CITY OF LAKEVILLE
PLANNING COMMISSION MEETING MINUTES
JANUARY 7,1993
The meeting was called to order by Chair Steigerwalt at 7:00 p.m. in the
City Hall Council Chambers
Roll call was taken. Present: Whitehouse, I~olberg, Steigerwalt, Smith,
Miller. Absent: Whittingham.
Also present: Robert Erickson, City Administrator; Jim Walston, Assistant
City Attorney; Michael Sobota, Community and Economic Development Director;
Daryl Morey,. Assistant Community and Economic Development Director; Alan
Brixius, Northwest Associated Consultants; Mira Holliday, Recording
Secretary.
ITEM 3
The minutes of the December 3,1993 and the December 10,1992 Planning
Commission meetings were approved as written.
ITEM 4
Officers for 1993 were elected as follows:
Whitehouse volunteered to continue as Secretary.
Smith nominated Whittingham as Vice Chair. Voice vote unanimous.
Smith nominated Holberg as Chair. Voice vote unanimous.
ITEM 5
The public hearing to consider the application of the City of Lakeville for
an amendment to the Comprehensive Plan to include revisions to the
comprehensive park and trail system plan was opened. ,The City Attorney
attested that all legal notices had been duly published and mailed.
Steve Michaud, Parks and Recreation Director, distributed an executive
summary of the plans to the Commission and introduced Barry Warner of
Barton-Aschman Associates. Mr. Warner presented an overview of the Park
and Open Space System Plan.
Alan Brixius presented an overview of the multi-purpose trail way (MPTW)
plan.
The Commission commended staff and the Parks and Recreation Advisory
Committee for their impressive work on the plan. Discussion included:
- Lighting for parks
- Curfews for parks
- Protected wetlands and waterways
- Future park land acquisition
Possibility of assistance from Dakota County
- Possibility of referendum for park and trail improvements

93.01 Motion was made by Miller, seconded by Smith to close the public hearing.
Roll call was. taken on the motion. Ayes: Unanimous.
93.02 Motion was made by Whitehouse, seconded by Miller to recommend approval of
the application of the City of Lakeville for an amendment to the
Comprehensive Plan amending the chapter pertaining to the Comprehensive
Park and Open Space System Plan and Comprehensive Trails System Plan in
their entirety.
Roll call was taken on the motion. Ayes: Unanimous.
ITEM 6
The public hearing to consider the application of Robert T. Brantly and
Gary M. Tushie for the vacation of :drainage. and utility easements on land
located at 10249182nd Street West and 18193 Jamaica Path was opened. The
City Attorney attested that all legal notices had been duly published and
mailed.
Daryl Morey presented an overview of the requested easement vacation,
outlining the planning report of December 29,1992. He stated that Mr.
Brantly and Mr. Tushie are requesting the easement vacation in conjunction
with an administrative subdivision application they have submitted for a
vacant single family residential parcel that they jointly awn in Woodridge
Estates 4th Addition. Mr. Morey stated that staff recommends approval of
the easement. vacation subject to dedication: of a ten foot wide drainage and
utility easement centered over the new property lines proposed with Mr.
Brantly and Mr. Tushie's administrative subdivision/combination
application.
Mr. Brantly was present to answer questions of the Commission and the
public.
The Commission held a brief discussion regarding future use of the
property. Mr. Brantly indicated the additional land on each lot. is planned
to remain as is at this time.
93.04 Motion was made by Smith, secanded by Holberg, to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
93A5 Motion was made by Holberg, seconded by Whitehouse, to recommend approval
of the application of Robert T. Brantly and Gary M. Tushie for the vacation
of drainage and utility easements on land located at 10249182nd Street
West and 18193 Jamaica Path subject to the planning report of December 29,
1992.

ITEM 7
The public hearing to consider the application of Craig W. Morse for a
special home occupation permit to allow the operation of a .consultation and
installation business in a single family residence located at 16055 Oak
Shore Drive was opened. The City Attorney attested that all legal notices
had been duly published and mailed.
Daryl Morey presented an overview of the proposed special home occupation,
outlining the planning report of December 30,1993. He discussed the
following:
- Background
- Zoning. Ordinance provisions for home occupations
- Occasional cabinet assembly in garage
- Time frame for permit with subsequent review/inspection by staff
Mr. Morey stated that staff recommends approval of the Morse special home
occupation permit. request subject to five stipulations listed in the
plannuig report.
Mr. Morse was present and explained the operation of his business. He
expressed concern over not being allowed to use his garage for any assembly
of the cabinets.
The Commission held a discussion which included:
- Fee far renewal of permit after expiration ~
- Occasional use of garage to assemble cabinets
- Parking of vehicles if garage used for-occasional assembly of cabinets
- Deadline far vacation of present business location
- Tyke of equipment needed for business
- Driveway width. {parking for secretary's car)
- Timeframe for permit
It was the.. feeling of the Commission that Mr. Morse should be allowed to
use his attached ggarage for the assembly of cabinets provided his
automobiles could still be parked in the garage at all times. Mr. Morse
stated that his garage was large enough to assemble the cabinets and not
displace his. vehicles. The stipulations of the planning report were
amended as follows:
2. The home occupation shall be conducted entirely within the principal
dwelling and maybe conducted in the attached. garage provided no
special home occupation activity would displace indoor vehicular
storage at any time.
6. .The special home occupation permit shall expire January 19,1994 and
maybe renewed by the applicant with Planning Commission and City
Council approval.

The Planning Commission agreed no additional fees would be needed for Mr.
Morse to reapply for the special home occupation permit in twelve months.
.There was no public comment.
93.06 Motion was made by Miller, seconded by Smith o close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
93.07 Motion was made by Miller, seconded by Holberg, to recommend approval of
the application of Craig W. Morse for a special home occupation permit to

ITEM 8
The public hearing to consider the application of Michelle and David
Ellison for a conditional use permit to allow an expansion of an existing
• attached garage fpr a total attached garage area m excess of 1,000 square
feet on a single family residential lot located at 17151 Isleton Avenue was
opened. The City Attorney attested that all legal notices had been duly
published. and. mailed.
Daryl Morey presented an overview of the proposed garage expansion,
outlining the planning report of December 28,1992. He discussed the
.following:
- Background
- Zoning Ordinance provisions regarding the size of attached garages
- Possible adverse. affects of the proposed conditional use permit
- Use and need for proposed garage addition
- Concern over future owner's use of garage
- .Proposed storage. space over the rear bay of the proposed garage
addition
- Potential future use of the area for separate living quarters for
renters or boarders
- Matching of existing roof line
- Proposed garage addition designed to have appearance from street of a
normal three car garage
- Driveway accessing existing garage and proposed addition must be paved
- Height of proposed garage
Mr. Morey stated that staff has not previously processed a conditional use
permit for an attached garage located in a platted R-2 neighborhood
exceeding Zoning Ordinance size requirements. As such, the Ellison's
conditional use permit request will be precedent setting. He further
stated that staff recommends approval of the Ellison conditional use permit
request for accessory building size and height subject to eight
.stipulations listed in the planning report.

Mr. and Mrs. Ellison were present to answer questions of the Commission and
public.
The Commission held a discussion which included:
- Use of the garageas future dwelling space
- No outside storage
- No future construction of accessary buildings
- Possibilities of use if property changes owners
The stipulations of the planning report were amended as follows:
2. The garage shall not be used as dwelling space unless it is in
compliance with City ordinance. and code requirements.
9. There shall be no outside storage of any motor vehicles, trailers,
.boats, snow mobiles, seasonal vehicles, snow removal equipment or lawn
equipment allowed on the subject property.
Anne Hagen, adjacent property owner, questioned the amount of space between
lot lines. She was also concerned over the view from her bedroom window.
• Staff indicated that the proposed addition would meet set back standards.
93.08 Motion was made by Smith, seconded by Miller, to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
93.09 Motion was made by I-Iolberg, seconded by Smith to recommend approval of the
application of Michelle and David Ellison for a conditional use permit to
allow an expansion of an existing attached garage for a total attached
garage area in excess of 1,000 square feet on a single family residential
.lot located at 17151 Isleton Avenue subject to the planning report of
December 28, 1992 as amended by the Planning Commission.
Roll call was taken on the motion. Ayes: Unanimous.
The:Planning Conunission asked he Ellsons o consider the concerns of Ms.
Hagen in the' final design of he garage addition.
ITEM 9
The public hearing to consider the application of Independent School
District 194 for an amendment to Conditional Use Permit No. 91-01 to allow
an expansion of McGuire Junior High School on land located at 21220 Holyoke
Avenue was opened. The City Attorney attested that all legal notices had
been duly published and mailed.
Alan Brixius presented an overview of the proposed amendment, outlining the
planning report of December 31,1992. He discussed the following:
- Background
- Section31.4 of the Zoning Ordinance

- Previous agreement regarding temporary classrooms
- Future enrollment -reduction with opening of new high school
- Renovation timing
- Building height
- Building appearance
- Off-street parking
- Setbacks
- Loading area in northwest corner
- Landscaping
- Sanitary sewer and water
- Sidewalks
- Lighting ,
- Shoreland requirements
- Floodplain
- Schmitty property and need for cross parking arrangement before
building permit issuance
- Building and fire code requirements
- Deletion of conditions number seven and thirteen from the planning
report
Mr. Brixius stated that staff recommends approval of the requested
conditional use permit amendment subject to the conditions listed in the
planning. report.
Dan Mehleis of ISD 194 and David Lunde of Wold .Architects were present to
answer questions of the Commission and public.
The Commission held a discussion which included:
- Floorplan of the school after remodeling
- Locker layout
- Loading area in northwest corner
- Lighting for rear parking area
- Maximum anticipated occupancy of school
- Future expansion
The conditions of the planning report were amended as follows:
3. Parallel parking along: the school's 24 foot access drive on the south
side of the building is prohibited. Parking on the access drive along
the west side of the building is limited to the western side of the
drive. To implement these recommendations, "no parking" signs should
be posted at appropriate locations along the routes.
7. .Deleted (redundant with #11)
8. Prior to building permit approval, the junior high school plans are
subject to review and recommendation by the City Fire Marshall in
regard to building and fire code requirements.
9. The plan for a sidewalk extension to the. west school entrance be
submitted for review by City staff.

10. Prior to the issuance of a building ermit, the MWCC determine the
need for any additional sewer and~or water availability charges.
11. Exterior lighting is provided proximate to the school's drop off lane
and western entrance. -All such lighting should be hooded and directed
so as o deflect away frompublic rights-ofway and residential
zones. Specific lighting locations hould'be identified on the site
plan.. The lighting plan is subject to staff review.
13. Delete.
There was no public comment.
93.10 Motion was made by Holberg, seconded by Smith to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
93.11 Motion was made by Holberg, seconded by Miller to recommend approval of the
application of Independent School District 194 for an amendment to
Conditional Use Permit No. 91-O1 to allow an expansion of McGuire Junior
High School on land located at 21220 Holyoke Avenue subject to the planning
• report of December 29,1992 as amended.
Roll call was taken on the motion. Ayes: Unanimous.
ITEM 10
The public hearing to consider the application of the City of Lakeville for
a rezoning from B-4, General Business District, to R-5, Single and Two
Family, Medium Density Residential District on land located west of Kenyon
Avenue and south of 179th Street West was opened. The City Attorney
attested that all legal notices had been duly published and mailed.
Alan Brixius reviewed the planning report of October 28, 1992, outlining
the following:
- Background
- Site characteristics
- Development/use considerations
- I-35 visual and noise impact
- Environmental considerations
- Marketability
- Access/location
- Compatibility with current and planned uses
- Area considerations
- Rezoning options - R-7, R-S, R-1
• - Suggestion from developer to rezone R-1 to the west and B-4 to the
east.
Carl Dale was present representing the developer.

- Roadway locations
- Utilities
- Right-of-way
- Rezoning options - R-l preferred and R-5 would be an acceptable
alternative
93.12 Motion was made by Miller, seconded by Smith to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
93.13 Motion was made by Holberg, seconded by Steigerwalt to recommend to the
City Council rezoning the property from B-4 to R-5.
Roll call was taken on the motion. Ayes: Steigerwalt, Holberg.. Nays:
Whitehouse, Smith, Miller.
93.14 Motion was made by Miller, seconded by Smith to recommend to the City
Council rezoning the property from B-4 to R-1.
Roll call was taken on the motion. Ayes: Whitehouse, Miller, Smith.
Nays: Holberg, Steigerwalt.
The reason for Holberg's nay was she feels R-1 does not allow enough
flexibility.
93.15 Motion was made by Steigerwalt, seconded by Holberg to direct the City
Attorney to draft findings of fact to be considered at the January 21,1993
Planning Commission meeting.
Roll call was taken on the motion. Ayes: Unanimous.
ITEM 11
Daryl Morey updated the Commission on the status of the Bodine variance.
93.16 Motion was made by Holberg, seconded by Whitehouse to extend consideration
of the Bodine variance-request until the January 21,1993 meeting.
Roll call was taken on the motion. Ayes: Unanimous.
Chair Steigerwalt adjourned the meeting at 10:45 p.m.
