X19 .CITY OF LAKEVILLE DAKOTA, COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLE 3 OF THE LAKEVILLE CITY CODE CONCERNING ON-SALE LIQUOR LICENSES THE CITY COUNCIL OF THE CITY OF tAKEVILLE, MINNESOTA ORDAfNS: SECTION 1. Section 3-1-4A(1) of the Lakeville City Code is amended to pr©vide: A. "On-Sale Liquor License": On-Sale. intoxicating liquor license shalt be granted only to restaurants. 1. lnittal lnvestrnent Required: No on-sale License. sha l be granted to any person who does not have invested or does not propose to invest in the business, including, but not limited to, all fees, site development, construction costs, utilities, furnishings and fixtures; but... exclusive of land costs, an amount of at least eight hundred twenty-five thousand dollars ($825,000.00)- biased upon 2002 construction costs. The required amount shall be annually adjusted upward or downward by Council -resolution to reflect changes in construction costs as reflected in commonly accepted construction cost Indexes. In the case of multi-purpose building such as motels, hotels, bowling alleys and the like, only that portion of the building directly attributable to the preparation, handling, storing or serving.. of food and liquor shall be considered in determining the value of the inves#ment. The Council may provide for an independent appraisal, at applicant's expense, as an aid in determining the .value of said premises. fn the event this requirement as to investment is not complied with within one. year from the date of issuance of the license, the..license may be revoked.' SECTION 2. Section 3-1=4B of fhe Lakeville City Code is repealed.- SECTION 3. Section 3-1-4D of the Lakeville City Code is amended to read: D. "On-Sale .Sunday .Liquor Sale License": On-sale Sunday liquor .sale licenses. may be issued to establishments holding an on-sale liquor license 101241.05 1 RNK:r08/27/2002 hereunder. Such license shall permit the sale of liquor to be consumed on the premises between the hours of ten o'clock (10:00) R.M. on Sunday and one o'clock (1:00) A.M. on Monday in conjunction with the serving of food. A separate application for such. license shah be made to the City in the. same manner as applications for- other licenses to sell intoxicating liquor are made hereunder. SECTION 4. Section 3=1-4A(2) of the Lakeville City Code is amended to read: 2. RenewaL• The minimum investment fore the renewal of licenses issued prior to the effective date of this provision .shall be the investment. required when a license was first .issued for the location, plus any subsequent investment voluntarily made. If a location ceases to be licensed for one year tlis provision shall not apply and the current investment requirement shall apply. SECTION 5. Section 3-1-4-1 of the Lakeville City Code is amended in its entirety to provide; 3-1-4-1: NUMBER ~F ON-SALE LICENSES: A. Eighteen (18) on-sale intoxicating liquor licenses may be issued. SECTION 6. Section 3-1-5-1J of the Lakeville City Code is amended to read: J. A detailed narrative description of the proposed business for which the license is sought including, .but not limited to: type of clientele, type of entertainment including but not limited to outdoor entertainment, dancing,. live .music, and amplified music. (if any), type of food menu (if any), fixtures. SECTION Section 3-1-8-13B of the Lakeville City Code is amended to read: B. Prohibited: Dancing and outdoor entertainment are .prohibited on premises that have an on-sale, "special club intoxicating liquor", "on-sale wine", or "on-sale 3.2 percent matt liquor" license unless such license specifically authorizes dancing or .outdoor entertainment. If the Council allows dancing or outdoor entertainment on a licensed premises it may impose conditions to ensure the quietude, safety, and welfare of the premises surrounding neighborhood and community. SECTION 8.
