HomeMy WebLinkAbout01-16-92 {s .r, CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES JANUARY 16,1992 The meeting was called to order by Chair Steigerwalt at 7:05 p.m. in the City Hall Council Chambers. Roll call of members was taken. Present: Whitehouse, Steigerwalt, Whittingham, Smith, Miller. Absent: O'Donnell, Holberg. Also present was Robert Erickson, City Administrator; Jim Walston, Assistant City Attorney; Michael Sobota, Community and Economic Development Director; Daryl Morey, Assistant Community and Economic Development Director; Jeff Oliver, Assistant Engineer; Mira Holliday, Recording Secretary. The minutes of the January 2,1992 Planning Commission meeting were approved as written. The public hearing to consider the application of Mankato Rehabilitation Center, Inc.. for a conditional use permit to allow an adult education facility for the purpose of operating a vocational and habilitation program for adults with disabilities in a B-4, General Business District on land located at 17993 Kenwood Trail in the Kenwood Center was opened. The City Attorney attested that all legal notices. had been duly published and mailed. Daryl Morey reviewed the conditional use permit request, outlining the planning report of January 10,1992. He stated that Mankato Rehabilitation Center, Inc. plans to operate a day training and habilitation program for possibly the next 15 years at the Kenwood Center location. The day training and habilitation program provides adult vocational and habilitation professional services to adults with severe disabilities. Mr. Morey further discussed the following: - Licensing by the State of Minnesota - Hours of operation - Setbacks - Utilities - Landscaping - Parking - Loading - Signage - Floor plan Mr. Morey stated that staff recommends approval of the conditional use permit subject to the recommendations listed m the January 10, 1992 planning report. DeWayne Hamlin, representing Mankato Rehabilitation Center, Inc. was present to answer questions of staff and the public. He stated that he sees no need for the short term/drop-off parking spaces to be signed at this time. 1 , • PLANNING COMMISSION MINUTES JANUARY 16,1992 'Page 2 He stated that if the need arises in the future, he would be willing to install the signs, He further stated that City staff has been very cooperative m assisting them with their plans and his organization looks forward to locating in the City of Lakeville. The Commission held a discussion which included: - Signage forparking stalls for short term parking of mini buses/vans - Long term van and all staff parking to be located at the rear of the building - Handicapped parking spaces - Snow storage - Dumpsters - Number of participants in the program (licensed for 30) - Length of time CUP to remain in effect 92.06 Motion was made by Miller, seconded by Smith to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 92.07 Motion was made by Whitehouse, seconded by Smith to recommend approval of the application of Mankato Rehabilitation Center, Inc. for a conditional use permit to allow an adult education facility for the purpose of operating a vocational and habilitation program for adults with disabilities in a B-4, General Business District on land located at 17993 Kenwood Trail in the Kenwood Center subject to the findings of fact and the recommendations in the January 10,1992 planning report with an amendment to the wording of stipulation 2 to read "two handicapped sized short term/drop-off parking spaces be designated and signed on the site near the main entrance to the facility" and the addition of two stipulations to read as follows: 6. Staff and long term van parking shall take place at the rear of the Kenwood Center. 7. This conditional use permit shall remain in full force and effect for as long as Mankato Rehabilitation Center, Inc.'s lease at Kenwood Center remains in effect. Roll call was taken on the motion. Ayes: Unanunous. The public hearing to consider the~ appplication of the City of Lakeville for the vacation of Park Boulevard (a/kJa Linch Avenue), Forest Glen Avenue ~a/k/a 169th Avenue), County Road a/k/a 170th Street), Lake Drive (a/kJa udicial Road), Wright Boulevard (a~k/a Linch Path) and other dedicated rights-of-way, all located on the west side of Orchard Lake lying within Sections 2 and 11, Township 114, Range 21 was opened. The City Attorney attested that all legal notices had been duly published and mailed. h4. r . PLANNING COMMISSION MINUTES JANUARY 16,1992: Page 3 Daryl Morey reviewed the proposed street vacations, stating the vacations are m conjunction with the Judicial Road Improvement Project. Jim Walston. further explained that these vacations are also in conjunction with agreements between the. City and adjacent property owners. David Truehart, 16949 Judicial Road, questioned the ownership of the land located between the north right-of-way line of the new 170th Street and south of the center line of 170th Street as platted. Jim Walston responded that the City would retain ownership of this triangular shaped parcel as right-of-way for 170th Street. Brian Seeman,1b885 Judicial Road, questioned ownership of vacated Linch Path in front of his property. Mr. Walston explained quit claim deeds will be procured from the property owners on the other side of Linch Path such that Mr. Seeman would gam title to the portion of vacated Linch Path needed for frontage and access to the new Judicial Road. Beth Skaudis,16881 Judicial Road, questioned the City's request for an .easement across her property to access an existingg pond. She stated she has no intention of granting such an easement. Mr. Walston explained the easement was included in the legal description for this vacation and is needed to provide the City with access for maintaining the pond. The Commission held a discussion. 92.08 Motion was made by Whittingham, seconded by Smith to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 92.09. Motion was made by Whittingham, seconded by Smith to recommend approval of the application of the City of Lakeville for the vacation of Park Boulevard a/k/a Linch Avenue), Forest Glen Avenue (a/k/a 169th Avenue), County Road a/k/a 170th Street), Lake Drive 4a/k/a Judicial Road}, Wright. Boulevard a/k/a Linch Path) and other dedicated rights-of--way, all located on the west side of Orchard Lake lying within Sections 2 and 1L Township 114, Range 21 subject to the January 10,1992 memo by Daryl Morey, Assistant Community and Economic Development Director.. Roll call was taken on the motion. Ayes: Unanimous. Daryl Morey reviewed the final plat of Daniels 2nd Addition, outlining his memo dated January 10,1992. He stated that the consideration of this plat had been tabled at the December 5,1991 Planning Commission meeting to allow the developer an opportunity to: 1) obtain the required Army Corps of .Engineers permit for partial filing of two wetlands located within the plat boundaries; and 2) revise the tree preservation plan to show all trees six . inches or greater in diameter as well as the measures to protect .significant trees to be saved during mass grading. Mr. Morey stated the items have been addressed by the developer. He went onto discuss the following: PLANNING COMMISSION MINUTES JANUARY 16,1992 Page 4 - Lots/blocks - Street connections - Review of the tree preservation plan - Wetlands - Park and trail dedication - Outlot A Greg Brick of Probe Engineering was present representing the developer. The Commission held a discussion which included: - Tree preservation plan and number of trees that will be lost - House pad elevations - Fill on custom graded lots - Deeding of Outlot A to the City 92..10 Motion was made by Whittingham, seconded by Miller to recommend approval of the final plat of Darnels 2nd Rddition subject to the planning report of January 10,1992 with the addition of stipulation number 8 to read "the tree preservation plan tree summary shall be revised to read 31 trees located on custom graded lots. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of the City of Lakeville for an amendment to Section 9.5 of the Lakeville Zoning Ordinance concerning erosion and drainage was opened. The City Attorney attested that all legal notices had been duly published and mailed. Building Official David Krings reviewed the ordinance amendment. He stated that the intent of the amendment is to update and tighten the existing requirements related to drainage and erosion control for development, especially related to individual lots. He further stated that the amendment has been reviewed and approved by the City Attorney and the Environmental Affairs Committee. The Commission discussed the proposed amendment. .There was no public comment. 92.11 Motion was made by Miller, seconded by Smith to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 92.12 Motion was made by Miller, seconded by Whitehouse to recommend approval of the application of the City of Lakeville for an amendment to Section 9.5 of the Lakeville Zoning Ordinance concerning. erosion and drainage. Roll call was taken on the motion.
