CITY OF LAKEVILLE
PLANNING COMMISSION MEETING MINUTES
NOVEMBER 5, 1992
The meeting was called to order by Chair Steigerwalt at 7:00 p.m. in the
City Hall Council Chambers.
Roll call of members was taken. Present: Whitehouse, Holberg,
Steigerwalt, Whittingham, Smith, Miller. Absent: O'Donnell.
Also ppresent:. Robert Erickson, City Administrator; Jim Walston, Assistant
City Attorney; Michael Sobota, Community and Economic Development Director;
Daryl Morey, Assistant Community and Economic Development Duector; David
Licht, Northwest Associated Consultants; Allan Hunting, Northwest
Associated Consultants; Mira Holliday, Recording Secretary.
The minutes of the October 15,1992 Planning Commission meeting were
approved as written.
ITEM 4
Michael Sobota stated that Freeborn-Mower, Ltd. had withdrawn their
application for the vacation of a portion of 165th Street West located east
of Ipava Avenue. He further stated that the vacation of this portion of
right-of--way will be addressed during the replatting of subsequent phases
. of the Crystal Lake Golf Estates PUD. No action was. needed on the item.
ITEM 5
The public hearing to consider the application of M.W. Johnson
Construction, Inc. for a rezoning from R-2, Single Family Residential
District to R-3, High Density Single Family Residential District on land
located in the northeast corner of 208th Street and Hollins Avenue was
opened.
The public hearing to consider the application of M.W. Johnson
Construction, Inc. far a lot width variance for: an interior lot in an R-3,
High Density Single Family Residential District to allow the construction
of a single family residence on Land located in the northeast corner of
208th Street and Hollins Avenue was opened.
The City Attorney attested that all legal.. notices had been duly published
and mailed.
Daryl Morey presented an overview of the rezoning and variance requests,
outlining the planning report of October 29,1992. He discussed the
following:.
- Background
- Administrative subdivision
- Rezoning from R-2 to R-3

- Lot width variance for one of the two proposed lots.
- Minimum building setbacks for R-3 District
- Building plans for proposed houses to be constructed
- Comprehensive Plan land use goals for the area
- Hardship related to variance request
- Comparison of lot sizes in surrounding single family neighborhood
Mr. Morey discussed letters received from area residents including a letter
from Amelia Sauser, Felix Tillges, Vidas Voas, and Audrey Johnson. He
responded to issues raised in each individual letter. He further stated
that staff recommends approval of the rezoning and variance requests
subject to four stipulations listed in the planning. report plus an
additional stipulation requiring hammerhead driveways for both lots.
Mr. Dale McClosky, representing M.W. Johnson Construction, Inc. was present
and provided pictures of the homes proposed to be built on the site.
Dwayne Voas, 20865 Holiday Avenue, commended staff and the Commission for
their quality work. He stated he is concerned that rezoning the property
would impact the property values of surrounding property. He further
stated he believes there is no hardship involved that would warrant a
variance.
David Licht, Northwest Associated Consultants, stated he believed the 70
percent rule for parcels of record in the Zoning Ordinance relatedto
setbacks and lot dimensions would apply to this issue, therefore a rezoning
or variance would not be required under this rule.
Mr. Erickson recommended the Planning Commission table this item to allow
staff time to investigate further the application of the 70 percent rule to
the proposal, and, if necessary, schedule the matter back at a later
Planning Commission meeting.
The Planning Commission discussed tree preservation, the possibility of the
area remainm~ R-2 if the 70 percent rule applies, and the possibility of
the houses facing Hollins Avenue.
John Lewis of 20740. Hollins Avenue stated he felt the proposed houses
should face Hollins Avenue rather than 208th Street.
Felix Tillges stated he would like to see-only one home on the lot. He
further stated that the trees on the lot are very old and should be removed
.and new trees planted..
Mr. McClosky stated that M.W. Johnson Construction originally wanted to
have the two proposed homes face Hollins Avenue but did not think it was

possible. He stated that if the 70 percent rule applies and the
neighborhood wants the home facing Hollins Avenue, plans would be redrawn.
Staff suggested a neighborhood meeting be held by the developer with area.
residents when plans are redrawn.
Jim Walston, Assistant City Attorney recommended the public hearing be
continued to allow staff time to research the 70 percent rule.
92.153 Motion was made by Holberg, seconded by Whittingham to continue the public
hearing.
Roll call was taken on the motion. Ayes: Unanimous.
ITEM 6
.David Licht presented an overview of the planning report dated October 28,
1992 regarding the proposed rezoning east of Lake Villa Golf Estates 7th
Addition. He discussed the following:
- Background
- Site characteristics
I-35 visual and noise impact
Environmental considerations
- Marketability
- Access/location
- Compatibility....
- Area considerations
- Rezoning options
Mr. Licht stated he felt the present B-4 zoning of the site in question is
viewed as too. intense and inappropriate. He stated an R-5 designation
would be appropriate for the site. Such zoning would provide a logical
transition between highly diverse uses.
The Commission was generally in favor of zoning that would allow the most
flexibility in design and preserve the environment while at the same time
allowing transitional land uses. They agreed that the R-S zoning wauld be
appropriate. Staff stated they would follow ug with the land owner for a
new rezoning application based on the planning report.
Robert Erickson updated the Commission on ISD 194 projects (i.e. the new
high school, the remodeling of McGuire Jr. High and proposed new elementary.
schoal).
ITEM 7
Allan Hunting of Northwest Associated Consultants handed out a working
draft of the proposed Shoreland Overlay District ordinance amendments and
provided an overview of the amendments. The changes are made necessary by
changes in DNR Shoreland rules. Mr. Hunting briefly identified issues and
stated the next Planning Commission meeting would be devoted to an in-depth
discussion of the proposed changes.
