PLANNING CQMMI$SION MEETING MINUTES
FEBRUARY 7, 1991
.The meeting. was. called to order by Vice Chair Whitehouse. at 7:00
p.m. in .the City Ha]1 Council Chambers.
Roll call of members was .taken. Present: Miller, Holberg,
Whitehouse, Whittingham. Absent: Steigerwalt.
.The minutes of the January 3, 1991 Planning Commission meeting
were approved as written.
The public hearing to consider the application of Ralph Trabant
for the preliminary plat of 11 single family residential lots to
be known as Trabant Addition and for a minor comprehensive plan
amendment to bring the property into the Year 2000 Urban Service
.Area on land located at 175th Street and Judicial Road was
continued from the January 3,1991 meeting.
.Daryl Morey presented an overview of the preliminary plat,
stating the Commission had asked: 1) the applicant's engineer to
investigate the impact of reconfiguring Lots 1 and 2 to front the
.proposed cul-de-sac street instead of Judicial Road (to include a
review of the number of trees to be removed given. the lot
reconfiguration), and. 2) the City to review the value of Lots 7
and 8, Block 2 if Lot 9, Block 2 is eliminated.
Mr. Morey stated that staff had met with `Mr. Tauer, the
applicant's engineer,. to .discuss the lot reconfiguration and
other issues related to the plat. Mr. Tauer had presented a
sketch plan showing how Lots 1 and 2, Block 2 would lay out,
given the reconfiguration. Mr. Tauer had indicated that the lot
reconfiguration would result in the loss of 13 trees and that a
pyramid shaped piece of high ground would be left when the two
building pads are graded. Driveway access for Lot 2, Block 1 and
Lots 2,' 8 .and 9, Block 2 and right-of-way for Judicial Road was
also discussed, Mr. Morey also discussed the asking prices for
Lots 7, 8 and 9, Block 2.
Mr. Morey recommended approval of the Trabant Addition
preliminary plat subject to the recommendations listed in the
planning report dated' February 1, 1991..
Miller questioned whether the recommendations listed in the
December 28, 1991 Hennipen Parks letter were being considered by
.the applicant. Wayne Tauer responded. Mr. Tauer also discussed
recommendations five through ten of the February 1, 1991. planning

- Reconfiguration of Lot 9, Block 2.
- Curve line in Judicial Road between Lots 8 and 9, Block 2
and Lots. 1 and 2, Block 1.
Mr. Ace Raymond of Coldwell Banker distributed and reviewed a
price comparison of lots in various subdivisions of Lakeville.
91.12 Motion was made by Mi]1er, seconded by Holberg to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
91.13 Motion. was made by ,Miller, seconded by Whittingham to recommend
,.approval of the application of Ralph Trabant for the preliminary
plat of 11 single family .residential lots to be known as Trabant
Addition and for a minor comprehensive plan amendment to include
the property_in the Year 2000 Urban. Service Area subject to the
...planning reports of November 29 and December 27, 1990 and
February 1, 1991.
Roll call was taken on the motion.. Ayes: Miller, Whittingham.
Nays: Holberg, Whitehouse.
The reason Holberg voted nay was she felt there are too many lots
for .the topography of the area.
The reason. Whitehouse voted nay was he felt the value of the
property. is greater than what the developer believes and that the
elimination of ..Lot 9, Block 2 would generate the same amount of
revenue as it would if it remained..
The public hearing to consider the application of Independent
School District 194. for a conditional use permit to .allow .the
construction of an elementary school and a minor comprehensive
plan amendment to bring. the property into the Year 2000 Urban
.Service Area on land located on the west side of Highview Avenue
north of Dodd Boulevard was opened. The City Attorney attested
that all legal notices had been duly published .and mailed.
David Licht presented a review of the application and planning
reports of February. 1, and February 7, 1991. He stated the
elementary school would be an approximately 74,500 square foot
facility. He .went on to review the following:

Mr. Licht recommended approval of the conditional use permit
subject to the the 18 conditions l:i.sted in the draft conditional
use permit. form..
.Dan Mehleis of Independent School District 194 was present and
stated the proposed Highview Elementary School-will. replicate the
Lake Marion Elementary School except for the color.
The Commission held a discussion which included:

- Landscaping..
- On-site circulation
- Turn .lanes on 175th Street

- Landscaping
- Screening
- Signage
- Trash enclosure
91.14 Motion was made by Whittingham, seconded by Holberg to close the
public hearing.
Roll call was taken on the .motion. Ayesr Unanimous.
91.15 Motion was made by Whittingham, seconded by Miller to .recommend
approval of the application of Independent .School District 194
. for a conditional use permit to allow the construction. of an
elementary school and a minor comprehensive plan amendment to

bring the. property into the Year 2000 .Urban Service Area. on land
.located on' the west side of Hi.ghview Avenue north of Dodd
Boulevard subject the recommendations listed in the planning
reports of February 1 and February 7, 1991, the amended
conditional use permit, and the findings of fact.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application. of Independent
School District 194 for a conditional use permit to allow a
portable classroom expansion at McGuire Junior High School was
opened. The City Attorney attested that all legal notices had
been duly published. and mailed.
Daryl. Morey presented an overview of his planning report dated
February'1, 1991. He stated that Independent School District 194
feels the temporary classrooms are necessary to meet the interim
needs of the expanding student. population. He reviewed the
following:
- Appearance, color and compatibility
Length of use
Location
- Parking spaces
- Sidewalk access
Mr. Morey "recommended approval of the conditional use ..permit
subject. to the recommendations listed in the planning. report of
February 1, 1991 with the elimination of recommendation number
five since the parking supply' exceeds ordinance requirements..
The Commission held a brief discussion.. There was no public
comment.
91.16 Motion was made by Miller, seconded by Whitehouse to close the
public hearing.
Roll call was taken on the motion. .Ayes: Unanimous.
91.17 Motion was made by Miller, seconded. by Whittingham to recommend
approval of the application of Independent School District. 194
for a conditional use permit to allow a portable classroom
expansion at `McGuire Junior High School subject to the amended
recommendations i.n the planning report of February 1, 1991, the
draft conditional use permit, and the findings of fact.
Roll call was taken on the motion. Ayes: Unanimous.

building on a corner lot) to .allow modification of the .approved
site plan on land located at 8287 - 214th Street West was
;opened. The City Attorney attested that all legal notices had
been duly published and mailed.
Daryl Morey presented a review of '.the proposed amendment and
planning report of February 4, 1991. He gave a brief review of
' the background of conditional use .permit #90-12, which allowed
.International Chemtex to expand their existing business. Chemtex
was also granted a variance from the parking lot setback
requirement and a Zoning Ordinance amendment to allow a parking
deferment. He went on to discuss the deviations to the site plan
and staff's comments related thereto.
Mr. Gary Glenna of International Chemtex .was present and gave an
explanation of the deviations from the site plan. He stated he
felt the deviations from the original plan are actually safer and
more functional than the original, approved plans.
The Commission discussed the following:
Pallets stored on the site
Dumpster stored outside the building
- .Trailer stored on the site
- Green space
Bob Erickson, City Administrator, discussed one by one the
deviations listed in the planning. report and Mr. Glenna responded
to each.. Mr. Glenna agreed to recommendation number one; number
two was unresolved; he agreed to recommendation number three; and
he agreed to number four subject to the resolution of number
two. Mr. Erickson recommended that staff work with the applicant
on resolving the remaining issue and bring it back to the
Planning Commission with a revised site plan at a future date..
91.18 Motion was made by Whittngham, seconded by Miller to continue
the public hearing to consider the .application of International
Chemtex .Corporation for an amendment to Conditional Use Permit
#90-12 (construction of a loading berth located at the. side of a
building on a corner lot) to allow modification of the approved
site plan on land located at .8287 - 214th Street West.'
Roll call .was taken. on he motion. Ayes: Unanimous.
The public .hearing to consider the application of Dick and Ann
Miller for. the vacation of an alley on land located between
• Holyoke and Holt Avenues, and Upper.. 209th and 210th Streets was
opened. The City Attorney attested that all legal notices had
been duly published and mailed.

Daryl Morey reviewed .the proposed vacation, outlining the
planning report of February 1, 1991. He recommended. approval. A
brief discussion was held by the Commission. There was no public
comment.
91.19 Motion was made by Miller, seconded by Holberg to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
91.20 Motion was made by Miller, seconded by Holberg to recommend
approval of the. application of Dick and Ann Miller for the
vacation of analley on land located between Holyoke .and Holt
Avenues,..and Upper 209th and 210th .Streets subject to the
planning .report of February 1, 1991.
Roll call was taken on the motion. Ayes: Unanimous.
Under unfinished business, Bob Erickson discussed the airport
expansion.
There was no new business.
91.21 Motion was .made by Holberg, seconded by Whittingham to adjourn
the meeting.
Voice vote was taken on the motion. Ayes: Unanimous.
