF, the possibility of a pole hitting a house in the event it should fall, and the possibility of burying the line. He further requested that the Planning Commission recommend the City Council not approve the conditional use permit until the transmission line is proposed for an undeveloped area or buried. Mr. Hoover also suggested that the transmission line be moved to the Pilot Knob Road corridor east of the North Creek Mobile Home Park and then west across undeveloped property. Jim Walston questioned if the poles. would be placed in highway right of way. Bill McGoldrick, Land Use Manager for Cooperative Power discussed right of way widths. Michael Sobota addressed the right of way for future expansion of Dodd Boulevard. Robert Erickson discussed the dedication of right of way by future developers as a requirement of platting without reimbursement by the City or County or the purchase of right of way from current property owners by • Cooperative Power at this time. PLASII~TING COMMISSION MEETING MINUTES NOVEMBER 17, 1994 PAGE 3 • Mr. Sobota responded to Mr. Hoover's alternate route and the reasons the transmission line could not be placed east of the mobile home park including impact on homes along Pilot Knob and the corridor across undeveloped property not in a road right of way would mean the power lines may actually be closer to future homes. Tim Schmidt, 17144 Gannon Way, expressed concern over potential health problems in young children, stating he plans to open a day care center in his home. He also expressed concern over how close the lines would be to his home should it be moved north of Dodd Boulevard. Mr. Sobota responded. John Murtfeldt, 17099 Dodd Boulevard, stated he would like to see the line buried and wanted to know exactly where the poles would be located. Ron Predovich, Transmission and Construction Manager, addressed the proposed placement of the poles and distance to homes. He also raised concerns regarding the impact the poles and the future widening (ROW) of Dodd Boulevard would have on the trees in his front yard. Mary Elias, 16570 Dodd Boulevard, stated she has 48 significant trees between her • home and Dodd Boulevard. She expressed concern over the possibility of loosing some of the trees which have been appraised at $19,000. She also stated she was concerned over loosing her "green acres" status should the County take part of her property for right bf way. She also asked if the poles would be made in Mexico, expressing her concern over the low wages that are paid for such labor. She also stated she felt the transmission line should be underground and questioned what effects the EMF's would have on farm/crop land. City staff addressed Ms. Elias' concerns. A representative of Cooperative Power Association indicated the poles are manufactured in Redwing, Minnesota. Tom Hargrove, Fraiser Path, expressed concern over the effects of EMF. Scott Schoaf, 16840 Florin Avenue stated he felt too much. emphasis was being placed on the. cost of the transmission line rather than the health risks. Linda Murtfeldt, 17099 Dodd Boulevard, questioned the fallowing: Cost per person far the transmission line; cost for moving the line from one side of the road to the other; who actually pays for the line; what is considered a "danger tree"; are the trees that have to be removed paid for by Cooperative Power; the effect of EMF if the line is buried; how many volts are under the line; how many feet away from the line is it to get a 0 EMF reading;. what are the chances of the poles being • doubled. for more power lines in the future; when will construction begin if approved. Mr. Kaul noted that transmission lines have not been buried in any other residential area in Minnesota. He .indicated that the only location where transmission .lines have been buried are in downtown Minneapolis. Brad Hibben, 16702 Flagstaff Avenue, questioned'the study conducted regarding property values. He also questioned the effect of ESF (electro .static field). Mr. Walston discussed the review of the sale of homes in other areas of the City and Mr. Kaul discussed the ESF stating no scientific evidence is available on ESF impacts.. Delores Farnsworth, 17043 Fraiser Path, questioned the cost of burying the transmission line. Terry Madsen, 6545 L. 169th Street, indicated he felt the line should be buried. Cecil Hoover asked the Planning commission and staff if they would live near a transmission line. Randy Pinson, Dakota Electric, stated he has lived near a transmission line for eight years and has no complaint. Sue Mahles, Dakota Electric, discussed the existing distribution lines along Dodd Boulevard to be buried as a part of this project. Tony Cravens, 17149 Gannon Way, questioned the current need for the proposed transmission line. Ms. Mahles responded. 94:173 Motion was made by Steigerwalt, seconded by Luick, to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. The Commission and staff discussed an'alternate plan forthe transmission line pole locations in the vicinity of Cedar Highlands Park and the vertical elevation of the lines. The Commission agreed pole number 21, 22 and 23 should be located on ...the. north side of Dodd Boulevard. Pole 24 on the south and poles 25 throught 31 should be on the north side. The vertical height of the lines was agreed to be raised to a minimum of 30 feet ground clearance at pole numbers 19 and 20. Line height for poles 22 and 23 should be increased to minimize impact on trees. 94.174 Motion was made by Whitehouse, seconded by Luick to recommend approval of the application of Cooperative Power Association for a conditional use permit to • allow the installation of a 115 kilovolt overhead electrical transmission line along PLANNING CONIlVIISSION MEETING NIINUTES NOVEMBER 17, 1994 PAGE 5 Dodd Boulevard between 160th Street West and Cedar Avenue subject to the planning report dated November 9, 1994 with modified Exhibit O. Roll call was taken on the motion. Ayes: Unanimous. ITEM 5 The public hearing to consider the. application of the City of Lakeville for a major Comprehensive Plan amendment to revise the generalized land use plan for. the I- 35/C,R. 46 freeway interchange was opened. The City Attorney attested that all legal notices had been duly published. Michael Sobota reviewed the land use study prepared by Northwest Associated Consultants dated November 1994 and recommended the Commission table the item pending comments from neighboring jurisdictions. Vernon Lorentzen, 10969 W. 162nd Street stated his objection to the City HRA taking a remnant of his property. Mr. Erickson stated that was not the subject of the public hearing. • The Commission held a brief discussion regarding County Road 5 being a four lane road and the R-1 zoned praperty located across from commercial zoned property. Public Comment: Mike Edling, 1b338 Jewel Avenue asked about the proposed Kwik Trip store and plans for the adjacent property. Staff responded that the site plan for Kwik Trip would require a public hearing. The design would require screening between Kwik Trip and the neighboring residential properties. Jay Young, 16238 Jewel. Avenue, also asked questions regarding the proposed Kwik Trip site and access to County Road 46. Ed Bach, .16306 Jewel Avenue expressed concern over property values after the interchange is completed. 94.175 Motion was made by Whitehouse, seconded by Steigerwalt to continue the public hearing to consider the application. of the City of Lakeville for a major .Comprehensive Plan amendment to revise the generalized land use plan for the I- 35/C.R. 46 freeway interchange to allow additional time for camments from neighboring jurisdictions. • Roll call was taken on the motion. Ayes: Unanimous. .PLANNING COMMISSION MEETING M7[NUTES NOVEMBER 17, 1994 PAGE 6 ITEM 6 The public hearing to consider the application of the City of Lakeville for a minor Comprehensive Plan amendment for minor MUSA boundary adjustments due to the conversion from a manual mapping system to an automated Geographic Information System was opened. The City Attorney attested that all legal notices had been duly published. Michael Sobota presented an overview of the proposed Comprehensive Plan amendment, outlining the planning .report. dated November 10, 1994. He explained that as part of the City's preparation of the Comprehensive Sanitary Sewer Plan, a new MUSA GIS map has been prepared. on an AutoCAD system. This new MUSA map utilizes land information obtained from the Dakota County Surveyors Office, rather than the previous map which is based on state plane coordinates done on DigiCAD software. The new map will be tied to property line data from the Dakota County Surveyors office. The Commission held a brief discussion. Public comment: Mike Smith stated he felt legal descriptions should be used in the creation of the map. Staff stated that legal descriptions are currently being used. 94.176 Motion was made by Whitehouse, seconded by Steigerwalt to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 94.177 Motion was made by Steigerwalt, seconded by Luick to recommend approval of the application of the City of Lakeville for a minor Comprehensive Plan amendment for minor MUSA boundary adjustments due to the conversion from a manual mapping system to an automated Geographic Information System subject to the planning report dated November 10, 1994. Roll call was taken on the motion.. Ayes: Unanimous. .UNFINISHED BUSINESS The Commission held a discussion regarding Planning Commission meetings beginning at 6:00 p.m. after January 1, 1995. • 94.178 Motion was made by Steigerwalt, seconded by Luick to recommend to the City Council that Planning Commission meetings begin at 6:00 p.m, in 1995.
