HomeMy WebLinkAbout01-02-92 s CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES JANUARY 2,1992 The meeting was called to order by Chair Steigerwalt at 7:00 p.m. Roll call of members was taken. Present: Whitehouse, O'Donnell, Holberg, Steigerwalt, Smith, Miller. Absent: Whittingham. Also present was Robert Erickson, City Administrator; Jim Walston, Assistant City Attorney; Michael Sobota, Community and Economic Development Director; Daryl Morey, Assistant Community and Economic Development Director; David Licht, Consulting Planner; Mira Holliday, Recording Secretary. ,The minutes of the December 5,1991 Planning Commission meeting were approved as written. The election of officers for 1992 was held. Nominations were as follows: Secretary -Whitehouse Vice Chair -O'Donnell Chair - Steigerwalt Voice vote was taken on the nominations. Approved unanimously. The public hearing to consider the application of Brown and Cris, Inc. for an amendment to an existing conditional use permit (exterior storage of trucks, equipment, and materials) to allow the construction of a storage building on land located at 19740 Kenrick Avenue was continued from the December 5,1991 meeting. Daryl Morey stated the public hearing on this matter had been continued to give the applicant an opportunity to prepare a landscaping plan, to meet with City staff to review building code requirements for the storage building, and to prepare cost estimates for providing exterior building materials in compliance with Zoning Ordinance requirements. He stated the applicant had completed all the items. Mr. Morey proceeded to present a review of the planning report dated December 27,1991. He discussed the following: - Landscaping plan/revised site plan which included the dumpster location, revised outdoor storage area, and the location of five additional future parking spaces that are required by ordinance with the construction of the storage building for which the applicant is requesting a parking deferment. - Exterior storage building materials. Mr. Morey stated that Community and Economic Development Staff is recommending approval of the Brown and Cris, Inc. conditional use permit amendment request subject to nine stipulations listed in the December 27, 1991 planning report. PLANNING COMMISSION MINUTES JANUARY 2,1992 Page 2 The Commission discussed the following: - Exterior material treatment Hard surface floor requirement - Installation of concrete posts/bollards around doors - Installation and expense- of evergreen. trees for screening - Outside storage°area (and screening) - `Signage (no change) - Corrections to conditional use permit form Wayne and Greg Brown of Brown & Cris, Inc. were present and stated they prefer the exterior material of the building to be metal and stated they would be willing to plant evergreen trees for screening as shown on their revised site plan. A discussion was held between the Commission and the applicants. Additional conditions to the Amendment to Conditional Use Permit No. 88-10 are as follows: #2. The addition of "Replacement of dead evergreen trees shall be conducted for a five year period following their initial installation." #3. The addition of "A horizontal colored paint stripe be added around the entire storage building". #4. The addition of "and installation of building protection devices". 92.01 Motion was made by Miller, seconded by Holberg to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 92.02 Motion was made by Holberg, seconded by Miller to recommend approval of the application of Brown and Cris, Inc. for. an amendment to an existing conditional use permit (exterior storage of trucks, equipment, and materials) to allow the construction of a storage building on land located at 19740 Kenrick Avenue subject to the amendment to the conditional use permit as amended and the findings of fact as amended. Roll call was taken on the motion. Ayes: O'Donnell, Holberg, Steigerwalt, Miller, Smith. Nay: Whitehouse. Whitehouse voted nay because he felt the storage building should have a wood or brick siding rather than metal The public hearing to consider the application of David Oster for a conditional use permit to allow the construction of a detached accessory building in excess of 1,100 square feet in size in an R-2, Single Family Residential District an land located at 7$20 200th Street West was opened. The Recording Secretary attested that all legal notices had been duly published and mailed.. PLANNING COMMISSION MINUTES JANUARY 2,1992 Page 3 David Licht presented a review of the application, outlining the planning report of December 24,1991. He discussed the following: - .Background - Commercial or home occupation use within an R-2 Zoning District - Storage of equipment Lack of information regarding building design, color, screening and landscaping - Review of Section 9.4(8) criteria of the Zoning Ordinance - Policy questions related to home occupations: size of accessory buildings; design of accessory buildings; R-2 zoning of long term non-MUSA properties Mr. Licht stated that certain conditions would have to be met in order for the site to accommodate an oversized building. He further stated that more information would be needed from the applicant. Mr. Oster was present along with representation by Glen Nord. Mr. Nord discussed the following: - .Zoning of the surrounding area _ Size of Mr. Oster's property Neighboring commercial business - Definition of "commercial activity" Mr. Nord further stated that Mr. Oster had no objections to the requests outlined in the planning report. The Commission held a discussion which included: - .Storage of equipment - Location of building on property - Questioned Mr. Oster's plans for screening - Lawn service (not primary occupation) - Type of building to be constructed - Repair of equipment - .Use of remaining acreage - Future use of the property Mr. Oster stated he would provide staff and the Commission a detailed site plan. He stated he plans to install water, heat, electricity and. telephone in the accessory building. The Commission expressed their concern over "spat zoning" if the property were rezoned to allow a larger accessory building without the need for conditional use permit approval; and also that a precedent could be set if the conditional use permit were granted with an intended commercial use of the accessory building. PLANNING COMMISSION MINUTES JANUARY 2,1992 Page 4 Robert Erickson stated that staff was unaware of Mr. Oster's plans for the installation of utilities and the issue should be discussed between Mr. Nord and the City Attorney. He encouraged the Commission to continue the public hearing until further information is received from the applicant and staff. 91.03 Motion was made by Holberg; seconded byMiller to continue-the public hearing. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of the State of Minnesota Department of Human Services for the vacation of existing drainage and utility easements on land located at 17041/17053 Jonquil Avenue was opened. The City Attorney attested that all legal notices had been duly published and mailed. Robert Erickson discussed a neighborhood meeting which was held previous to the Planning Commission meeting. He stated that Mr. Gumringer and Mr. Campbell of the Department of Human Services had answered questions of the residents who expressed concern over the construction of a group home on the property. Mr. Erickson went on to state that staff had worked with. the Department of Humans Services previously to find another, more appropriate location to build the group home. Daryl Morey reviewed a planning report dated December 27, 1991. He stated the applicant is requesting the vacation of the easement for the purpose of constructing a group home for six developmentally disabled adults. The group home will be positioned in such a manner that it will encroach. upon this existing drainage and utility easement, thus necessitating the need for easement vacation. He went on to state that staff has worked with the Department of Human Services during the past few months on an alternative location for the group home. Staff felt it would be of benefit to the residents of the group home to be located within walking distance to facilities that they might normally utilize,. such as retail stores, parks, leisure activities, etc. The alternate location of Lakevale Townhomes near downtown Lakeville, was rejected by the Department of Human Services. Mr. Morey stated that staff recommends approval of the .drainage and utility easement request subject to six stipulations listed in the December 27, 1991 planning report. Bert Gumringer and Jim Campbell of the Department of Human Services were present and stated they have been working for quite some time on locating a group home on this site and are anxious to get started. Comments of the public included: . , PLANNING COMMISSION MINUTES JANUARY 2,1992 Page 5 John Bringgo1d,17031 Jonquil, presented acolor-coded map indicating the residents in the area who are opposed to the construction of the group home. Richard West, 17039 Jonquil, felt the proposed home and lot is too large in comparison to-the surrounding neighborhood. Paul Zyla,17061 Jonquil, stated he lives adjacent to the subject lot and feels the lot and home will not conform with the neighborhood, as most homes in the area are split entries and the proposed group home will be a large rambler. He suggested the Department of Human Services look for a more appropriate location. Bruce Andrews,17037Jonquil, questioned the vehicles that would be used by the staff of the home. He was concerned that the vehicles would bear the logo "State of Minnesota". Mr. Gumringer stated the vehicles would have no logo. David Binhner,17070 Jonquil, stated he would not have purchased his home had he been aware of the State's plans for the group home. He further stated he feels the home should be designed as the others in the neighborhood and requested that the matter be tabled until the residents. of the area have a chance to visit the group home located on Hersey Avenue. Bob McCaulley,17199 Jordan Court, expressed concern over drainage. Mike Murray, 17125 Jordan Court, also expressed concern over drainage and stated he felt failed by the City. He felt the neighborhood should have been notified when the State purchased the property. Monica Zyla,17061 Jonquil, expressed concern over the safety of the residents of the group home in that the location is in a heavy traffic area. Susan Nelson, 17035 Jonquil, questioned the restrictive covenants of the development. A petition waspresented to the Recording Secretary by the residents. The Commission held a discussion which included: - .Landscaping around the home - Fencing - Future expansion - Amount of time residents will live in the home - Driveway access Number of vehicles that would be parked at the home on a regular basis Parking for visitors - Concern over residents of home attempting to walk to local commercial businesses - Square footage of the home PLANNING COMMISSION MINUTES JANUARY 2,1992 Page 6 Whitehouse stated he felt the group home should be located closer to the " downtown area. He stated he felt the use of the property would be a misuse of the zoning district. Smith stated he felt the home would not fit in with the surrounding neighborhood. O'Donnell and Holberg stated they understood theconcern of the residents but reminded the Commission the issue at hand was the vacation of the easement. O'Donnell further stated that he feels a grading plan needs to be submitted before a decision can be made. Robert Erickson stated that staff has researched the situation and the State .has the authority to place the group home in the proposed area. He further stated that. no action should be taken until a grading plan is submitted. Mr. Gumringer stated a grading plan would be provided and that he would agree to meet with the residents of the area to modify the exterior .architecture of the house and to review landscaping plans to more closely fit the character and design of the surrounding homes.. 92.04 Motion was made by Miller, seconded by Smith to continue the public. hearing until the February 6,1992 Planning Commission meeting. Roll call was taken on the motion. Ayes: Unanimous. Under unfinished business, O'Donnell questioned the status of an architectural review process that was discussed at a previous meeting. Mr. Erickson stated that information will be provided with the next packet material. 92.05 Motion was made by Holberg, seconded by Whitehouse to adjourn the meeting.
