PLANNING COMMISSION MEETING MINUTES
OCTOBER 1,1992
The meeting was called to order by Chair Steigerwalt at 7:00 p.m. in the
City Hall Council Chambers.
Roll call of memberswas taken. Present: Whitehouse, O'Donnell, Holberg,
Steigerwalt, Whittingham, Smith, Miller.
Also present: Robert Erickson, City Administrator; Jim Walston, Assistant
City Attorney; Michael Sobota, Community and Economic Development
Director; Daryl Morey, Assistant Community and Economic Development
Director; Alan Brixius, Northwest Associated Consultants; Jeff Oliver,
Assistant Engineer; Mira Holliday, Recording Secretary.
The. minutes of the September 17,1992 Planning Commission meeting were
approved as writtenwith a revision to the attendance statement.
Daryl Morey presented an overview of the final plat of Lake Villa Golf
Estates 7th Addition, outlining the planning report of September 25,1992.
His discussion included the following: .
- Background
- History
Consistency with the approved preliminary plat
Lotsiblocks
- Outlots
- Setbacks
Streets
- Grading, drainage and erosion control
- Eng~'neering report dated September 24,1992
- Dakota County Soil and Water Conservation District report dated
September 22,1992
- Environmental Affairs Committee recommendation
- Tree preservation

- Park and trail dedication
- MUSA
Mr. Morey stated that staff recommends. approval of the Lake Villa Golf
Estates 7th Addition final plat subject to 11 stipulations listed in the
planning report.
Byron Watschke, Carl Dale and Paul 'Thomas were present to answer questions
of the Commission.
The Commission held a discussion which included:
- Whitehouse felt the retaining wall on Lot 1, Block 2 should be made. of
- native rock
Number of trees to be removed
- Wetland mitigation

- Easement on 179th Trail
- Building pad for Lot 2, Block 1
Commission member Smith expressed his concern over the number of trees to
be removed. He stated he felt the plat is flawed because of he large
percentage of trees being removed. He noted that the tree preservation
plan includes a number of trees located outside the final plat boundaries..
He pointed out that by excluding these trees from the sigmficant tree
inventory for this final plat, the percentage of significant trees saved is
reduced to approximately 32 percent. Mr. Smith also expressed his concern
regarding drainage issues in the existing Lake Villa Golf Estates
.development as well as the 7th Addition and future phases. Jeff Oliver
explained the proposed storm water drainage system to be implemented with
this final plat. Mr. Oliver pointed out that the proposed storm water
drainage system will help alleviate storm water drainage problems that.
currently exist in Lake Villa Golf Estates.
The following amendments were made to the stipulations of the planning
report:
6. The final plat shall be revised so that the street names for Kewanee
Circle North and South are changed to read Kestrel Court and Kettle
River Court respectively.
12. Each custom graded lot will be evaluated by City staff at the time of
building permit application in an effort to maximize the number of
significant trees to be saved.
Mike O'Desky, representing the Lake. Villa Homeowners Association presented
a list of concerns to the Commission. He discussed the following:
- Background and purpose of the homeowners association.
- Concern over ponding issues.
- Parties responsible if more trees are killed due to drainage problems.
- Stagnation of the pond.
- Need for environmental impact statement
- Easements in regard to long term drainage.
- Removal of diseased/dead trees.
- DNR jurisdiction
- Concern over number of trees to be removed.
- Concern over covenants and enforcement.
- Architectural review committee.
- Concern over maintaining current standard of living and property
values.

Michael Sobota explained that the City does nat become involved in the
development or enforcement of covenants and suggested that the Homeowners
Association contact the developer. Jeff Oliver explained the City's role in
maintaining. water quality, removal of dead/diseased trees, and the role of
..the DNR.
Byron Watschke stated he had received few complaints on the previous
additions of Lake Villa Golf Estates that he developed. He further stated
that the square footage requirement for housingg was being increased in the
protective covenants proposed far the 7th and $th Additions.
Robert Erickson briefly discussed the history of the Lake Villa area,
stating there have been many developers and that the only addition that a
tree preservation plan had been prepared was the 6th Addition. He went on
to state that each addition has its own covenants and that their homeowners
association cannot enforce covenants in an addition other than their own.
92.141 Motion was made by Miller, seconded by Whittingham to recommend approval of
the final plat of Lake Villa Golf Estates 7th Addition subject to the
lanning report of September 25,1992 as amended, the engineering report of
September 24,1992, the Dakota County Soil and Water Conservation District
t report dated September 22,1992, and the Barr Engineering memorandum dated
September 16,1992.
Roll call was taken on the motion. Ayes: Whitehouse, O'Donnell, Halberg,
Steigerwalt, Whittingham, Miller. Nay: Smith
Smith stated the reason he voted nay was he felt the developer needs to
work in good faith with the residents from other additions, the tree
preservation plan is inadequate, and the City needs to control lots for
sale that are partially under water.

Mr. Morey stated that staff recommends approval of the Royal Woods Fourth
Addition final plat subject to eight stipulations listed in the planning
report.
Ralph Wagner of Probe Engineering, representing the developer, was present
to answer questions of the Commission.
The Commission held a brief discussion. It was decided to change the name
Juniata Court to June Court.
92.142 Motion was made by Holberg, seconded by Whittingham to recommend approval
of the final plat of Royal Woods Fourth Addition subject to the planning
report of September 24,1992 as amended..
Roll call was taken on the motion. Ayes: Unanimous.

report.
• John Rezac, developer and Jerry Sunde of Sunde Engineering were present to
answer questions of the Commission.

The Commission held a brief discussion. It was decided to change Fishook
Court to Fisher Court.
92.143 Motion was made by Holberg, seconded by O'Donnell to recommend approval of
the final plat of Dodd Ridge Fourth Addition subject to the planning report
dated September 24,1992 as amended, the engineering report dated September
18,1992 and .the Dakota County Soil and Water Conservation District report
dated September 23, 1992.
Roll call was taken on the motion. Ayes: Unanimous.
.ITEM 7
Robert Erickson presented an update on the Stonebriar and Lynwood South 2nd
Addition revised preliminary plats. He stated that four meetings had been
held with City staff and the developers in an effort to revise the two
pplats to the satisfaction of the City, the developers and area residents.
Mr. Erickson discussed the wetlands and park land to be purchased and
controlled by the City, the revised tree inventory, and street realignment.
Alan Brixius reviewed the findings of fact and recommendations for the
Lynwood South 2nd Addition and Stonebriar preliminary plats,. outlining each
recommendation along with. a response based on the developers' revised
preliminary plat design and negotiations with City staff.
Mr. Erickson then reviewed in detail the proposed park concept plan,
stating that the Parks and Recreation Advisory Committee and the
Environmental Affairs Committee had not yet reviewed the proposed draft
concept plan. He explained that the proposed access points would be
through the Kranz and Boehmer property in the Ridgeview subdivision.
John Prins, developer of Stonebriar and Scott Johnson, developer of Lynwood
were present.
Chair Steigerwalt and Commission member Whitehouse thanked the developers
and City staff for their efforts and cooperation in making the design
changes to the preliminary plats making a much more workable project.
John Prins expressed his appreciation to Mr. Kranz for allowing the park
access through his property.
The Commission held a brief discussion regarding the cul-de-sac adjacent to
Goose Lake and possible parking for residents using the trail system.
A Lynwood South resident expressed his appreciation for the sensitivity of
the Planningg Commission and City staff regarding the neighborhood
.concerns. He questioned what would happen if the City could not get a
second access, as planned, throughthe Ridgeview area.

92.144 Motion was made by Miller, seconded by Whittingham to recommend approval of
the revised preliminary plats of Stonebriar of Lakeville and Lynwood South
2nd Addition subject to the findings of fact and recommendation and
responses as identified in the September 24,1992 planning memorandum
prepared by Alan Brixius, NAC; and approval of the. plans and .exhibits as
shown subject to the recommendations of the Environmental Affairs Committee
and the Parks and Recreation Committee.
Roll call was taken on the motion. Ayes: Steiggerwalt, Whittingham, Smith,
Miller, Whitehouse, .O'Donnell. Abstain: Holberg.
Chair Steigerwalt adjourned the meeting at 10:15 p.m.
