HomeMy WebLinkAbout06-15-09CITY OF LAKEVILLE COUNCIL MEETING MINUTES JUNE 15, 2009 Mayor Dahl called the meeting to order at 7:00 p.m. The pledge of allegiance to the flag was given. Present: Mayor Holly Dahl Council Member Kerrin Swecker Council Member Laurie Rieb Council Member Mark Bellows Also Present: Roger Knutson, City Attorney Steve Mielke, City Administrator Tom Vonhof, Police Chief Keith Nelson, City Engineer Dennis Feller, Finance Director David Olson, CED Director Steve Michaud, Parks Recreation Director Daryl Morey, Planning Director Charlene Friedges, City Clerk Mr. Mielke had no additional agenda information. Presentations /Introductions Pan -O -Prog Past President Dave Litzinger outlined the schedule of events for this year's Panorama of Progress celebration. He also presented the new Pan -O -Prog logo and recognized the many sponsors and volunteers who make the annual summer festival possible. Cindi Rollins, representing the Government Finance Officers Association of the United States and Canada, presented a Distinguished Budget Presentation Award to the City of Lakeville. Brian Kempa, David Lang and Tom Nesseth accepted the award on behalf of the City's Finance Department. Chief Vonhof presented a Chief's Award of Merit to Cub Scout Pack 260 Tiger Den 5 for their efforts in extinguishing a fire in Ritter Farm Park. Chief Vonhof presented the May Police Department monthly report. Steve Michaud presented the May monthly report of the Parks Recreation Department. Citizens' comments None Consent agenda 09.39 Motion was made by Rieb, seconded by Bellows, to approve the consent agenda items as follows: a. Claims for payment. b. Minutes of the June 1, 2009 City Council meeting, June 8, 2009 Special Council meeting and May 11, 2009 Council work session. c. Receive minutes of the following advisory committee meetings: Parks Recreation Natural Resources Committee, June 3 Planning Commission, June 4 Economic Development Commission, May 26 d. Resolution No. 09 -42 authorizing the sale of assets. e. Resolution No. 09 -43 authorizing the temporary closing of City streets for Pan -O -Prog events. f. Extension of on -sale liquor license for Babe's Sportsbar Grill to allow the sale of alcoholic beverages and live entertainment in the fenced -in parking lot on July 10 -11, 2009. g. Temporary on -sale liquor license for VFW Post 210 to host Pan -O- Prog events on July 9 -11, 2009. h. Resolution No. 09 -44 authorizing the use of certain parks, Senior Center and Arts Center for Pan -O -Prog events. Professional Services Agreement with Brauer Associates, Ltd. for Field Stone Park development. Quail Ridge 2nd Addition preliminary plat extension. o. Resolution No. 09 -46 approving Energy Efficiency Conservation Block Grant (EECBG) Program application. p. Resolution No. 09 -47 approving State of Minnesota Agency Agreement No. 94790 with the Department of Transportation for Federal Participation in Construction Holyoke Avenue /Highview Avenue reconstruction, Improvement Project 09 -02. Roll call was taken on the motion. Ayes, unanimous. Item 7 Brackett's Crossing On -Sale and Sunday Liquor License Mayor Dahl opened the public hearing on the application of Northern Gopher Enterprises, Inc. for an on -sale and Sunday liquor license at Brackett's Crossing Country Club, 17976 Judicial Road. The City Clerk attested to legal notice publication. Sergeant Kornmann explained that Brackett's Crossing has had a club liquor license in the past. Due to the expansion of their facility, Brackett's is requesting a full liquor license. The on site daily operation of the business will not change with this license. The Police Department has no objection to the issuance of an on -sale and Sunday liquor license. The applicant, Tom Smith, stated that the full liquor license will allow them to provide off -site catering services. There were no questions or comments. 09.40 Motion was made by Swecker, seconded by Rieb to close the public hearing. Ayes, unanimous. 09.41 Motion was made by Swecker, seconded by Rieb to grant an on -sale and Sunday liquor license to Northern Gopher Enterprises, Inc. at Brackett's Crossing Country Club, 17976 Judicial Road. Roll call was taken on the motion. Ayes, unanimous. Item 8 Liquor License Renewal Mayor Dahl opened the public hearing on the renewal of on -sale liquor, club liquor, Sunday liquor, wine and 3.2% malt liquor licenses. The City Clerk attested to legal notice publication. Sergeant Kornmann presented the list of applicants requesting renewal and a detailed analysis of each licensed establishment. All existing license holders meet the ordinance requirements for renewal. Item 9 Market Plaza /Ace Hardware Roger Heyda and Dean Simon requested Council approval of the Market Plaza preliminary and final plat, right of way vacation and conditional use permit for a new Ace Hardware store, to be constructed on Lot 1, Block 1 of the Market Plaza plat. Dave Olson presented the planning report. He explained that the replatting of this area is being requested to reflect the property lines that were adjusted with the City's construction of Market Plaza and to combine several parcels that exist within the multi- tenant retail buildings owned by Metro Equity Management. The plat consists of three lots and includes Outlot A, which consists of the newly constructed Market Plaza to be owned and maintained by the City. The right of way being vacated is the area of 208th Street between Holyoke Avenue and Holt Avenue which is now encompassed by Market Plaza. A conditional use permit is being requested to allow Ace Hardware to use several of the parking spaces within Market Plaza to meet the parking requirements of the Commercial Central Business District area. The Planning Commission held a public hearing and recommended approval of the preliminary and final plat, easement vacation and conditional use permit subject to 11 stipulations. Staff recommends approval. CITY OF LAKEVILLE COUNCIL MEETING MINUTES JUNE 15, 2009 Page 6 09.44 Motion was made by Rieb, seconded by Bellows to approve Resolution No. 09 -48 vacating public right of way; Resolution No. 09 -49 approving the preliminary and final plat of Market Plaza; and approve Findings of Fact and a Conditional Use Permit to allow off -site parking in the Commercial Central Business District. Roll call was taken on the motion. Ayes, unanimous.
