Chris Petree, Operations Maintenance Director Daryl Morey, Planning Director Charlene Friedges, City Clerk Additional agenda information None Nick Thompson, Director, Office of Policy Analysis, Research and Innovation at the Minnesota Department of Transportation, provided an overview and status update of the Twin Cities Urban Partnership Agreement. He explained that I -35W will become The 21St Century Road and highlighted the following components of the UPA program: 35W MnPASS System; Managed Lane System; Kenrick Avenue /I -35W Park -and- Ride; 181st Street /Cedar Avenue Park and -Ride; and six miles of new spot capacity at three key bottleneck locations. A major expansion to the Cedar Avenue /155th Street Park and -Ride will also be completed this year. In addition, transit buses will be equipped with a Driver Assist System- advanced technology that will provide feedback to bus operators. This is used to operate buses on narrow shoulders during darkness or adverse weather conditions. The I -35W MnPASS System opens on September 30th, and new transit service in Lakeville will begin on September 28th. CITY OF LAKEVILLE COUNCIL MEETING MINUTES SEPTEMBER 8, 2009 Page 2 Betty Schneider, representing the John Witherspoon Chapter of the Daughters of the American Revolution, requested the City Council proclaim the week of September 17 -23 Constitution Week in Lakeville. Council Member Rieb read the proclamation. Chris Petree presented the August monthly report of the Operations Maintenance Department. City Engineer Keith Nelson provided an engineering project update. Candice Hojan and Jan Dallenbach requested the City Council proclaim September 13 -19 as Senior Center Week in Lakeville. Council Member Swecker read the proclamation. Tom Barnard, Arts Center Coordinator, presented the Lakeville Area Arts Center 2009 -2010 schedule of activities. Citizens' comments Harley and Diane Horsager, 17141 Jaybell Court, announced that the Lakeville Friends of the Environment, along with Lakeville Parks Recreation, will be hosting Pedal the Parks on Sunday, September 20th, at East Community Park. Consent agenda Council Member Miller asked about the ordinance amendment concerning bike paths (Item 6r) and whether motorized bicycles, foot scooters, etc. will be allowed on bike paths. Chief Vonhof stated the proposed ordinance only allows an exception for City maintenance and emergency vehicles. Other types of motorized vehicles are prohibited. 09.58 Motion was made by Rieb, seconded by Swecker to approve the consent agenda items as follows: a. Claims for payment. b. Minutes of the August 17, 2009 City Council meeting and the August 24, 2009 Council work session. c. Resolution No. 09 -68 calling public hearing to certify unpaid utility charges to the Dakota County Auditor Treasurer. e. Parks, Recreation Natural Resources Committee, August 19, 2009 Planning Commission, August 20, 2009 Economic Development Commission, August 25, 2009 f. Resolution No. 09 -69 appointing Advisory Board for Special Service District No. 1. g. Temporary on -sale liquor license for Lakeville VFW Post 210 to host a public event inside the building and within the outdoor fenced -in area of their property on October 3 -4, 2009. h. Resolution No. 09 -70 accepting donation from Residential Mortgage Group on behalf of Jeffrey and Vicki Morton to the Lakeville Fire Department. Resolution No. 09 -71 accepting donations from various businesses to the Police Department for Night to Unite. Resolution No. 09 -72 approving plans and specifications and setting a bid date for Holyoke Avenue /Highview Avenue reconstruction (Heritage Drive to Dodd Boulevard), Improvement Project 09 -02. k. Set a special Council meeting to be held on September 14, 2009 at 6:00 p.m. to adopt the preliminary budget and tax levy. Set a Council work session to be held on September 21, 2009, beginning at 5:45 p.m. m. Joint Powers Agreement with the City of Burnsville for snow and ice control in the Maple Island area of Burnsville. n. Minnesota Trail Assistance Program Cross Country Ski Traditional Grant Agreement with the Minnesota Department of Natural Resources. p. Minnesota Snowmobile Trails Assistance Program Snowmobile Maintenance and Grooming Grant Agreement with the Minnesota Department of Natural Resources. a. Resolution No. 09 -73 authorizing City of Lakeville to enter into a cooperative agreement with the Minnesota Department of Natural Resources for replacement of the Casperson Park fishing pier. r. Ordinance No. 857 amending Title 7 of the Lakeville City Code concerning bike paths. s. Declarations of Restrictions and Covenants for Site Specific Wetland Replacement. Roll call was taken on the motion. Ayes, unanimous. Item 7 Alcohol Best Practices Program and Presumptive Civil Penalties Sergeant Knutson presented an ordinance amendment regulating the sale of alcohol and establishing presumptive civil penalties for license holders. The proposed ordinance is specifically related to the Best Practices program, which is offered by the City of Lakeville with the intent to eliminate sales of alcohol to youth. It is a voluntary program which offers incentives to the licensees to undertake certain practices believed to be helpful in avoiding sales to minors. Sergeant Knutson explained that the Police Department worked in partnership with the existing liquor license holders to amend the Best Practices program and establish presumed penalties for violations that are equitable and more consistent with standards set by comparable cities in the Twin Cities Metropolitan area. The ordinance establishes one set of penalties for license holders who participate in the Best Practices program and a different set of penalties for license holders not enrolled in the program. He stated the proposed ordinance was mailed to all existing license holders, who were asked to review the proposed changes and provide feedback. No comments were offered by the license holders. CITY OF LAKEVILLE COUNCIL MEETING MINUTES SEPTEMBER 8, 2009 Page 5 09.59 Motion was made by Bellows, seconded by Rieb to adopt Ordinance No. 858 and Summary Ordinance No. 858 regulating the sale of alcohol and establishing presumptive civil penalties for license holders. Roll call was taken on the motion. Ayes, unanimous. Item 8 Spirit of Brandtjen Farm 4th Addition Jacob Fick, Project Manager for Tradition Development, requested Council approval of the Spirit of Brandtjen Farm 4th Addition preliminary and final plat. The preliminary plat includes 68 single family cottage -style lots ranging from 60 to 70 feet in width, and will be developed in phases. The Spirit of Brandtjen Farm 4th Addition final plat consists of 12 single family lots. Planning Director Daryl Morey stated this plat is consistent with the Planned Unit Development for the Spirit of Brandtjen Farm that was approved by the City Council in 2005. Included with the preliminary and final plat is a resolution designating "no parking" on the west side of Discovery Lane, which is consistent with the approved PUD and the narrower street design. Council Member Swecker asked Mr. Fick to explain Tradition Development's marketing strategies for the 60 -foot wide cottage -style lots, which are new to Lakeville. Mr. Fick explained that the target market for these cottage -style lots are the buyers moving out of townhomes to a single family home with all the amenities, which is more realistic for the buyer in terms of financing than the $500,000 homes being marketed in the first two phases of the Spirit of Brandtjen Farm development. He indicated that the homes in this development are priced at $350,000 to $425,000. 09.60 Motion was made by Miller, seconded by Swecker to approve the following: Spirit of Brandtjen Farm 4th Addition preliminary plat and development stage planned unit development of 68 single family lots; CITY OF LAKEVILLE COUNCIL MEETING MINUTES SEPTEMBER 8, 2009 Page 6 Resolution No. 09 -74 approving the final plat of Spirit of Brandtjen Farm 4th Addition; Resolution No. 09 -75 designating a "no parking" zone on the west side of Discovery Lane.
