HomeMy WebLinkAbout03-19-92 # y CITY OF LAt~EVILLE PLANNING COMMISSION MEETING MINUTES MARCH 19,1992 .The meeting was called to order by Chair Steigerwalt at 7:00 p.m. in the City Hall Council Chambers. Roll call of members was taken. Present: O'Donnell, Holberg, Steigerwalt, Whittingham, Smith and Miller. Absent: Whitehouse. Also present was Robert Erickson, City Administrator; Jim Walston, Assistant City Attorney; Michael Sobota, Community and Economic Development Director; Daryl Morey, Assistant Community and Economic Development Director; Jeff Oliver, Assistant Engineer; Mira Holliday, Recording Secretary. The minutes of the March 5,1992 Planning Commission meeting were approved as written. Jeff Bonde of the Environmental Affairs Committee gave a brief presentation on the upcoming Community Clean-Up Day on Apri125. He stated that volunteers are needed and asked for Planning Commission member support. Whitehouse arrived at 7:10 p.m. • The public hearing to consider the application of Carol McCoy for a special home occupation permit to allow the operation of a photography studio in a single family residence located at 20676 Jaguar Avenue was opened. The City Attorney attested that all legal notices had been duly published and mailed. Daryl Morey presented an overview of the proposed home occupation, outlining the planning report of March 13,1992. He discussed the following:... - :Background - Zoning Ordinance regulations (Section 10) - Hours of operation. - Number of customers daily - Number of employees (applicant only) - Outdoor storage of equipment (none) - Customer parking Signage Mr. Morey stated that staff recommends approval of the special home occupation permit request far a photography studio subject to nine stipulations listed in the planning report:. Mrs. McCoy was present to answer questions of the Commission and public. Carol Tovar of 205th Street expressed her concern over the possible • increase in traffic. .PLANNING COMMISSION MEETING MINUTES • MARCH 19,1992 Page 2 Mary Lee Taylor of 20640 Jaguar Avenue expressed her concern over increased traffic in the area and the safety of neighborhood children. She also presented letters from two other area residents opposingthe photography studio. The Commission held a discussion which included: - Average number of customers per week (limited to one at a time) - Signage - .Traffic in the area - Possibfity of police monitoring speed in the neighborhood - .Fire precautions and film developing Mrs. McCoy stated she anticipated no more than one customer per. day and ...that all customerswould be byappointment only. She further stated no film developing would take place at her home. Ms. Taylor again expressed her concern over the safely of the children in the neighborhood and the. possibility of increased traffic. Staff discussed with the Commission and residents the future expansion of 205th Street into the Lake Marion Estates development. Mr. Erickson stated he would have. the police department monitor the traffic speed in the • neighborhood. Recommendation number three of the planning report was modified to read: Signage must meet City Siggnn Ordinance. requirements and shall require permit approval by the Building Official, shall not advertise the nature of the business, shall be attached to and be an integral part of the mailbox which shall be moved closer to the driveway, shall be not more than two square feet in area and shall be complimentary in color to the house. The McCoys agreed that the sign would not include the nature of the business but would include only their name if they elect to put up a sign. 92.31 Motion was made by Miller, seconded by Smith to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 92.32. Motion was made by Miller, seconded by Smith to recommend approval of the application of Carol McCoy for a special home occupation ~ernut to allow the operation of a photography studio in a single famdy residence located at 20676 Jaguar Avenue subject to the recommendations in the planning report of March 13,1992 as amended and the findings of fact. PLANNING COMMISSION MEETING MINUTES MARCH 19,1992 .Page 3 The public hearing to consider the application of David Truehart for the prelimuiary and final plat of seven single family residential lots to be known as Truehart Addition, and a ten foot side yard budd'u~g setback variance for those lots abutting Orchard Lake on land located adjacent to Judicial Road and north of 170th Street on the west side of Orchard Lake was opened. The City Attorneyattestedthatali legal notices had been duly published and mailed Daryl Morey presented a backgroundihistory of the proposed replat and outhned the planning report of March 13,1992. He discussed the following: - Judicial Road project - Attemppted administrative subdivision/combination process - Lots/blocks - Streets - Grading, utilities and easements - Setbacks - Variances for setbacks Mr. Morey stated staff is recommending approval of the Truehart Addition preliminary and final plat as a replat subject to four stipulations listed • m the planning report. Mr. Truehart discussed the background of the project, stating he had invested $50,000 in ading and. the administrative subdivision process. He further stated that if variances are not granted, he would have to redesign the plat to include three lots on the east side of Judicial Road instead of four. The Commission held a discussion which included: Sideyard setbacks - Hardship regarding variance request - Housepad grading - Arrangements made during Judicial Road Project - Vacated streets - Design i£ plat is changed to three lots - Setbacks. on adjoining properties - Possb~ity of a total 30 foot sideyard setback between the houses on each lot Mr. Erickson explained that Mr. Truehart's property consists of approximately 20 lots of record and that he ~s entitled legally to an administrative combination/subdivisionbnt due to part of the property being torrens property and part being abstract property, as well as the property involving two different plats, the Dakota County Recorder • recommended the City assist the developer with re-platting the property. The Commission was in agreement that staff and Mr. Truehart should work together further in an effort to eliminate the need for a variance. • PL~INNING COMMISSION MEETING MINLTI~S MARCH 19,1992 Page 4 92.33 Motion was made by Miller, seconded by Holbergg to continue the public hearing pending further review and revisions by the applicant and staff. The public hearing to consider the application. of David Oster for a conditional use permit to allow the construction of a detached. accessory building in excess of 1,100 sgcare feet in size in an R-2, Sin~gla Famd}r Residential District on land. located at 7820 200th Street West was continued from the January 2,.1992 Planning Commission meeting. Michael Sobota stated a letter had been received from Mr. Oster's attorney along with revised plans for the site on March 18. He further stated that staff had not reviewed the proposed revisions and suggested that the public hearing be tabled for staff review and recommendation. 92.34 Motion was made by O'Donnell, seconded by Smith to continue the public hearing. Roll call was taken on the motion. Ayes: Unanimous. Under unfinished business. Robert Erickson updated the.
