HomeMy WebLinkAbout0706 706 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING .TITLE 9, CHAPTER 3 OF THE LAKEVILLE CITY CODE CONCERNING THE LAKEVILLE SIGN ORDINANCE THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS: SECTION 1. Section 9-3-3 of the Lakeville City Code shall be amended to include the foNowing definition: Building Sign A sign that identifies a multiple occupancy principal building upon the parcel where such sign is located. SECTION 2. The definition of "Area Identification Sign" in Section 9-3-3 of the Lakeville City Code-shall be amended to read as follows: Area Identification Sign A free standing sign identifying the name. of a single- or two-family subdivision consisting of twenty (20) or more lots; a residential planned unit development; a multiple -residential development consisting of three (3) or more structures; a business or industrial development consisting of three (3) or more separate. principal buildings; a manufactured home court; or any integrated combination of the above. The sign shall only identify an area, or development and shall not, contain the name of individual tenants. The. sign may not contain advertising. SECTION 3. Section 9-3-7.C.2 of the Lakeville City Code is amended to read: 2. Single of Double Occupancy Business Sign: The total sign area may not exceed ten percent (10%) of the total front building facade except that the .area of up to two (2) facades facing a public street. may. be counted for a lot where the side and/or rear yards abut a public right-of-way. Signs chosen to comprise the total sign area shall be consistent with the following provisions: a. Freestanding: Not. more than one. freestanding sign. Sign. area may not exceed fifty (50) square feet with a maximum height of twenty feet. (20'). b. Wall, Canopy, or Marquee: Not more than one wall, canopy, or marquee. sign per building per street frontage. Wall, Canopy,. or Marquee: Not more than one wall, canopy, or marquee sign per building per street frontage. All wall, canopy, or marquee signs shall be located on a building facade facing a public street. The maximum number of wall, canopy, or marquee. signs allowed per building is two (2) signs. lndividual sign area may not exceed sixty four (64) square feet. SECTION 5. Section 9-3-7.E.2 of the .Lakeville City Code is amended to read: 2. Single of Double Occupancy Business Sign: The total sign area may not exceed fifteen percent (15%) of the total front building facade except that the area of up to two (2) facades facing a public street may be counted for a lot where the side and/or rear yards abut a public right-of-way. Signs chosen to comprise the total sign area shall be consistent with the following provisions: a. Freestanding: Not more than. one freestanding sign. Sign area may not :exceed one hundred (100) square feet with a maximum height of twenty feet (20'). b. Wall, Canopy, or Marquee: Not more than one wall, canopy, or marquee sign per building per street frontage. All wall, canopy, or marquee signs shall be located on a building facade facing a public street.: The maximum number of wall, canopy, or marquee signs. allowed per building is two (2) signs. Individual sign area may not exceed one hundred (100) . square feet. Additional wall signs may be approved by the City Council in the C-CBD District if a freestanding sign is not used. SECTION 6. Section 9-3-7.F.2 of the Lakeville City Code is amended to read: 2. Single of Double Occupancy Business Sign: The total sign area may not exceed fifteen percent (15%) of the total front building facade except that the area of up to two (2) facades facing a public street may be counted for a lot where the side and/or rear yards abut a public right-of-way. Signs chosen to comprise the total sign area shall be consistent with the following provisions: 2 a. Freestanding: Not more than one freestanding sign. Sign area may not exceed one hundred (100) square feet with a maximum height of ten feet (10'). b. Wall, Canopy, or Marquee: Not. more than. one wall, canopy, or marquee sign per building. per street frontage.... All wall, canopy, or marquee signs shall be located on a .building fagade facing a public street. The maximum number of wall, canopy, or marquee signs allowed per building is two. (2) signs. Individual sign area may not exceed one hundred (100) :.square feet. SECTION 7. Section 9-3-7.F.3.a of the Lakeville City Code is amended to read: a. Wall, Canopy, or Marquee: Not more than one wall, canopy, or marquee sign per building per street frontage. All wall, canopy, or marquee signs shall be located on a building facade facing a public street. The maximum number of wall, canopy, or marquee signs allowed per building is two (2) signs. The. total sign area shall not exceed three hundred (300) square feet. SECTION 8. Section 9-3-7.G.2 of the Lakeville City Code is amended to read: 2. Single of Double Occupancy Business Sign: The total sign area may not exceed fifteen percent (15%) of the total front building facade except that the area of up to two (2) facades facing a public street may be counted for a lot where. the side and/or rear yards. abut a public right-of-way. Signs chosen to comprise the total sign area shall be consistent with the following provisions: a. Freestanding; Not more. than .one freestanding sign. Sign area may not exceed one hundred fifty (150) square feet with. a maximum height of thirty feet (30'). b. Wall, Canopy, or Marquee: Not more than one wall, canopy, or marquee signper building .per street frontage. All wall, canopy, or marquee signs shall be located on a building fagade facing a .public street. The maximum number of wall, canopy, or marquee signs allowed per building is two (2) signs. Individual sign area .may not exceed one hundred fifty (150) square feet. SECTION 9. Section 9-3-7.G.3.a of the Lakeville City Code is amended to read: a. Wall, Canopy, or Marquee: Not more than one wall, canopy, or marquee sign per building per street frontage...All .wall, canopy, or marquee signs shall be ..located on a building fagade facing a public street. The maximum .number of .wall, canopy, or marquee signs allowed per building is two (2) signs. The total sign area shall not exceed six hundred (600) square feet. SECTION 10. Section 9-3-8.C of the Lakeville City Code is amended to read as follows: 3 C. Multiple Occupancy Commercial. and .Industrial Buildings: When a single principal building is devoted to three (3) or more businesses or industrial uses, a comprehensive sign plan shall be required subject to review by .the Planning Commission and the approval of the City Council based upon the following requirements: 1. A comprehensive sign plan is .submitted which includes all of the following. information: a. A site plan to scale showing the location of lot lines, buildings, structures, parking .areas,. existing and .proposed signs, and any other physical features of the area included within the comprehensive sign plan. b. Elevations to scale of buildings included within the comprehensive sign plan including the location of existing or proposed wall, canopy or marquee signs. c. To scale plans for all existing- and proposed signs of any type included within the comprehensive sign plan indicating area, dimensions, height, materials, colors, and means of illumination (if any).. 2. The maximum individual sign sizes for multiple occupancy buildings and individual businesses that: may display a sign shall not exceed the maximum provisions for single or double occupancy structures in the same zoning district in Section 9-3-7 of this Chapter. The bonus provided in Section 9-3-8.B of this .Chapter shall not apply in calculating maximum sign size. 3. Commercial retail or mixed use multiple occupancy buildings may display a freestanding building. or business sign consistent with the applicable zoning district provisions in Section 9-3-7 of this Chapter. A single freestanding business sign may identify one (1) tenant. 4. Multiple occupancy office buildings may display a freestanding building or business sign consistent with the applicable zoning district provisions in Section 9-3-7 of this .Chapter. A single freestanding business sign .may identify multiple office tenants. 5. Except as provided for in this subsection C, individual tenants of a multiple. occupancy building shall not display separate business wall, canopy, or .marquee signs unless the tenant's business has an exclusive exterior entrance. The number of individual business wall, canopy, or marquee signs shall be limited to one per entrance, and each sign shall be limited to the maximum wall sign size permitted in the district. The individual business signs shall be located only on exterior walls of the tenant space being identified. 6. In .any. multiple` occupancy building qualifying as a shopping center, directory. signs shall be permitted for each common public entrance. Each directory sign area shall not exceed a total of fifty (50) square feet and shall be located within fifty feet (50') of the common public entrance being served. The size of individual business identification signing within the directory shall be established during the situ. plan review process. Attention shall be .given to the. possible number of 4 ..tenants or occupant bays that may be served by the common public entrance for which the directory sign is intended. 7. No permit shall be issued for a new or replacement business sign for an individual use except upon a determination by the Zoning Administrator thatit is consistent with the approved comprehensive sign plan. SECTION 11. Section 9-3-8 shall be amended to include a new subsection J to read as follows: J. Co-location of Freestanding Business Signs. Separate commercial and industrial uses on adjoining properties with a common lot line may. each locate a business sign on one (1) freestanding structure subject to approval by the Zoning Administrator, provided that: 1. The area of each of the individual business signs shall be .consistent .with. the applicable district provisions in Section 9-3-7 of this Chapter. 2. The height of the freestanding sign shall be consistent with the applicable district provisions in Section 9-3-7 of this Chapter. 3. The .maximum number of business signs displayed on a single structure is two (2) signs. 4. No additional freestanding signs shall be displayed on the individual properties. 5. An agreement addressing .construction, maintenance, and repair responsibilities and trespass rights is established .subject to .approval by the City Attorney and filed .with the Dakota County Recorder against the titles. of the two properties involved in the co-located freestanding sign. Amendment or cancellation of the agreement shall be allowed only upon written approval by the .Zoning Administrator. SECTION 12. This ordinance shall be effective immediately upon its passage and publication... Adopted by the Lakeville City Council this 4'h-day of March 2002.
