to CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES FEBRUARY 18, 1993 The meeting was called to order by Chair Holberg at 7:OU p.m. in the City Hall Council Chambers. Roll call of members was taken.. Present: Whitehouse, Steigerwalt, Holberg, Whittingham, Smith, Miller. Alsopresent was Robert Erckson,'Cty Administrator; Roger Knutson, City Attorney; Michael Sobota, Community and Economic Development Director; Daryl Morey, Assistant Community and Economic Development Director; Allan Hunting, NAC; Jeff Oliver, Assistant Engineer; David Krings, Building Official; John Hennen, Planning Assistant; Mira Holliday, Recording Secretary. The minutes of the February 4,1993 Planning Commission meeting were approved as printed. ITEM 4 The public hearing to consider the application of Messiah Lutheran Church for an amendment to Conditional Use Permit No. 8$-01 to allow an expansion of Messiah Lutheran Church and to allow self-contained motor homes to be used as temporary living quarters for construction. workers working on said expansion on land located at 16725 Highview Avenue was opened. The City Attorney attested that all legal notices had been duly published: and mailed. Daryl Morey presented an overview of the proposed addition to the church, outlining the planning report of February 12,.1993. He discussed the following: - Background - History - The proposed classroom addition being one of five expansion phases - The use of volunteer laborers who will live on site temporarily during construction of the classroom addition - Landscaping Parking - Expansion of existing north driveway entrance from two-lanes to four lanes divided - Seating capacity of new sanctuary currently under construction Perimeter curbing will be concrete, except adjacent to`future Phase IV parking expansion area will be bituminous Mr. Morey stated that staff recommends approval of the Messiah Lutheran Church conditional use permit amendment request to allow a classroom addition constructed by volunteer laborers temporarily living on site subject to the three stipulations listed in the planning report of February 12,1993. • PLANNING COMMISSION MEETING MINUTES FEBRUARY 18,1,993 Page 2 Vern Lovstad, representing Messiah Lutheran Church was present to answer questions of the Commission and the public. ,He requested that six motor homes housing twelve workers be allowed an site rather than five motor homes housin8 twenty people as the Zoning Ordinance allows. The Commission held a discussion which included: - Expansion of existing day care use into the proposed addition - `Number of parking spaces proposed - :.Southern driveway safety - Zoning Ordinance requirements regarding the temporary use of motor homes an non-residential construction. projects - Landscaping - Timeframe for completion of proposed addition (120 days or less) There was no public comment. 92.27 Motion was made by Miller, seconded by Steigerwalt to close the public hearing. Aye: Unanimous. • 92.28 Motion was made by Miller,. seconded Whittingham, to recommend approval of the application of Messiah Lutheran Church for an amendment to Conditional Use Permit No. 88-p1 to allow an expansion of Messiah Lutheran Church and to allow self-contained motor homes to be used as temporary living quarters for construction workers working on said expansion'on land located at 16725 Highview Avenue subject to the planning report dated February 12,1993 and the findings of fact. Roll call was taken on the motion, Ayes: Unanimous. ITEMS .The public hearing to consider the application of the City of Lakeville for a text amendment to Section 47 of the Zoning Ordinance to conform to new Minnesota Department of Natural Resources State Shoreland Regulations was continued from the February 4,1993 Planning Commission meeting. Michael Sobota summarized the questions raised at the February 4,1993 Planning Commission meeting, reviewing the suggested changes from the. previous meeting. A lengthy discussion was held regarding the fohowing: - 70 percent rule in regular zoning ordinance and proposed Shoreland Overlay District. - A proposed time limit (sunset provision) for the proposed 70 percent rule in the. Shoreland Overlay District .r - PLANNING COMMISSION MEETING MINUTES FEBRUARY 18,1993 Page 3 - Holding tanks/septic tank drain fields - Boathouses (a correction was noted on page 9, section 2, line 2 to delete all reference to boathouses) - Storage buildings - Stairways, lifts and landings - Restoration of natural vegetation Commercial uses :Dog kennels.... - Picnic areas {delete reference in Section 47.10.2) Wally Potter stated he was not. in favor of boathouses on the Lakeshore but felt storage buildings should be allowed. Bill Jackson of Jackson landscaping questioned if bluff land could be used for park land dedication. The Commission agreed that the deadline for the 70 percent rule should be January 1, 1999 to allow time to notify property owners and to allow ample time for redevelopment. 93.29 Motion was made by Steigerwalt, seconded by Whittingham to close the public . hearing. Roll call was taken on the motion. Ayes: Unanimous. 93.30 Motion was made by Miller, seconded by Smith to recommend approval of the application of the City of Lakeville for a text amendment to Section 47 of the Zoning Ordinance to conform to new Minnesota Department of Natural Resources State Shoreland Regulations subject to the planning memorandum dated February 10,1993, the February 11,19931etter from the Minnesota Department of Natural Resources and the amended ordinance. Roll call was taken on the motion. Ayes:.Unanimous. ITEM 6 The public hearing to consider the application of the City of Lakeville for an ordinance amending Ordinance No. 167, the City's Zoning Ordinance concerning accumulation, st©rage and disposal of waste was continued from the .February 4,1993 meeting. The public hearing to consider the application of the City of Lakeville for a rezoning from I-2, General Industrial to PUD, Planned Unit Development on land located east of Cedar Avenue and south of 21~th Street was continued from the February 4,1993 meeting. Michael Sobota introduced Dean Johnson of Resource Strategies who reviewed the Waste Management Study.. The Commission held a discussion which included the disposal of medical waste and farm waste. Roll call was taken on the motion. Ayes: Unanimous. 92.32 Motion was made by Steigerwalt, seconded by. Whittingham to recommend approval of the application of the City of Lakeville for an ordinance amending Ordinance No,.167, the City's Zoning Ordinance concerning accumulation, storage and disposal of waste subject to the planning report dated February 12,1993.. Roll call was taken on the motion. Ayes: Unanimous. Michael Sobota reviewed the proposed rezoning from I-2, General Industrial to PUD, Planned Unit Development of the Aptus, Inc. property. Marty Bergsted, Vice President of Aptus, Inc. was present. Mr. Sobota stated that Aptus and City staff had reached an understanding on the draft PUD agreement. The City Attorney noted that final language would be worked out before City Council approval. The Commission held. a brief discussion. • There was no public comment. 92.33 Motion was. made by Steigerwalt, seconded by Whitehouse, to close the public hearing. Roll call was taken on the motion. Ayes..: Unanimous. 92.34 Motion was made by Steigerwalt, seconded by Smith to recommend approval of the application of the City of Lakeville for a rezoning from I-2, General Industrial to PUD, Planned Unit Development on land located east of Cedar Avenue and south of 215th Street subject to the planning report of February 12,1993, the findings of fact and the amended agreement. Roll call was taken on the motion. Ayes:. Unanimous. 92.35 Motion was made by Whitehouse, seconded by Miller to recommend approval of the PUD permit agreement between the;City of Lakeville and Aptus, Inc. to the City Council subject to final language acceptable to the City Attorney and legal counsel for Aptus Inc. ITEM 8 Michael Sobota reviewed proposed amendments to the City Code regarding subdivisions. He explained the amendments included current policies and practices of the City and incorporate language in the City Code currently used in development contracts with developers. He stated staff feels the • amendments are necessary to ensure that the requirements for. subdivisions are contained in the City Code. The Commission held a brief discussion.
