HomeMy WebLinkAbout07-09-09CITY OF LAKEVILLE Planning Commission Meeting Minutes JULY 9, 2009 The July 9, 2009 Planning Commission meeting was called to order by Chair Davis in the City Hall Council Chambers at 6:00 p.m. Flag pledge and roll call of members: Present: Chair Davis Vice Chair Lillehei Secretary Pattee Commissioner Drotning Commissioner Grenz Commissioner Glad Commissioner Adler Ex- officio Bussler Absent: None. Staff Present: Daryl Morey, Planning Director; Frank Dempsey, Associate Planner; Zach Johnson, Assistant City Engineer; Roger Knutson, City Attorney; and Penny Brevig, Recording Secretary. ITEM 3. APPROVAL OF MEETING MINUTES: The June 18, 2009 Planning Commission meeting minutes were approved as presented. ITEM 4. ANNOUNCEMENTS: Mr. Morey reminded the Commissioners that there will be a work session immediately following tonight's meeting. ITEM 5. CHARLES AND TAMMY FIELD Chair Davis opened the public hearing to consider the application of Charles and Tammy Field for an Interim Use Permit to allow the construction of a special purpose fence on property located in the RS -2, Single Family Residential District, located at 18132 Ironstone Way. The Recording Secretary attested that the legal notice had been duly published in accordance with State Statutes and City Code. Charles and Tammy Field presented an overview of their request. They requested that a letter from Jason and Sally Phillips, residents of the Quail Ridge development, be accepted by the Planning Commission. Chair Davis opened the hearing to the public for comment. John Neumann, 17895 Irons Court Scott Olson, 18114 Ironstone Way Planning Commission Meeting July 9, 2009 Page 2 Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that Planning Department staff recommends approval of the Field Interim Use Permit, subject to the 7 stipulations listed in the July 2, 2009 planning report. Mr. Neumann does not border the Field's property, but he wanted to comment that this looked more like a freeway noise wall rather than a fence. He suggested putting up a shorter fence and planting trees and shrubs along the outside of the fence. This would seem more "green" to him. Mr. Olson lives a few houses away from the Field's property. He was in attendance tonight to see what the proposed fence looked like and learn more about this particular fencing material. 09.35 Motion was made and seconded to close the public hearing at 6:14 p.m. Ayes: Glad, Adler, Lillehei, Davis, Grenz, Drotning. Nays: Pattee. Chair Davis asked for comments from the Planning Commission. Discussion points were: Concern was expressed about the view of the fence from the adjacent properties. The possibility of a two foot lattice section on top of the proposed six foot high fence to break up the mass of the fence from the adjacent single family properties was discussed. The Planning Commission discussed the 5% open for passage Zoning Ordinance requirement for fences. Mr. Morey stated that the 5% open for passage requirement can be achieved by taking 5% of the total area of the fence. The applicants indicated that they are willing to work with staff to discuss design alternatives for their proposed fence. Ms. Field indicated that because of the slope of their yard, they may have fewer options with this type of fencing. Chair Davis asked for a motion to table this agenda item. Ayes: Adler, Lillehei, Davis, Glad, Grenz, Drotning, Pattee. Nays: 0 Planning Commission Meeting July 9, 2009 Page 3 Mr. Morey indicated that if the fence design was revised to address the Planning Commission's concerns and to meet the 5% open for passage requirement, the Field's could then withdrawal their interim use permit application and would only need to apply for a fence permit. Mr. Morey indicated that fencing requirements will be part of the Zoning Ordinance discussion at the next work session. The 5% open for passage requirement could be discussed at that time. 09.36 Motion was made and seconded to table action on the Field Interim Use Permit to a future Planning Commission meeting. Mr. Morey explained that if the fence design is revised such that the interim use permit is no longer necessary, this request would still have to come back to the Planning Commission to acknowledge withdrawal of the interim use permit application. There being no further business, the meeting was adjourned at 6:45 p.m. The Planning Commission proceeded into a work session in the Marion Conference Room.
