HomeMy WebLinkAbout12-03-92 Y • CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES DECEMBER 3,1992 The meeting was called to order by Chair Steigerwalt at 7:00 p.m. in the City Hall Council Chambers. Roll call was taken. Present: Holberg, Stei~erwalt, Whittingham, Miller. Absent: Whitehouse (late), O'Donnell,:Smith. Also present: Robert Erickson, City: Administrator; Jim Walston, Assistant City Attorney; Michael Sobota, Community and Economic Development Director, Daryl Morey, Assistant Community and Economic Development Director; Allan Hunting, Northwest Associated Consultants; Jeff Oliver, Assistant Engineer; Mira Holliday, Recording Secretary. The minutes of the November 5,1992 Planning Commission meeting were approved as written. ITEM 4 The public hearing to consider the application of Flagstaff Development, Inc. for the preliminary plat of two single family residential lots to be known as Country Pond South 4th Addition on land located in the southwest corner of Flagstaff Avenue and 173rd Street West was opened. The City Attorney attested that all legal notices had been duly published and mailed. Daryl Morey presented an overview of the proposed preliminary and final plat, outlining the planning report dated November 23,1992. His discussion included the following: - Background - History - Consistency with the approved preliminary plat - Lots blocks - Setbacks - Streets - Grading, drainage and erosion control - Tree preservation - Wetlands - Park and trail. dedication - MUSA Mr. Morey stated that staff recommends approval of the preliminary and final plat of Country Pond South 4th Addition subject to the five stipulations listed in the planning report. Ralph Wagner representing Flagstaff Development was present. He expressed his concern over the requirement of a certain house style andJor garage size for the lots. • PLANNING COMMISSION MEETING MINUTES DECEMBER 3,1992 Page 2 The Commission held a discussion which included: Easement locations. - Placement of housepads to accommodate a deck. - Possibility of a portion of the exception being. deeded to the two lots at the time the exception is final platted. - Dakota County Soil and Water Conservation District recommendation regarding the slope located south of the plat on the exception. - Drainage. Bill Fueling of 6555 173rd Street questioned if the proposed homes would be comparable in size to the existing homes m the area and if the setback from the street would be the same. Mr. Wagner stated that the homes would be comparable, possibly even larger that the existing homes in the area. He further stated that the setbacks would be exactly the same. Whitehouse arrived at 7:25 p.m. .Recommendation number 4 of the planning report was revised to read as follows: Implementation of the recommendations listed in Building Official Dave Krin~s' memo dated October 22,1992 with the exception of the requirement that Lot 2, Block 1 have a two car garage.. The grading plan shall be revised to label a minimum 15 foot wide future house addition for each lat. The houses constructed on the two. lots included in this preliminary and final plat shall be of a style that will allow the implementation of these recommendations. 92.154 Motion was made by Whittingham, seconded by Miller to close the public hearing. Roll call was taken on the motion. Ayes: Holberg, Steigerwalt, Whittingham, Miller. Abstain: Whitehouse. 92.155 Motion was made by Miller, econded by Whittingham to recommend approval of the application of Flagstaff Development, Inc. for the preliminary plat of two single family residential lots to be known as Country Pond South 4th Addition on land located in the southwest corner of Flagstaff Avenue and 173rd Street West subject to the planning report dated November 23,1992 as amended, the memorandum from David Krings dated October 22,1992, the engineering report dated November 12,1992, and the Dakota County Soil and Water Conservation District report dated November 18,1992. • • PLANNING COMMISSION MEETING MINUTES DECEMBER 3,1992 Page 3 Roll call was taken on he motion. Abstain: Whitehouse. 92.156 Motion was made by Holberg, seconded by Miller to recommend approval of the final plat of Country Pond South 4th Addition subject to the planning report dated November 23,1992 as amended, the memorandum from David Krings dated .October 22, .1992, the engineering report dated November 12, 1992, :and the Dakota County Soil and Water Conservation District report dated November 18,1992. Roll call was taken on the motion. Ayes: Holberg, Steigerwalt, Whittingham, Miller. Abstain:. Whitehouse. ITEM 5 The public hearing to consider the application of Lance Johnson for the preliminary plat of two single family residential lots to be known as Daniels 3rd Addition on land located on the east side of Tberia Avenue south of 175th .Street was opened. The City Attorney .attested that all legal notices had been duly published and mailed. Mr. Walston stated that a public hearing notice regarding the rezoning of a portion of the property • had not been published for tonight's meeting. He recommended that staff review the proposed plat but that no formal action be taken until the special Planning Commission meeting on December 10,1992. The public hearing for the rezoning will be held at that special meeting. Daryl Morey presented an overview of the proposed plat, outlining the planning report of November 25,1992. His discussion included the following: - Background - Rezoning of the Zweber property within the proposed plat - Consistency with the Comprehensive Land Use Plan - Zoningg - Lots blocks - Outlots - Setbacks - Streets - Grading, drainage and erosion control - Engineering report dated November 23,1992 and revised report dated November 30,1992 - Dakota County Soil and Water Conservation District recommendations - Environmental Affairs Committee recommendations - Tree preservation - Wetlands - Park and trail dedication - MUSA • Mr. Morey.. stated that staff recommends approval of the preliminary and final plat of Daniels 3rd Addition subject to the five stipulations listed in the planning report with an additional stipulation to read:. i PLANNING COMMISSION MEETING MINUTES DECEMBER 3,1992 Page 4 6. Outlot A shall be deeded to the City. Greg Brick of Probe Engineering was present representing the developer. The Commission .held a brief discussion regarding drainage and custom grading of `lots to preserve more trees. 92.157 Motion was made by Holberg, seconded by Miller to continue the .public hearing until December 10,1992. Roll call was taken on the motion. Ayes: Unanimous. ITEM 6 Allan Hunting presented and overview of the proposed shoreland ordinance. He reviewed the concerns and questions raised by the Environmental Affairs Committee during their review of the draft shoreland Ordinance at their November 17,1992 meeting. His discussion included: - Setbacks Impervious surfaces = Vegetation alteration Variance procedures for substandard lots - Bluff definitions and state guidelines The Commission's discussion included the following: - DNR's review process regarding bluffs and impervious surfaces - Setbacks for property adjacent to Horseshoe Lake - Soils around Horseshoe Lake being conducive to septic system - Variances -Rebuilt homes should be in compliance - 70 percent rule -future discussion - Platted and unplatted bluff areas - Tree preservation - Impervious surfaces in Airlake Industrial Park. The Commission members felt that platted lots that were not buildable should be treated he same as unplatted property in relation to the bluff standards. Item 7 Michael Sobota explained the new State law regarding campaign signs. The City Code does not currently comply with the statutes. The Council will be considering chapges to the Code and wanted input from the Commission. Members of the Commission thought that $2 was. not adequate to offset actual costs of removal. • PLANNING COMMISSION MEETING MINUTES DECEMBER 3,1992 Page 5 ITEM 8 Mr. Sobota stated that a letter had been received from Patty and Steve .Bodine dated November 17,1992. requesting the Planning Commission extend consideration of their variance request. 92.158 Motion was made by Holberg, seconded by Miller to table public hearing regarding the Bodine variance until the January 7,1993 Planning Commission meeting. Roll call was taken on the motion. Ayes: Unanimous. 92.159 Motion was made by Steigerwalt, seconded by Miller for staff to review the 70% rule and make a presentation at a later date. Roll call was taken on the motion. Ayes: Unanimous. Staff updated the Commission on the status of the Winnie home occupation proposal and the M.W. Johnson rezoning and variance issues.
