Roll call of members was taken. Present: Whitehouse, Steigerwalt, Forsberg, Holberg, Whittingham, Smith. Miller arrived at 7:10.. Also present: Robert Erickson, City Administrator; Jim Walston, Assistant City Attorney; :Michael Sobota, Community and. Economic Development Director; .Daryl Morey, City Planner; Frank Dempsey, Associate Planner; Jeff Oliver, Assistant Engineer; Mira Holliday, Recording Secretary.. The minutes of the May 20, 1993 Planning Commission meeting were approved as written. ITEM 4 The public hearing to consider the application of Todd HIingel for the vacation of an existing drainage and utility easement on land located at 12058 Lucerne Trail was continued from the May 20, 1993 meeting. Daryl Morey presented an overview of the proposed easement vacation, outlining the planning report of May 25, 1993. Mr. Morey explained. that the easement vacation is being requested by Mr. Klingel in conjunction with an administrative subdivision request. He stated the easement is no longer needed given the re-configured shared side lot line. Mr. Morey recommended approval of the easement vacation. Mr. Klingel was present to answer questions of the Commission and public. The Commission held a discussion which included: - Possibility of shifting the lot line to the northeast to allow for separate driveways - City policy regarding shared. driveways There was no public comment. 93.81 Motion was made by Smith, seconded by Steigerwalt to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 93.$2 Motion was made by Whittingham, seconded by Smith to recommend approval of the application of Todd Klingel for the vacation of an existing drainage and utility easement on land located at 12058 Lucerne. COMMISSION MEETING MINUTES JUNE 3,1993 Page 2 ITEM 5 The public hearing to consider the application of Midwest Asphalt Corporation for an excavation (gravel mining) permit on land located in the northeast corner of 195th Street and Kenrick Avenue was opened. The City Attorney attested that all legal notices had been duly published and mailed. Frank Dempsey reviewed the proposed permit, outlining the planning report of May 27, 1993. His review included the following: - Background - Surrounding land uses - Reclamation plan - Ordinance requirements - Protection of bluff and trees - Northern Natural Gas high pressure natural gas line - Engineering recommendations - Dakota County Soil and Water Conservation District recommendations - Environmental Affairs Committee recommendations Mr. Dempsey recommended approval of the proposed excavation permit contingent upon 11 stipulations as listed in .the planning report. David Blanski representing Midwest Asphalt was present and stated he was in agreement with staff recommendations. .The Commission held a discussion which included: - Possibility of pollution from proposed use as horse farm - Time frame for full extraction - Stabilization of slopes - Width of bluff - Banner signs - Development standards Whitehouse stated he felt the proposal was incomplete and should have further review prior to Planning Commission. Robert Erickson discussed the possibilities for future use and reviewed the Environmental Affairs Committee concerns and recommendations. He suggested the Commission table action on the proposal subject to review and recommendation by the City Attorney. Mr. Erickson commended Midwest Asphalt for their willingness to bring. the operation into conformance with the current .mining ordinance. Roll call was taken an the motion. Ayes: Unanimous. .ITEM 6 The public hearing to consider the application of Family of Christ Lutheran Church for the preliminary and final plat of one church lot to be known as Family of Christ .Lutheran Church Addition and a minor comprehensive plan amendment to bring the property into the Year 2000 Urban Service Area and a conditional use permit to allow the construction of a church and the operation of a day care facility in an R-2 District on land located south of 185th Street and east of Orchard Trail was opened. The City Attorney attested that all legal notices had been duly published and mailed. • Daryl Morey presented a review of the proposed. plat and conditional use permit,. outlining the planning report of May 27,1993. His review included the following: - Background - Wetlands - Tree preservation - Park and trail dedication - MUSA - Conditions to be met to allow churches. in the R-2 District - Day care facility Mr. Morey recommended approval of the proposed preliminary and final plat and conditional use permit requests subject to the nine stipulations listed in the planning report. Pastor Del Lind, Daryl Olberg, Building. Committee Chair, and Shelly. Santine of Adkins Association, project architects, were present representing Family of Christ Lutheran Church. Mr. Olberg thanked City staff for their assistance through the process and stated they are in agreement with all recommendations. The Commission held a discussion which included: - Parallel parking spaces - Day care center Mitigation Sedimentation pond Oil skimming device "No parking' signage . PLANNING COMMISSION MEETING MINUTES JUNE 3,.1993 Page 4 - Utility extension time frame - Access off of 185th Street - Possibility of speed bumps - Exterior fighting - Signage Chair Holberg stated she was not comfortable with the day care facility being a part of the conditional use permit. She felt it should be handled separately. Staff explained that the conditional use permit will. stipulate that all Zoning Ordinance and state requirements be met. Staff further stated that if the church representatives plan to have less than 12 children enrolled in the day care, a conditional. use permit would not be required. Shelly Santine of Adkins Association stated that they were prepared to meet the stipulations recommended by City staff. Paul Anderson of Great Oak Shores questioned if .Orchard Trail would remain the same width. Staff indicated the width would remain the same at this time. • Lynette Natwig of Orchard Trail stated they have horses on their property and expressed her concern over children approaching the horses and possibly getting injured. Staff explained that fenced play areas are required for day care centers. Pastor Lind stated the Church wishes to be a good neighbor and will address any problems that might arise from children attending church services. Rebecca Mehan requested "children at play" signage. Commission members .discussed amendments to the stipulations listed in the planning reports. The amendments are as follows: 5. The site plan shall be revised to eliminate the proposed parallel parking spaces and "no parking" signs will be installed in this location. 8. The site shall be developed according to the site and landscape plans dated Apri115,1993 as amended to comply with stipulation numbers 4-6. The location of proposed monument identification signage shall be shown. on the site plan. 93.84 Motion was made by Steigerwalt, seconded by Whittingham to close the public hearing. Roll call was taken on the motion. . 93.85 Motion was made by Steigerwalt, seconded by Smith to recommend approval of the preliminary and final plat of one church lot. to be known as Family of Christ. Roll call was taken on the motion. Ayes: Unanimous. 93.86 Motion was made by Steigerwalt, seconded by Whitehouse to recommend approval of the application of Family of Christ Lutheran Church for a conditional use permit to allow the construction of a church and the operation of a day care facility in an R-2 District on land located south. of 185th Street and east of Orchard Trail subject to the planning report dated May 27, 1993 as amended and the findings of fact. Roll call was taken on the motion. Ayes: Unanimous. ITEM 7 Daryl Morey. reviewed the final plat of Marion Village 2nd Addition, outlining the planning report of May 27, 1993. His review included the following: • - Background - History - Consistency with the approved preliminary plat - Zoning - Lotslblocks - Outlots - Setbacks - Streets - .Grading,. drainage, erosion control, and utilities - Tree preservation - Wetlands - EAC recommendation - DCSWCD recommendation - Engineering report dated May 27,1993 Park and trail dedication - MUSA Mr. Morey recommended approval of the proposedfinal plat subject to the stipulations as listed in the planning report with the elimination of stipulation numbers 6, 8, 10 and 13, as they have been met by the developer with the submission of revised plans prior to the Planning Commission meeting and the modification of stipulation. number 7 to read "prior to City Council consideration of the final plat". Paul Kempf and Steve Grohoski were present to answer questions of the • Commission. Mr. Grohoski stated they were in agreement with the recommendations of staff. PLANNING COMMISSION. MEETING MINUTES JUNE 3, 1993 Page 6 Michael Sobota discussed a conversation he had with Dale Pexa, property owner of the remnant exception in the southwest corner of the plat regarding including his property in the final plat. Mr. Kempf indicated he had spoken with Mr. Pexa and anticipated that the property could be purchased by the developer. The Commission held a discussion which included: - Tree preservation - .Drainage - Street names (Keningston Way vs. Kansas Way) - Access to Biessel property - Adjacent B-4 zoning - Lot 20, Block 4 (shape of lots) - Notification of property buyers that property to the west is zoned B-4 Wally Potter of 202nd Street questioned the time frame for utility extensions from this plat east on 202nd Street.. Staff responded that the time frame would be based on petition by the neighborhood or evidence of septic system failure. Frank Biessel expressed his concern over the access to his property, street Tights for the area, the speed limit on 205th Street, sewer access off of 203rd Street and the B-4 zoned area to the west. 93.87 Motion was made by Forsberg, seconded by Steigerwalt to recommend approval of the final plat of Marion Village 2nd Addition final plat subject to the planning report dated May 27, 1993 as amended, the engineering report dated May 27, and the Dakota County Soil and Water Conservation District report. dated May 26, 1993. ITEM 8 Under other business, Michael Sobota stated that the applications of M.W. Johnson for a variance and rezoning for property at 208th Street and Hollins Avenue had been withdrawn.
