Definitions. The definition in Minn. Stat. §.462.352, Subd.12 is adopted by reference. 99993.02 1 RNK:r04/10/2002 SECTION 2. Purpose and Intent. The Designated Area is east of the I-35/CSAH 50 interchange. It is the intent of this ordinance to allow the City time to undertake the necessary studies to officially map road alignments in the Designated Area, make other appropriate changes in official controls resulting from the mapped road alignments, and in the interim to protect the planning process and the health, safety, and. welfare of the citizens of the community. SECTION 3. Factual. Background. • The City Council authorized the I-35/CSAH 50 interchange area traffic. study in 1996. SRF Consulting Groupwas commissionedto do the study. • Following receipt of the interchange study numerous public meetings were :held in 1997 and 1998 to solicit input on the study. In 1999 the City Council adopted the interchange study selecting Alternate E-3 identified in the study. • The City .needs to officially map roads in the designated area to ensure that necessary roadways can be constructed in the future. • ..The City will need to secure the approval of Dakota County, the Minnesota Department of Transportation, and the Federal Highway Administration. for roadway alignments and geometries. • The City is currently undertaking an interchange financing study to identify funding sources for interchanges. • ` In 2001, the City. prepared and submitted a TEA-21 funding .application for .improvements at the I-35/CSAH 50 interchange for fiscal year 2005. The project was ranked 14 out of 22 applications by .the Transportation Advisory Board and .the Metropolitan Council in the A minor arterial expander category based upon prioritizing criteria, and based upon available funding, only the top five were funded. • Dakota County. has subsequently updated their 2002-2006 CIP, which does not identify funding for the I-35/CSAH 50 interchange. • The Cit~ has appropriated the proceeds from Tax Increment. Financing District #19 for the 176 Street/CSAH 50 signal light in 2006. • In the Legislative Study of State Funding for Local Road Improvements prepared by MNDOT in 2002, Dakota County is identified as having. the largest financial shortfall ($24 million) for transportation. improvements of any other county in .the State of Minnesota. • The 2002-2004 Strategic Plan for Economic Development, has established the CSAH 50, 60 and 70 interchanges as a priority issue. 99993.02 2 RNK:r04/10/2002 • The City's Comprehensive Land Use Plan states that the 1998 I-35/CSAH 50 Traffic Study shall be implemented to relieve traffic congestion and safety issues at the I- 35/CSAH 50 interchange. SECTION 4. Temporary Prohibition. Pending the completion of the above referenced study and adoption of official maps and other appropriate official controls, no application will be .accepted, processed or approved for the following: • Change in ofpicial controls • Plats • Subdivision of Land • The issuance of conditional use permits, interim use permits,. variances, and .site plan approval. • The issuance of building permits for new buildings or structures or to expand the foot print of an existing building or structure. • The issuance of permits for new or relocated free standing signs not attached to a building. .SECTION 5. Exception. The temporary prohibition set forth in Section 4 of this ordinance shall not halt, delay, or impede a subdivision which has been given preliminary approval prior to the effective date of this ordinance or for which sketch plan, preliminary .plat, conditional use permit, interim use permit, and variance applications have been completed and filed with the City prior to April 11, 2002. SECTION 6. Effective Date. This ordinance shall take effect from and after its passage and shall remain in effect until the date of the adoption of the official maps and. other official controls contemplated hereunder or April 14, 2003, whichever occurs first.
