HomeMy WebLinkAbout03-21-91 ea E, CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES MARCH 21, 1991 The meeting was called to order by Chair Steigerwalt at 7:00 p.m. in the City Hall. Council Chambers. Roll call of members was taken. Present: O'Donnell, Holberg, Steigerwalt, Whittingham, Smith and Miller. Absent: Whitehouse. Also present was Robert Erickson, City Administrator; Roger Knutson, City Attorney; Michael Sobota, Community and Economic Development Director; Jeff Oliver, Assistant City Eng~'neer; Daryl Morey, Assistant Community and Economic Development Director; Jim Robinette, Director of Public Works and Environmental Resources; and Mira Holliday, Recording Secretary. The minutes of the March 7, 1991 meeting were approved as written. Newly appointed Planning Commission member Michael O'Donnell was introduced and welcomed. The public hearing to consider the application of Meritor Development Corporation for the preliminary plat and planned unit development of 61 single family residential lots to be known as Chapel Hills 3rd Addition was opened. The City Attorney attested that all legal notices had been duly .published and mailed. Daryl Morey presented a review of the planning report dated. March 15, .1991.. He gave an overview of the background of the plat stating the original Chapel Hills subdivision had been approved in 1987. He went on to state that as a part of Meritor's original preliminary plat, they had also applied for a rezoning of a portion of the subdivision from R-2 to R-3. The preliminary plat was approved by the City Council but the rezoning was never acted upon because the lots in the first two additions met R-21ot width and lot area requirements. Mr. Morey explained that last fall, Meritor appplied again for the rezoning of Chapel Hills 3rd Addition from R-2 to R-3. Their request was met with substantial. opposition from neighboring residents and the application for rezoning was withdrawn by Meritor. Planning Commission members, at the time of the withdrawal, suggested that the applicant consider the elimination of one of the smaller sized lots m the northern portion of the 3rd Addition to bring the remaining. lots more into conformance with R-2 requirements. Mr. Morey discussed the consistency of the 3rd Addition with the original preliminary plat, stating it is consistent with the exception that the 3rd Addition ~reliminar~ plat shows eight fewer lots than shown on the original Chapel Hills preliminary plat. The developer eliminated eight lots from ti Planniing Commission Minutes MARCH 21, 1991 Page 2 the phase of development in an attempt to bring more lots in the 3rd .Addition into conformance with R-2 requirements. However, twelve lots in the 3rd Addition still do not meet R-2 requirements for lot width. These 12 lots do meet R-2 requirements for lot area. As such, the applicant is seeking PUD appproval for these lots since they meet R-2 requirements for. lot area but not lat width. Mr. Morey stated that staff recommends the elimination of one lot in Lots 14 through 23, Block 1. This would reduce the number of lots in that area of the subdivision that would be short of R-2 lot width requirements to .only one or two. He stated that staff recommends approval of the Chapel Hills 3rd Addition preliminary plat subject to the four conditions listed in the planning report of March 15, 1991. Larry Vossen of Meritor Development Corporation stated that the grading for Chapel Hills 3rd Addition had been completed over two years ago and that it would be an expensive process to eliminate another lot. Warren Kochis, .16404 Griffon Trail in the adjacent Foxborough 2nd Addition subdivision, questioned drainage in the area. Paul Thomas of Pioneer Engineermg responded. He stated that since Meritor also developed the . Foxborough subdivision, they would be willing to work with residents and City staff to ensure any. drainage problems are solved.. There was no other public comment. Miller questioned Mr. Thomas about the 20 foot utility and drainage easement required between Lots 14 and 15 and Lots 24 and 25, Block 2 for storm sewer construction. Mr. Thomas responded. Smith stated he felt two lots should be eliminated to bring. all lots in Block 1 into conformance with R-2 requirements. Holberg was. in agreement. Whittingham expressed concern over drainage problems in the area. Robert Erickson discussed the background of the area and stated he felt grading could be done on a lot by lot basis as referenced in the City Engineer's report, rather than mass grading. Steigerwalt questioned the existing sediment basin at the south end of Grinnel Avenue. Staff responded. 91.26 Motion was made by Holberg,. seconded by Miller to close the public hearing. Roll call was taken on the motion. Roll call was taken on the motion. Ayes: O'Donnell, Holberg, Steigerwalt, Whittingham, Miller. Nays: Smith. The reason for Smith's nay was he felt two lots instead of one should be eliminated in order to bring all lots in Block 1 into conformance with R-2 requirements and to be consistent with the other lots in the Chapel Hills subdivision. The public hearing to consider the application of Schmitty and Sons, Inc. for a rezoning from R-6, Medium Density Residential District, to PUD, Planned Unit Development, located at 21160 Holyoke Avenue was opened. The • City Attorney attested that all legal notices had been duly published and mailed. Daryl Moreyresented a review of the planning, report dated March 15, 1991. He reviewed the background of the property stating the Schmitty and S_Bonh property is located on three separate lots north of McGuire Junior g School and is currently being used as a school bus garage operation. He further stated that in 1984, the City Council approved an R-6 to PUD rezoning and lot combination on two of the three lots owned by Schmitty and Sons in order to accommodate a building expansion for the school bus garage. One lot was held out from the PUD rezoning and lot combination by the applicant for mortgage purposes and the other two lots were never combined. In order to accommodate the connection of sanitary sewer to the Schmitty and Sons property and bring the property under a unified zoning and lot configguuration, the applicant is now requesting PUD rezoning approval of the lot they own that is not already zoned PUD and approval of the combination of all three Schmitty and Sons lots into one parcel. Mr. Morey stated that staff recommends approval of this PUD rezoning and lot combination request subject to five stipulations listed in the planning report of March 15, 1991. .John Schweich was present to answer questions of the Commission and public. Merle Brown of 210th Street questioned. the parcel across Holyoke Avenue from the bus garage. Mr. Schweich stated he is not asking for a rezoning on that property at the present time. There was no further public comment. The Commission discussed the following: - Assessments for Improvement Project #90-05. Plannin Commission Minutes g MARCH 21, 1991' Page 4 - The single family residential property located to the north of the site. - Timing of future expansion ofthe bus garage operation. - Hookup of adjacent houses to City sewer and water. - Administrative lot combination. 91.28 Motion was made by Whittingham, seconded by Smith to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. . 91.29 Motion was made by Miller, seconded by Whittingham to recommend approval of the application of Sehmitty and Sons, Inc. for a rezoning from R-6, Medium Densety Residential District, to PUD, Planned Unit Development, located at 21160 ~-Iolyoke Avenue subject to the stipulations listed in the planning report of March 15, 1991. Roll call was taken on the motion. Ayes: Unanimous. Jim Robinette, .Public Works and Environmental Resources Director presented . ~ a review of the executive summary of the Urban Storm Water Runoff Monitoring Report and the Lee Lake Water Quality Monitoring results to the Commission. Following the review, Mr. Robinette answered questions of the Commission. There was no unfinished or new business. Motion was made by Whittingham, seconded by Smith to adjourn the meeting.
