HomeMy WebLinkAbout0733 ORDINANCE NO. 733 CITY OF LAKEVILLE DAKOTA COUNTY, IvRNNESOTA AN ORDINANCE AMENDING ORDINANCE NO.711 BY EXTENDING THE TEMPORARY PROHIBITION OF APPROVALS OF .CERTAIN RESIDENTIAL DEVELOPMENTS FOR AN ADDITIONAL EIGHT MONTH PERIOD THE CITY COUNCIL OF THE CITY OF LAKEVTi .i .R ORDAINS: SECTION 1. Background. On April 15, 2002, the City adopted Interim Ordinance No. .711 which temporarily prohibited approval of certain residential development within the City of Lakeville. The Lakeville .Planning Commission and City staff initiated a review of the Zoning Ordinance approximately two years following the Zoning Ordinance Update approved by the City Council on July 17, 2000, consistent with the direction of the City Council at the time the Zoning Ordinance Update was adopted. The Planning Commission has held eight work sessions. to review the scope' of work, to receive and discuss proposed amendments from City staff„and to receive comments from townhouse developers regarding performance standards far townhouse uses. The Planning. Commission .and City. staff need to hold additional work sessions. to discuss proposed amendments to .townhouse performance standards to and to receive additional comments from townhouse developers.. The Planning. Commission will then work on a comprehensive review and update of the City's Zoning Ordinance pertaining to the performance standards for multiple family residential dwellings and update of the City's comprehensive sanitary sewer and water plans. The City Council believes that the Planning Commission will not have sufficient time to complete these revisions to the Comprehensive Plan and Zoning Ordinance or sufficient time for tfie City Council to review the recommendations of the Planning Commission before the expiration of the moratorium provided in Ordinance No. 711. The City is authorized under Minn.. Stat. § 462.355, subdivision 4, to extend the .Interim Ordinance for additional. periods not to exceed 18 months. The City Council has determined. that an eight month extension of Interim Ordinance. No. 711 is necessary for the City Council to review and adopt appropriate amendments to the City's zoning ordinance concerning appropriate controls for multiple family residential subdivisions. SECTION 2. Section 4 of Ordinance No. 711 is hereby amended to read as follows: Pending. the completion of the above referenced activities and adoption of .appropriate official controls, no plat for residential development in the RST-2, RM-1, RM-2, RH-1 and RH-2 zoning districts or for medium, medium high, and high density residential developments as designated on the 2020 land use plan in the PUD zoning district shall be processed or approved and no applications for such approval will be accepted. This ordinance shall not apply to the following:.. (1) Plats .which have been. preliminarily approved by the City Council prior to the adoption of this ordinance, unless that approval is void pursuant to Sections 10-2-2 and 10-2-3 of the Lakeville City Code. (2) Plats for senior housing. (3) Plats for which a sketch plan or preliminary plat application has been completed and filed with the City prior to April 11,.2002. (4) Plats for manufactured homes as defined in Minn. Stat. § 327.31, Subd. 6. (5) Plats for churches. (6) Plats for schools. (7) Administrative subdivisions. (8) Plats for developments located within the MUSA and the RM-1 district where (a) the development is shown conceptually on an approved preliminary plat as a future phase or (b) the development is necessary to accommodate construction of 173' Street, a minor collector street which necessary to provide a connection to 170th Street and Pilot Knob Road as identified in the City's transportation plan.. and to provide sidewalk and trail connections as identified in the City's Comprehensive Park, Trail and Open System. Plan. SECTION 3. Section S of Ordinance No. 711 is hereby amended to read as follows:.. This ordinance shall take effect upon passage and :shall: remain- in effect until. it is repealed in conjunction. with the date of the adoption of the official controls contemplated hereunder or December 15, 2003, whichever occurs first.
