PLANNING COMMISSION MEETING MINUTES
JULY 16, 1992
The meeting was called to order by Chair Steigerwalt at 7:00 p.m. in the
City Hall Council Chambers.
Roll call of members was taken. Present: Whitehouse, O'Donnell, Holberg,
Steigerwalt, Whittingham. Absent: Miller, Smith.
Also present was Robert Erickson, City Administrator; Jim Walston,
Assistant City Attorney; Michael Sobota, Community and Economic Development
Director; Daryl Morey, Assistant Community and Economic Development
Director; Alan Brixius, NAC; Jeff Oliver, Assistant Engineer;. Mira
Holliday, Recording Secretary.
The minutes of the June 25,1992 Planning Commission meeting were approved
as written.
Staff requested that consideration of the Marion Pines 2nd Addition be
tabled pending submission and review by staff of an as-built grading plan
for the area.
92.82 Motion was made by Whittingham, seconded by Holberg to continue .the. public
hearing to consider the application of Eldon Fossum for the .preliminary
plat of 45 single family residential lots to be known as Marion Pines
Second Addition and a minor comprehensive plan amendment to bring the
proper mto the. Year 2000 Urban Service Area on land located on the south
side of ~.H. 50 at Jaguar Avenue.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Richard and Laverne
Fenner .for a conditional use permit to allow the construction of a detached
accessory building on a single family residential lot located at 7880 202nd
Street West was opened. The City Attorney attested that all legal notices
had been duly published and mailed.
Daryl Morey presented an overview of the propposed detached garage,
outlining the planning report of July 10,1992. He discussed the
following:
- Background
- Need for the proposed detached garage
- Materials to be used
- Certificate of Survey showing location of the existing house and
attached garage as well as the proposed detached garage.
- Floor plan showing items proposed to be stored in the detached garage
- Outdoor storage
- Existing and proposed landscaping on property
- Private septic and water system
- Zoning Ordinance requirements regarding area and height limits for
accessory buildings

Mr. Morey stated that staff recommends approval of the proposed detached
garage subject to eight stipulations listed in the planning report.
Mr. and Mrs. Fenner were present to answer questions of the Commission and
public. Mr. Fenner stated they were in agreement with the recommendations
of staff.
The Commission held a discussion which included:
- Flooring of the proposed garage (concrete slab)
- Heat and plumbing (none planned)
- Height of the garage (less. than 15 feet)
- Planting of trees/shrubs for screening purposes
- Driveway surface (class 5 gravel)
- A letter from Roger and Dianne Piejarski was received and discussed
There was no other public comment.
92.83 Motion. was made by O'Donnell, seconded by Holberg to close the public
hearing.
Roll call was taken on the motion. Ayes: Unanimous.
92.84 Motion was .made by Holberg, seconded by Whitehouse to recommend approval of
the application of Richard and Laverne Fenner for a conditional use permit

The public hearing to consider the application of John Petran for a
conditional use permit to allow a veterinary clinic in a B-2, Retail
Business District on land located at 165?0 Cedar Avenue was opened. The
City Attorney attested that all legal notices had been duly published and
mailed.
Alan Brixius presented an overview ofthe proposed veterinary clinic to be
located in a bay of the Ole Piper Inn strip center located at Cedar Avenue
and 167th Street, outlining the planning report of July 9,1992. He
discussed the following:
- Background
- Zoning
- Soundproofing
- Material disposal

- Surgical and medical boarding only
- Kennel requirements
- Adverse affects consideration
Mr. Brixius stated he recommends approval of the conditional use permit
subject to eight stipulations listed in the planning report.
Mr. Petran was present to answer questions of the Commission. and public.
He stated that the south wall in common with Ole Pipe Inn, which was
addressed in the planning report, is an existing wall made of cinder
block. He also stated, in regard to stipulation number 2, that he will
only be installing cages for the overnight hospitalization of up to 12
animals rather than the maximum allowable number of 20,
The Commission held a discussion which included:
- Noise in regard to adjacent. tenants
- Possibility of sound testing
- Adequate ventilation
- Waste disposal
- Hours of operation
- Number of employees
- Parking
- Facilities for bathing animals
Amendments to stipulations listed in the planning report are as follows:
1. Soundproofing plan needs to meet Zoning Ordinance requirements of
soundproofing animal ward by specifying materials selected andpercent
soundproof. Measures should be taken to soundproof entire clime in
order not to disturb adjacent building uses. This item should be
subject to testing as deemed necessary by the Building Official.
2. The number of animals hospitalized overnight shall not exceed 12. It
should be demonstrated that overnight hospitalization capacity will be
based on building capacity.
There was no public comment.
92.85 Motion was made by O'Donnell, seconded by Holberg, to close the public
hearing.
Roll call was taken on the motion. Ayes: Unanimous.
92.86 Motionwas made by Whittingham, seconded by Holberg, to recommend approval
of the application of John Petran for a conditional use permit to allow a
veterinary clinic in a B-2, Retail Business District on land located at
.16570 Cedar Avenue subject to the planning report of July 9,1992 as
amended and the findings of fact.

The public hearing to consider the application of Cooperative Power
Association for a conditional use permit amendment to allow the
installation of antennas in excess of 15 feet in height on land located at
17709 Ipava Avenue was opened. The City Attorney attested that all legal
notices had been duly published and mailed.
Alan Brixius presented an overview of the application and plans for
construction of two antennae on top of an existing 100 foot steel
transmission pole that is a part of an existing electrical substation. He
stated that an amendment to the .original conditional use permit is required
in order to allow construction of the antennae within an R-2 Zoning
District. Mr. Brixius also discussed the following:
- Facility need
- Zoning
- No outside storage
- Adequate screening and. landscaping
- Provisions of Section 4.2(5) of the Zoning Ordinance (CUP judgement
criteria)

Mr. Brixius stated that he recommends approval of the amended conditional
use permit subject to four conditions listed in the July 8,1992 planning
report.
Bill McGoldrick and Dennis Wilson of Cooperative Power, along with Ed
Brunkhorst of Dakota Electric, were present to answer questions of the
Commission and public. Mr. Brunkhorst stated that he feels there is
sufficient landscaping on the site, as he had personally counted 87
plantings. He went on to explain that the landscape plan approved with the
original conditional use permit in 1987 was conceptual.
Mr. Brixius stated that a site inspection should be conducted by staff to
determine if the landscape screening approved with the original conditional
use permit is adequate and if additional plantings will be necessary.
The Commission held a discussion which included:
- Height of antennae
- Tree preservation
Amendments to conditions in the planning report are as follows:
a. The site be in compliance with the screening requirements pertaining
• to planting of trees and vegetation on the subject property. All dead
trees and vegetation shall be removed and replanted forthwith.

b. The driveway be surfaced with asphalt or other paving material to be
in compliance with Zoning Ordinance requirements. Placement of
asphalt shall be up to within than two feet of the exterior of the
fence.
e. Total antennae height not to exceed 120 feet.
92.87 Motion was made by Holberg, seconded by O'Donnell, to close the public
hearing.
Roll call was taken on the motion. Ayes: Unanimous.
92.$8 Motion was made by Holberg, seconded by O'Donnell to recommend approval of
the application of Cooperative Power Association, for a conditional use
hermit amendment to allow the installation of antennae in excess of 15 feet
m height on land located at 16609 Ipava Avenue subject to the planning
report of July 8,1992 as amended and the findings of fact.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of the City of Lakeville for
• a rezoning from R-7, High Density Residential District, to R-2, Single.
Family Residential Distract, on land Iocated east of Kenrick Avenue at
181st Street was opened. The City Attorney. attested that all legal notices
had been duly published and mailed.
Alan Brixius presented an overview of the proposed rezoning, outlining the
planning report. of July 9,1992. He discussed. the following:
Zoning history
- Opinion survey of property owners
- Judgement criteria
- Land use compatibility
- Comprehensive plan
- Sanitary sewer service
- Thompson property
Mr. Brixius stated he recommends approval of the rezoning of Lots 1 and 2
and a ortion of Lot 3, Block 3 of the Acorn Heights Addition from R-7,
High Density Residential to R-2, Single Family Residential subject to the
recommendations listed in the planning report.
The Commission held a brief discussion.
92.89 Motion was made by O'Donnell, seconded by Holberg to close the public
hearing.

92.90 Motion was made by O'Donnell, seconded by Whitehouse, to recommend approval
of the application of the City of Lakeville for a rezoning from R-7, High
Density Residential District, to R-2, Single Family Residential District,
on land located east of Kenrick Avenue at 181st Street legally described as
Lots 1 thru 3, Block 3, Arcorn Heights, subject to the planning report of
July 9,1992.
Roll call was .taken on the motion. Ayes: Unanimous.
Daryl Morey presented an overview of the final plat of Lake Marion Estates
2nd Addition. He stated the final plat consists of 25 single family
residential lots on land located on the south side of 205th Street, east of
Juno Trail. He went on to discuss the following:
- Background
- History
- Consistency with the approved preliminary plat
- Lots/blocks
- Outlot
- Setbacks
- Streets

Mr. Morey stated that staff recommends approval of the Lake Marion Estates
2nd Addition. final plat subject to nine recommendations. listed in the
planning report dated July 9,.1992.
Rick Murray of Builders Development and Rick Sathre, engineer for the
project, were present. The .Commission held a discussion which included:
- Option of hammer head. driveway on Lot 6, Block 2 or access off Jasmine
Avenue
- Lot size, setbacks and berming on Lot 1, Block 3
- Tree preservation
- Renaming of Jasmine Avenue to Jasmine Path (additional stipulation
number 10)
92.91 Motion was made by Holberg, seconded by O'Donnell, to recommend approval of
the final plat of Marron Estates 2nd Addition subject to the planning
• report of 3uly 9,1992 as amended.

Alan Brixius presented an overview of the Meadow. Brook 4th Addition final
plat, outlining the planning report of July 9,1992. He discussed the
following:
- Background
- Blocks.
- Lots
- Streets
- Utilities
- Grading, drainage and erosion control
- Parks
- Sidewalks and trails
- .Landscape screening plan
- Comprehensive plan amendment
- Outstanding unprovements/issues
Mr. Brixius recommended approval of the final plat of Meadow Brook 4th
Addition subject to ten conditions listed in the planning report dated July
9, 1992.
Warren Israelson, project engineer and developer, was present to answer
• questions.
The Commission held a brief discussion regarding lot sizes, house styles
and decks.
92.92 Motion was made by O'Donnell, seconded by Whitehouse to recommend
approval of the final-plat of Meadow Brook 4th Addition subject to the
planning report of July 9,1992.
Roll call was taken on the motion. Ayes: Unanimous. _
Robert Erickson discussed Ordinance No. 46b, an interim ordinance
temporarily prohibiting approval of certain residential developments and
expansion or development of mobile (manufactured) home parks and Resolution
No. 92-115 directing preparation of growth management controls.
Under new business, Michael Sobota discussed a special Planning Commission.
meeting to be held July 30,1992 to consider amendments to Crystal Lake
Golf Estates PUD and the grading plan.
The meeting was adjourned by Chair Steigerwalt at 9:40 p.m.
