HomeMy WebLinkAbout0843ORDINANCE NO. 843 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLES 5 AND 7 OF THE LAKEVILLE CITY CODE CONCERNING FIREARMS THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS: SECTION 1. Section 5-2-1-2 of the Lakeville City Code is amended to read as follows: PERMITTED USE OF FIREARMS: The carrying of firearms in the City is regulated by Minnesota Statutes chapter 624. The shooting of firearms is permitted under the following circumstances so long as no innocent party is endangered unless otherwise prohibited by State or Federal law. A. Bylaw enforcement officers in the line of duty or military personnel in the line of duty. B. By any person to resist or prevent an offense which that person reasonably believes exposes himself or another to great bodily harm or death. C. By a certified Firearms Safety Training instructor while participating in a Department of Natural Resources approved Firearms Safety Program. D. By any person while participating in a Department of Natural Resources approved Firearms Safety Program. E. By any person for the destruction of diseased, injured or dangerous birds, animals or reptiles by persons authorized to do so in writing by the Chief of Police. F. By any person on a rifle, trap, archery or target range established in accordance with the City's Zoning Ordinance or as part of aCity-sponsored activity. G. By any person for target practice provided that the projectiles are stopped by a suitable backstop and provided further that the shooting occurs at least five hundred feet (500') from all buildings unless owned by him or with the owner's written permission carried on his person. H. By any person hunting with a shotgun using fine shot at least five hundred feet (500') from a City trail. and five hundred feet (500') from all buildings unless the buildings are owned by that person or unless that person has the owner's written permission carried on his/her person. I. By any person hunting or target practicing with a bow and arrow at least two hundred feet (200') from all buildings, unless the buildings are owned by him or unless he has the owner's written permission carried on his person. Bow and arrow target practice may also take place within the confines of a building if a suitable backstop is used. J. By any person participating in a special hunting season, which season may not conflict with State law or regulations, established by the City Council for the purpose of wildlife management. The season shall be established by the City Council when, based upon competent professional advice such as a conservation officer, a season is needed to reduce an animal population. The Council may authorize the use of single projectiles as part of the special hunt regulations set forth in the resolution. K.. By any person slaughtering farm animals which they own or with the owner's permission. 139916v2 SECTION 2. Section 5-2-1-3 of the Lakeville City Code is amended to read as follows: A. The shooting of a firearm is prohibited except as allowed in this chapter. B. Shooting a firearm by any person under the age of fourteen (14) is prohibited except when accompanied by a parent, adult guardian or certified safety training instructor. SECTION 3. Section 5-2-3 of the Lakeville City Code is amended to read as follows: DESIGNATED SHOOTING AREAS: Annually the City Council shall cause to be published a map designating the areas within the City where shooting a firearm is allowed. Shooting a firearm in areas not designated on the map is prohibited except as allowed with the written permission of the Lakeville Police Chief, which permission shall be given under the following circumstances: A. With the written permission of the property owner ;and B. The area is isolated, rural in character, and sparsely populated; and C. No more than one party shall be allowed in the area at one time. SECTION 4. Section 7-1-6 of the Lakeville City Code is amended to read as follows: On a public lake access site: A. No person shall leave, store, abandon or otherwise cause to remain any fish house, shelter or dark house. B. No persons shall leave, store, or moor on or directly in front of any lake access site any boat, pontoon, or watercraft, after such person has left the lake area, or cause such watercraft to remain on the lake access site overnight. C. Except during loading and unloading, parking is prohibited except in designated parking spaces. D. No person shall remove, destroy or damage any tree, shrub, vine or plant. E. Building fires in other than designated fireplaces or throwing lighted cigarettes, cigars or other burning materials on the ground is prohibited. F. Using any firearm, bow and arrow, air rifle, slingshot or other missile propelling weapon is prohibited. 139916v2 2 SECTION 5.
