RESOLUTION NO. oh-i 1
RESOLUTION ESTABLISHING POLICY fOR
CONNECTION CHARGES AND OTHER FEES CHARGED TO DEVELOPMENTS
WHEREAS, it is necessary for the City of Lakeville to establish policies setting rates for
connection. charges and other fees charged to developments;
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
Lateral Sanitary Sewer & Watermain Access Charges
1. The City will impose an access charge comparable to lateral watermain or sanitary
sewer assessment for properties wishing to connect to watermain and/or sanitary
sewer service -and in certain areas where sanitary sewer and watermain were
installed without assessments to benefiting property owners.
2. Due to watermain oversizing in commercial and industrial areas for fire protection
purposes, the access charge to 12 inch and larger watermain for non-residential
properties will be set at a higher rate.
3. If no services exist, it will be the property owner's responsibility for construction of
the service from the main to the property line in accordance with City standards.
4. For large parcels which could be subdivided in the. future, there will be a maximum
access charge for 100 feet of frontage, with the remaining frontage charged at the
time of future subdivision.
5. The access charges for lateral watermain or sanitary sewer will be adjusted annually
to reflect current construction costs as reported by the Engineering News Record or
other factors deemed appropriate by the City. of Lakeville.
6. Adjustments to the access charges for lateral watermain or sanitary sewer will be
effective January 1 of each year, unless revised in subsequent resolutions.
Storm Sewer Area Charges
1. Revenue from storm area charges are used to finance construction of a trunk
storm water management system.
2. The storm sewer area charge shall be paid in cash or may. be specially assessed on
the following projects for a period not to exceedten (10) years at an interest rate
approved by the City Council:
A. New Plats and Administrative Subdivisions, On property not previously assessed.
6. Developing multiple (except duplexes), commercial, industrial and institution.
parcels of land that have not been previously assessed the storm sewer area
charge through platting.
C. Storm Sewer Improvement. Properties already .assessed the full storm sewer
area charge shall not be reassessed for offsite improvements.
3. Credits will be given for trunk .storm sewer oversizing, regional. ponding and wetland
dedication to the City within the plat or subdivision, consistent with Ordinance 7-7-2.
4. Storm sewer area charges for trunk storm drainage improvements will be adjusted
annually, consistent with the Comprehensive Stormwater Management Plan,
adopted by the City Council on October 16,.1995, to reflect current construction
costs as reported by .the Engineering News Record or other factors as deemed
appropriate by the City of Lakeville.
5. Adjustments to the storm sewer area charge will be effective January 1 of each
year, unless revised in subsequent resolutions.
Sanitary Sewer Unit Charges
1. Revenue from the sanitary sewer unit charge is appropriated to the financing and
construction of the sanitary sewer trunk system.
2. The sanitary sewer unit charge and the sanitary sewer area charge will be adjusted
annually, consistent withthe Comprehensive Sanitary Sewer Policy Plan, adopted by
the City Council on June 7, 2004, to reflect current construction costs as reported by
the Engineering News Record or other factors as deemed appropriate by the City of
Lakeville..
3. Adjustments to the rates will be effective February 1 of each year to allow Building
Inspections to notify builders of the new rates so they can incorporate them into
their building costs, unless revised in subsequent resolutions.
Watermain Unit Connection Charges
1. Revenue from the watermain unit connection charge is appropriated to the financing
and construction of the trunk water system.
2. The watermain unit connection charge will be reviewed annually and adjusted,
consistent with the Comprehensive Water Plan, adopted by the City Council on
October 4, 2004,. to reflect current construction costs as reported by the Engineering
News Record or other factors as deemed appropriate by the City of Lakeville.
3. Adjustments to the rates will be effective February 1 of each year to allow Building
Inspections to notify builders of the new rates so they can incorporate them into
their building costs, unless revised in subsequent resolutions.

Street Assessment Policy for Collector and Arterial Roadways
Properties which abut directly upon collector and arterial roadway improvements shall be
assessed a frontage benefit rate dependent upon the type of improvement being installed,
as follows:
A. Residential properties which abut upon an urban street section may be assessed
at a set rate per front foot for street and storm sewer lateral benefits.
Residential properties which abut a rural street section may be assessed at a set
rate per front foot for street and lateral drainage benefits. Expense for acquiring
public right-of-way and easements may be assessed on a front foot basis in
.addition to standard rates for street and lateral drainage benefits.
B. Platted* residential properties which abut collector and arterial roadways and
front upon another platted street shall be assessed for only one half of the actual
frontage on the collector and arterial roadway and for the full frontage on the
interior platted street.
C. Properties which are zoned for commercial or industrial development shall be
assessed at a rate of 1.5 times the frontage rates set for residential properties
described in paragraph A for the frontage which abuts a collector and arterial
roadway. Properties zoned for commercial or industrial uses, but which have an
existing residential use, shall be assessed under the residential policies.
D. Platted residential properties without utility service shall be adjusted to be
comparable to normally platted residential lots. The actual frontage footage shall
be reduced by 50% to adjust the front footage to a maximum of 175 feet or a
minimum of 100 feet. These properties shall be assessed on the basis of this
adjusted front footage and the rates established pursuant to paragraph A.
E. Properties which abut directly upon a collector and arterial roadway improvement
shall receive driveway access in accordance to City. Ordinance No. 6.10 relating to
the regulation of driveway access spacing. Driveway location design and spacing
shall be subject to approval by the City. Access will be provided within the rates
established pursuant to paragraph A without additional cost to the property.
* A platted lot is defined as,a City-approved single family residential lot less than
one acre in area.
