Council Chambers. Roll call of members was taken. Present: Whitehouse, O'Donnell, Holberg, Steigerwalt, Whittingham, Smith, Miller. Also present was Robert Erickson, City Administrator; Roger Knutson, City Attorney;. Michael Sobota, Community and Economic Development Director; Daryl Morey, Assistant Community and Economic Development Director; David Krngs, Building-Official; Mira Holliday, Recording Secretary. The minutes of the January 16,1992 Planning Commission meeting were approved as written. The public hearing to consider the application of the State of Minnesota Department of Human Services for the vacation of existing drainage and utility easements on land located at 17041/17053 Jonquil Avenue was continued from the January 2,1992 meeting. Chair Steigerwalt read a letter from the MN Department of Human Services which requested that their. application be tabled until further notice. The letter further stated that additional grading information requested by the City will not be available and the tabling of the application will allow them time to review an alternative site. 92.13 Motion was made by Miller, seconded by Whitehouse to continue the public hearing. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of Vista Telephone for a conditional use permit to construct. a remote telephone switching station on land located in the northwest corner of Dodd Boulevard and Gerdine Path was opened. The City Attorney attested that all legal notices had been duly published and mailed. Daryl Morey presented an overview of the conditional use permit request, outlining the planning report of January 27,1992. He discussed. the following: - Background - Zoning of property - Neighborhood meeting held January 13 - Conditions of Section 26.4(2) of the Zoning Ordinance - `Building materials , Tree preservation Landscaping Parking - Development of Cedar Highlands Park f • ~ FLANNING COMMISSION MINUTES .FEBRUARY 6,1992 Page 2 Mr. Morey stated that staff is encouraged by Vista Telephone's plans for. the remote telephone switching. station and recommended approval of the conditional use permit subject to seven stipulations listed in the planning report, with a modification to stipulation number three to allow the Crty to be added as an additional insured on the performance bond taken out by Vista Telephone's contractor to guarantee performance of site improvements in lieu of a letter of credit. Tim Graf of Vista Telephone was present to answer questions of the Commission and public. The Commission held a discussion which included: - .Parking spaces - F,xterior lighting - Storage of equipment - Size of handicapped parking spaces - Tree preservation - `Maintenance of building - Timeframe for construction of park • _ Alignment of driveway with Gannon Way Signage for park A resident of the area expressed concern over increased traffic and parking. Amendments to the stipulations of the planning report are as follows: 3. A $5,000 letter-of-credit shall be submitted by Vista Telephone or the City shall be added as an additional insured on the performance bond taken out by Vista Telephone's contractor to ensure installation of the parking and landscaping improvements, which shall be completed by July. 1, 1992. 8. The handicapped parking space shall be 16 feet in width. 9. Vista Telephone shall maintain the landscaping and parking area on Vista owned property and the City will maintain the parking and landscaping on City owned property after construction... 10. No overnight parking signage shall be installed. 92.14 Motion was made by Holberg, seconded by O'Donnell to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. i PLANNING COMMISSION MINUTES FE$RU~RY 6, 1992 Page 3 92.15 Motion was made by Whittingham, seconded by Miller to recommend approval of the application of Vista Telephone for a conditional use permit to construct a remote telephone switching station op land located in the northwest corner of Dodd Boulevard and Gerdine Path subject to the amended conditions of the January 27, .1992 planning report, the findings of fact and the draft conditional use permit. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of the City of Lakeville for an amendment to Sections 2.2 and 11.5 of the Lakeville Zoning Ordinance concerning triangular lots was opened. The City Attorney attested that all legal notices had been duly published and mailed. David Krings reviewed the proposed amendment. A brief discussion was held. There was no public comment. 92.16 Motion was made by Whitehouse, seconded by O'Donnell to close the public hearing. . Roll call was taken on the motion. Ayes: Unanimous. 92.17 Motion was made by Miller, seconded by Smith to recommend approval of the application of the City of Lakeville for an amendment to Sections 2.2 and 11.5 of_ the Lakeville Zoning Ordinance concerning triangular lots subject to the planning report. dated January 27,.1992. Roll. call was taken on the motion. Ayes: Unanimous. Michael Sobota discussed a resolution finding the proposal for Modification No. 3 of the Southfork I Housing Development Project Plan, Interest Rate Reduction Program and Housing Tax Increment District No. and approval and adoption of the modified Housing Development Plan and Tax Increment Financing Plan relating thereto to be consistent with the Comprehensive Plan of the City. He explained that the modification will accomplish two actions: 1) the. financing for the acquisition of the Old Station property recently purchased by the City; and 2) the acquisition of the grain elevators m downtown Lakeville, which would be a redevelopment project to demolish the. 40 plus year old elevators in order to allow for additional redevelopment. 92.18 Motion was made by Miller, seconded by Whitehouse to recommend approval of a resolution finding the pproposal for Modification No. 3 of the Southfork I Housing Development Project Plan, Interest Rate Reduction Program and Housing Tax Increment District No. 8, and approval and adoption of the modified Housing Development Plan and Tax Increment Financing Plan relating thereto to be consistent with the Comprehensive Plan of the City. Michael Sobota provided the Commission with additional information regarding the proposed group home to be built in the Rolling Oaks area. 92.19 Motion was made by Holberg, seconded by Whitehouse to adjourn the meeting.
