PLANNING COMMISSION MEETING MINUTES
MARCH 5,1992
The meeting was called to order by Vice Chair O'Donnell at 7:00 p.m. in the
City Hall Council Chambers.
Roll call of members was taken. Present: Miller, Smith, VVhittingham,
O'Donnell, Holberg and Whitehouse. Absent: Steigerwalt.
Also present was Robert Erickson, City Administrator; Jim Walston, Assistant
City Attorney; Michael Sobota, Community and Economic Development Director;
Daryl Morey, Assistant .Community and Economic Development Director; Jeff
Oliver, Assistant Engineer; Charlene Friedges, City Clerk.
The minutes of the February 20, 1992, Planning Commission meeting were
approved as written.
Vice Chair O'Donnell opened the public hearing on the application of Good
Value Homes, Inc. for .the .preliminary plat of 121 single family residential
lots to be known as Homestead Creek East, and a minor comprehensive plan
amendment to bring the property into the Year 2000 Urban Service Area. The
Assistant City Attorney .attested that all legal notices had been duly
published and mailed.
Mr. Morey presented the proposed ppreliminary plat, which is Located in the
• northwest corner. of 175th Street and Highview Avenue. The property is zoned
R-2, Single Family Residential District. The preliminary plat of Homestead
Creek East differs in lot and street layout from the- originally approved
preliminary plat of Homestead Creek. When the Army Corps of Engineers
redefined the boundary for the wetland two years ago, it resulted in the loss
of a number of developable lots. The net density of the proposed plat is 2.6
dwelling units per acre.
Staff review of the .preliminary plat indicates that all but six of the lots
meet R-2 requirements for area and width. However, the final plat for the
first phase of development, .which is a much more precise measure, has been
prepared and indicates that all lots in the first phase will meet lot width
requirements. All other lot width requirements .must be met when future
phases of development are final platted.
Mr. Morey .also discussed the following issues outlined in the planning report
of February 27,1992:
- Bermingilandscaping along 175th Street and Highview Avenue
- Trailways
- Building setbacks
- Right-of--way widths along Hghview Avenue and 175th Street
- Grading, drainage and erosion control
- Wetland fill areas
- Phasing
- Burying overhead electrical power lines

- 172nd Street vacation (driveway access, trail relocation, screening)
Mr. Morey recommended that Stipulation No..S in the planning report be
amended as follows, "The developer shall install landscaping and berming for
each development stage as shown on the landscaping plan dated 2/12/92 prior
to the issuance of any building .permits... Berming and landscaping shall be
installed outside the .utility .easements designated for underground electrical
power lines along Highview. Avenue and 175th Street". He also recommended
..Stipulation #15 be amended as follows, "The overhead electrical power lines
along 175th Street and Highview Avenue and electrical service to the Lots in
Homestead Creek East shall be underground."
Mr. Peterson of Good Value Homes, requested consideration. in moving the
trailway along 172nd Street north of the Good Value Homes property line. Mr.
Erickson exxpplained that the property owner to the north of .Homestead Creek
East, Mr. Heino Benthin, is not in opposition to the proposed plat. However,
he has requested screening between the trailway and his property.
Mr. Steve Witt, 17388. Harding Lane, asked about the wetland fill area,
recognizing the water problems that exist in the Cherrywood Heights area. He
was concerned whether this area had been properly tested.
. Mr. Peterson assured Mr. Witt that these homes will not experience ground
water problems, stating the house pads in this area are significantly higher
in elevation than the surrounding wetland. He stated the majority of these
lots will be able to accommodate a full basement. Staff stated the developer
will be required to submit soil borings.
Mr. Ed Brunkhorst of Dakota Electric Association spoke about the overhead
lines along 175th and Highview and their intentions to have these lines
buried as part of the development of this plat.
Mr. Walston discussed the necessity of vacating 172nd Street and recommended
utility companies and affected property owners be notified of the proposed
vacation when that phase is final platted.
The commission held a discussion which included:
- Depth of lots 12 and 13, Block 6; berming and landscaping will provide
screening.
- Wetland area concerns.
- Trees being donated by the City to provide screening along the north
side of the 172nd Street MPTW; the adjacent property owner must grant
the City permission to enter the property for installation of the trees.
- Location of trailways on neighborhood streets; not a practice of the
City.
- Future width of 175th Street.

- Drainage -changes in .the City's policy on drain the .will help assure
that .groundwater problems will not occur; water problems in Homestead
Creek developments have been minimal.
92.26 Motion was made by Miller, seconded by Smith to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
92.27. Motionwas made by Holberg, seconded by Whitehouse to recommend approval of
the preliminary plat of Homestead Creek East and a minor comprehensive plan
amendment to bring the property into the Year 2000 Urban Service Area,
subJ'ect to amendments to Stipulations #5 and #15 of the planning report dated
2/27/92, as outlined by Mr. Morey, and the addition of .Stipulations #18 and
#19 as follows:
18. .Additional landscape screening shall be provided for Lots 9-13 and: Lot
20, Block 6, subject to City approval.
19. Staff to review the basement floor elevation for Lot 1, Block 4, in
relation to the wetland to ensure it meets FHA requirements.
.Roll call was taken on the motion. Ayes: Unanimous.
• Chair O'Donnell opened the public hearing on the application of the City of
Lakeville for an amendment to Section 9.7 of the Lakeville Zoning Ordinance
concerning landscaping. The Assistant City Attorney attested that all legal
notices had been duly published and mailed.
Mr. Morey presented the proposed zoning ordinance amendment as outlined in
the .planning report dated February 28, 1992. Mr. Morey indicated the
amendments were to clarify the language and make the zoning ordinance,
development contract and tree. preservation policy all consistent. Subsection
(3c) relates to .suitable trees for planting in new residential subdivisions,
semi-public and all income producing property uses. This section currently
includes only deciduous trees as suitable plantings. Staff is recommending
this section be amended to include a list of suitable coniferous trees to be
used for screening purposes only.
.Subsection {3d) is amended by adding wording which would prohibit .the
planting of trees and shrubs in the right-of--way. Designated parkways are
proposed to be an exception to this section, with City Council approval.
Subsection (3e) would change the warranty period from two years to a more
practical 12 months, which is consistent with the City's contracts .with
developers.
Commissioner Miller asked about the 12-month warranty on trees.. Staff
explained that 12 months is a standard warranty, and staff feels it is
adequate.

92.29 Motion was made by Miller, seconded by Whitehouse to recommend approval of an
amendment to Section 9.7 of the zoning ordinance concerning landscaping.

Commissioner Whitehouse provided an update on the Strategic Growth Management
Task Force.
Under unfinished business, Commissioner O'Donnell discussed a proposal for
architectural review by the Planning Commission of new development locating
in the City. Under the proposed policy, a developer would be asked to submit
a site plan, elevation and floor plans and a written description of how the
proposed development fits in with the surrounding land use.
Mr. Erickson suggested Mr. O'Donnell present the proposal to the Economic
Development Commission for their support before forwarding it to the City
Council for approval.
Under new business, Commissioner Whitehouse asked that consideration be given
to increasing minimum residential lot sizes in the R-2, R-3 and R-4 zoning
districts.
92.30 Motion was made by Miller, seconded by Whitehouse to direct staff to do an
appropriate evaluation on increasing minimum residential lot sizes, and
report back to the Planning Commission with a recommendation. _

Vice Chair O'Donnell adjourned the meeting at 9:40 p.m.
