CITY OF LAKEVILLE
PLANKING COMMISSION MEETING MINUTES
APRIL 18, 1991
.The meeting was called to order by Chair Steigerwalt at 7:00 p.m, in the
City Hall Council Chambers.
Roll call of members was taken. Present:: Whitehouse, O'Donnell, Holberg,
Stegerwalt, Whittingham, Miller. Absent: Smith.
Also present was Robert Erickson, City Administrator; Roger Knutson, City
Attorney; Michael Sobota, Community and Economic Development Director; Jeff
Oliver, Assistant`Engineer; Daryl Morey, Assistant Community and Economic
Development Director; Alan Brixius, Consulting Planner; and Mira Holliday,
Recording Secretary.
The minutes of the March 21, 1991 Planning Commission meeting were approved
as written.
The public hearing to consider the application of George Siskoff for a
:.conditional use permit to allow the construction of a garage. on a
non-conforming residential lot located at 20950 Holt Avenue was opened.
The City Attorney attested that all legal notices had been duly published
and mailed:.
Daryl Morey presented a review of the planning report dated April 11„.
1991. He stated Ghat Mr. Siskoff owns Lot 6, Block 1, Lakeville Village
which was p. latted in 1917 and is non-conforming with respect to lot width
and. area.. He further stated that Mr. Siskoff is proposing to remove the.
existing 20' x 22''garage which is in poor condition, and replace it with a
new 32' x 22' garage in the same location. As such, the non-conforming 16
foot setback from the. Upper 209th Street right-of-wad will be maintained.
The new garage would meet Zoning Ordinance requirements for maximum
allowable floor area. 'Mr. Morel stated that staff recommends approval of
this conditional use permit apphcat~on subject to the six stipulations
listed in the planning report.'
Mr. Siskoff was present to answer questions of the Commission and the
.public. There was no public comment.
The Commission held a discussion which: included:
- Width of the driveway
- Setback requirements
- Foundation for the garage
- Driveway access
- .Possibility of moving the garage south two feet
91.30 Motion was made by Whittingham, seconded by O'Donnell to close the public
hearing.
Roll call was taken on the motion.. Ayes:. Unanimous.

91.31 Motion was made by Miller, seconded by Whittingham to recommend approval of
the application of George Siskoff for a conditional use permit to allow the
..construction of a garage on anon-conforming residential lot located at
20950 Holt Avenue subject to the planning report of Apri111, 1991 with the
addition of stipulation number 7 being the width of the driveway be no more
than 24'and stipulation number 8 being the garage be moved south two feet
suba'ect to approval of the Building Official; and subject to the findings
of fact.
Roli call was taken on the motion. Ayes:. Unanimous.
The public hearing to consider the application of Kevin and Dianne Sullivan
for a conditional use permit to allow a second driveway curb cut access on
property located at 17705 Layton Path was opened. The City Attorney
attested that all legal notices had been duly published and mailed.
Daryl Morey presented a review of the planning report dated April 10,
1991. He discussed Mr. and Mrs. Sullivan's proposed house and driveway
layout on the properttyy along with the reasons for the second driveway curb
cut access request. 1Vlr. Morey recommended appproval of the conditional use
permit subject to the three stipulations listed in the planning report of
. April 10, 1991.
Mr. Sullivan was present to answer questions of the Commission and public.
.There was no public comment. The Commission held a a brief discussion.
91.32 Motion was made by Miller, seconded by Whittingham to close the public
hearing.
Roll call was taken on the motion. Ayes: Unanimous.
91.33 Motion was made by Holberg, seconded by Whitehouse to recommend approval of
the application of Kevin and Dianne Sullivan for a conditional use permit
to allow a second driveway curb cut access on pproperty lacated at 17705
Layton Path subject to the plamung report of April 10, .1991, the draft
:.conditional use permit and the findings of fact.
Roll call was taken on the motion. Ayes: Unanimous.
Alan Brixiusresented an overview of the final plat of Meadow Brook 2nd
Addition, reviewing the planning report dated April 10, 1991. He discussed
the following:
- PUD/CUP
- Lots
- Blocks

Mr. Brixius recommended approval of the final flat of Meadow Brook 2nd
Addition subject to the recommendations listed in the planning report of
Apri110, 199 L
Warren Israelson of Progress Development was present to answer questions of
the Commission. The Commission held a discussion which included:
- Floodplain elevations
- Temporary cul-de-sac
- .Waiver of park dedication
91.34 Motion was made by Whitehouse, seconded by Miller to recommend approval of
the final plat of Meadow Brook 2nd Addition subject to the planning. report
of April 10, 1991, the recommendations of the Environmental Affairs
• Committee and the Parks and Recreation Committee, and a minor Comprehensive
Plan amendment to bring the final plat into the Year 2000 MUSA.
Roll call was taken on the motion. Ayes: Unanimous.
Daryl Morey reviewed the final plat of Cedar Glen 3rd Addition, outlining
the planning report of April 11, 1991. He discussed the following:
- Consistency with the preliminary plat
- Blocks
- Lots
- Outlots
- .Streets
- Grading, drainage, erosion control and easements
- Parks and trails
- Urban service area
Mr. More stated staff recommends approval of the final plat of Cedar Glen
3rd Addition subject to the 13 stipulations listed in the plamm~g report
of April 11, 1991 with the elimination of stipulation number. 5.
Steve Fiterman of Ground Development and Joel Cooper of Pioneer Engineering
were present to answer questions of the Commission. Mr. Cooper stated they
objected to the stipulations (1 through 4j regarding driveway access for
the corner lots not being allowed on Griffon Trail. They agree to provide
driveway access onto the side streets for Lot 9, Block 1, Lots.8 and 9,
_ • Block 2, and Lot 1, Block 4 but not Lots 1 and 7, Block 3, Lot 1, Block S,
and Lot 8, Block 6.
The Commission held a discussion which included:

- Lot width of Lot 6, Block 5 and Lot 2, Block 6
It was the general feeling of the Commission that driveway accesses should
not be off of Griffon Tra,~l.
91.35 Motion was made by Holberg, seconded by Whitehouse to recommend approval of
the final plat of Cedar Glen 3rd Addition subject to the planning report of
Apri111, 1991. with the elimination of recommendation number five and the
addition of a new number five being to take ten feet from Lot 8, Block 6
and add ten feet to Lot 1, Block 6 with the driveway (provided with a turn
around) location being on the west side of the house; the March 5,1991
Dakota County Soil and Water Conservation District report; the April 11,
1991 engineering report; and subject to a minor Comprehensive Plan
amendment to bring the final plat into the Year 2~ MUSA.
Roll call was taken on the motion. Ayes: Whitehouse, O'Donnell, Holberg,
Steigerwalt, Whittingham. Nay: Miller.
• The reason for Miller's nay was he felt there should be driveway turn
grounds for the lots fronting Griffon Trail.
There was no unfinished business.
Under new business, Robert Erickson discussed the upcoming public hearing
regarding the new high school.
91.36 Motion was made by Whitehouse, seconded by Holberg to .adjourn the meeting.
Voice vote was. taken on the motion.
