HomeMy WebLinkAbout07-21-08CITY OF LAKEVILLE COUNCIL MEETING MINUTES JULY 21, 2008 Mayor Dahl called the meeting to order at 7:00 p.m. The pledge of allegiance to the flag was given. Present: Mayor Holly Dahl Council Member Mark Bellows Council Member Kerrin Swecker Council Member Laurie Rieb Council Member Wendy Wulff Roger Knutson, City Attorney Steve Mielke, City Administrator Tom Vonhof, Police Chief Keith Nelson, City Engineer Dennis Feller, Finance Director Daryl Morey, Planning Director Steve Michaud, Parks & Recreation Director Charlene Friedges, City Clerk Mr. Mielke had no additional agenda information. Presentations/Introductions Chief Vonhof presented a proclamation for National Night Out. The National Night Out kick-off event will be held during the Police Station Grand Opening on Sunday, August 3rd. Council Member Wulff read the proclamation proclaiming August 5, 2008, National Night Out in Lakeville. Chief Vonhof presented the June Police Department monthly report. Steve Michaud presented the June monthly report of the Parks & Recreation Department. Park Maintenance & Operations Manager John Hennen highlighted the park maintenance division. Citizens' Comments John Lenvik, 16598 Galena Avenue, expressed concerns regarding an abandoned house in his neighborhood anal the unsightly and unsafe condition of the property. He stated he feels City staff has been unresponsive to his concerns, and he would appreciate a status update. CITY OF LAKEVILLE COUNCIL MEETING JULY 21, 2008 Page 2 Mayor Dahl referred the matter to City staff. Troy Molde, 17925 Fulda Trail, addressed the City Council regarding an incident at his home involving Lakeville police officers, in which he felt his fourth amendment rights were violated. He stated he filed a demand for a public hearing regarding police policies. The demand was filed with the City Administrator, who indicated that the Council members would make a decision as to whether or not they choose to hold a public hearing. He asked the Council to place this matter on their next agenda. Morries Pietz, 16593 Galena Avenue, expressed concerns regarding the unsightly condition of the property located at 16605 Galena Avenue. The occupant has unlicensed vehicles and a salvage collection in the yard. Mayor Dahl referred the matter to City staff. Carolyn Spark, 3660 Pilot Knob Road, stated she read the newspaper article regarding the incident at Mr. Molde's home, and she does not agree that his fourth amendment rights were violated by the Lakeville police officers. She stated she felt the officers were doing their job and should be commended for trying to help this family. Nancy Lazaryan, 10734 West Lake Road, Rice, MN, stated she represents the media and tracked Mr. Molde's story. She feels people who are familiar with this story want a response, and .she urged the Council to respond to Mr. Molde's request for a public hearing. Mr. Mielke stated he sent Mr. Molde a written response and explained that the City Council will decide whether or not they wish to hold a public hearing to discuss his concerns. Mr. Mielke also indicated in his letter to Mr. Molde, with respect to the potential violation of his rights, that he could file a formal complaint with the Lakeville Police Department. Mr. Molde has not taken advantage of that opportunity. Mr. Mielke stated that he will be working with the Police Department and City Attorney to review the City's processes and will report back to the City Council. Consent Agenda 08.74 Motion was made by Bellows, seconded by Wulff to approve the consent agenda items as follows: CITY OF LAKEVILLE COUNCIL MEETING JULY 21, 2008 Page 3 a. Claims for payment. b. Minutes of the July 7, 2008 City Council meeting. c. Receive minutes of the following advisory committee meetings: - Economic Development Commission, June 24, 2008 - Telecommunications Commission, July 8, 2008 d. Resolution No. 08-101 appointing election judges for the September 9, 2008 State Primary Election. e. Artist agreements/contracts for performances offered at the Lakeville Area Arts Center with Monroe Crossing, Paula Lammers, Power Shout, Cactus Willie, Boxcar Bob & the Drifter, and The Bad Plus. f. Resolution No. 08-102 accepting donation and authorizing partial refunding of prior donation to Orchard Lake Sportsmen's Club.. g. Acceptance of improvements and final payment to Friedges Excavating, Inc. for Caspersen Park soccer field and parking lot construction, Improvement Project 07-1 1. h. Joint Powers Agreement with St. Paul Police Department for the Republican National Convention. i. Shady Oak Grove Second Addition development contract amendment. j. Professional Services Agreement with McCollister's Transportation Systems, Inc. to provide moving services for the Police Department.. k. Site Lease Agreement between the City of Lakeville and Citilink Communications, LLC, for the North Park and Airlake water towers. Site Lease Agreement between the City of Lakeville and Verizon Wireless for the Airlake monopole. m. Final plat extension for Primrose of Lakeville. Item 7 -Ronin Enterprises, LLC On-Sale and Sunday Liquor License Mayor Dahl opened the public hearing on the application of Ronin Enterprises, LLC for an on-sale and Sunday liquor license at Ronin Cafe, 7704-160th Street West. The City Clerk attested to legal notice publication. The applicant, Nona Chan, stated Ronin Sushi Cafe primarily serves sushi and thai food and would like to offer wine, sake and a few other alcoholic beverages. Sergeant Knutson presented the Police Department's investigative summary for Ronin Enterprises, LLC. He reported that the application was very complete, and the background investigation revealed no issues that would prevent Ronin Cafe from obtaining a liquor license. He pointed out that the restaurant does have outdoor patio seating; however, that area will not be part of the licensed premise, as there will be no alcohol served or consumed on the patio. There were no questions or comments from the council members or members of the audience. 08.75 Motion was made by Bellows, seconded by Rieb to close the public hearing on the application of Ronin Enterprises, LLC, for an on-sale and Sunday liquor license. Roll call was taken on the motion. Ayes, unanimous. 08.76 Motion was made by Swecker, seconded by Wulff to grant an on-sale and Sunday liquor license to Ronin Enterprises, LLC, d.b.a. Ronin Cafe, 7704-160th Street West. Roll call was taken on the motion. Ayes, unanimous. New business - Council Member Swecker asked about the City's policies on abandoned homes and how those issues are handled. Mr. Mielke stated the Inspections Department currently keeps a data base and regularly visits those homes. City staff is currently working on a policy, which will identify CITY OF LAKEVILLE COUNCIL MEETING JULY 21, 2008 Page 5 the administrative process. He pointed out that the City Council recently adopted the home maintenance code, which provides the City more tools for enforcement than it previously had.
