Planning Commission Meeting Minutes
AUGUST 6, 2009
The August 6, 2009 Planning Commission meeting was called to order by Chair
Davis in the City Hall Council Chambers at 6:00 p.m.

ITEM 3. APPROVAL OF MEETING MINUTES:
The July 9, 2009 Planning Commission meeting minutes were approved as
presented.
The July 9, 2009 Planning Commission work session notes were approved as
presented.
The July 23, 2009 Planning Commission work session notes were approved as
presented.
ITEM 4. ANNOUNCEMENTS:
There were no handouts or announcements at tonight's meeting.
ITEM 5. CHARLES AND TAMMY FIELD (Tabled from the July 9, 2009 Planning
Commission meeting)
Chair Davis introduced for consideration the request for withdrawal of the
application of Charles and Tammy Field for an Interim Use Permit (IUP) to allow
the construction of a special purpose fence on property located in the RS -2, Single
Family Residential District, located at 18132 Ironstone Way.
09.37 Motion was made and seconded to receive the Charles and Tammy Field request
to withdraw their Interim Use Permit application.
Ayes: Glad, Adler, Lillehei, Davis, Pattee, Grenz, Drotning.
Nays: 0
ITEM 6. ARDEN AND LISA ROEN
Chair Davis opened the public hearing to consider the application of Arden and
Lisa Roen for a Conditional Use Permit to allow the construction of an addition to a
house with an existing non conforming setback within the Shoreland Overlay
District of Lake Marion, located at 10297 199th Street. The Recording Secretary
attested that the legal notice had been duly published in accordance with State
Statutes and City Code.
Lisa Roen presented an overview of their request.
Chair Davis opened the hearing to the public for comment.
There were no comments from the audience.

Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey
stated that Planning Department staff recommends approval of the Roen
Conditional Use Permit, subject to the 4 stipulations listed in the July 31, 2009
planning report.
09.38 Motion was made and seconded to close the public hearing at 6:07 p.m.
Ayes: Adler, Lillehei, Davis, Pattee, Grenz, Drotning, Glad.
Nays: 0
Chair Davis asked for comments from the Planning Commission. Discussion points
were:
Mr. Dempsey confirmed that the house is currently non conforming with
respect to the setback to the south property line adjacent to 199th Street. He
indicated that the proposed addition would meet all setbacks and other
Zoning Ordinance requirements.
09.39 Motion was made and seconded to recommend to City Council approval of the
Arden and Lisa Roen Conditional Use Permit to allow the construction of an
addition to a house with an existing non conforming setback within the Shoreland

Overlay District of Lake Marion, located at 10297 199th Street, subject to the
following stipulations:
1. The addition shall be constructed as shown on the Certificate of Survey
prepared by James R. Hill, Inc., revised July 10, 2009 and the plans
approved by the City Council.
2. Impervious surface area shall not exceed 25
3. The addition shall be constructed with siding and roofing materials to
match the existing house.
4. A building permit shall be issued by the Building Inspections
Department prior to beginning construction.
Ayes: Lillehei, Davis, Pattee, Grenz, Drotning, Glad, Adler.

ITEM 7. CITY OF LAKEVILLE
Chair Davis opened the public hearing to consider the following, on property
located south of 175th Street and west of Jonquil Avenue: A. Comprehensive Plan
amendment to re -guide approximately 5.75 acres from Commercial to Low Density
Residential. B. Zoning Map amendment to rezone the 5.75 acres from C -3 General
Commercial District to RS -2, Single Family Residential District. The Recording
Secretary attested that the legal notice had been duly published in accordance with
State Statutes and City Code.
Associate Planner Allyn Kuennen presented the planning report. Mr. Kuennen
stated that Planning Department staff recommends approval of the Comprehensive
Plan amendment and the rezoning, as presented in the July 31, 2009 planning
report.
Chair Davis opened the hearing to the public for comment.
Joan Sudheimer, Helkenn family member and Trustee, 708 Old Beach Lane, Waconia, MN
Ms. Sudheimer is requesting that the Helkenn property be considered for a high
density residential use as a transition between the commercial development to the
west and the low density residential to the east due to the natural buffers adjacent
to the property. She stated that a senior housing use had considered developing on
their property but the deal fell through for financing reasons. They would like to
market the property for that type of use.

Mr. Turner asked about a ghost plat that he thought was done for this study area
years ago.
09.40 Motion was made and seconded to close the public hearing at 6:21 p.m.
Ayes: Davis, Pattee, Grenz, Drotning, Glad, Adler, Lillehei.

Chair Davis asked for comments from the Planning Commission. Discussion points
were:
Chair Davis asked staff about the ghost plat. Mr. Morey stated that a ghost
plat was included with the Argonne Estates single family preliminary plat,
located north of 175th Street, to show road and utility connections and to
show how the adjacent property could develop. A ghost plat has not been
prepared for the overall Argonne East Study Area.
Regarding the statement about transitional zoning for the Helkenn property,
Mr. Kuennen stated that the low density designation will give the City the
most flexibility. He indicated that the Planning Commission reviewed
conceptually a senior housing proposal for the Helkenn property at one of
their work sessions last year but the project has not moved forward. At their
June 22, 2009 work session, the City Council directed staff to prepare
Comprehensive Plan and Zoning Map amendments to reflect the results of
the Argonne East Special Study.
Commissioner Drotning referred to the concept plan that was attached to
Mr. Gerk's written comments that were included with the July 31, 2009
planning report and indicated that this was just one possible way the
property could be developed. Mr. Kuennen stated that this concept plan
was not submitted as a formal sketch plan application so there was never a
formal staff review of the plan.
Commissioner Drotning reviewed the zoning history of the properties in the
Argonne East Special Study and stated that the previous zoning changes had
all been at the homeowners' request.
Commissioner Glad asked if the Low Density Residential land use
designation would put an undue burden on the marketing of the property to
developers of higher density residential uses. Assistant City Attorney
Poehler stated that marketing of the property is not part of the criteria for
consideration of the Comprehensive Plan and Zoning Map amendments and
as such does not fall under the Planning Commission's purview.
Commissioner Lillehei asked if property owners Faye and Lundquist have
agreed with the proposed rezoning of their property. Mr. Kuennen

indicated that at the open house Ms. Faye agreed with the Low Density
Residential land use designation and Mr. Lundquist said he would get back
to staff but he never did.
