HomeMy WebLinkAbout05-02-91 _ +s CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES MAY 2, 1991 The meeting was called to order by Chair Steigerwalt at 7:00 p.m. in the City Hall Council Chambers. Roll call of members was taken. Present: Whitehouse, O'Donnell, Holberg, Steigerwalt, Whttingham, Smith, Miller. Also present was Robert Erickson, City Administrator; Mayor Duane Zaun; Councilmember Pat Harvey; Roger Knutson; City Attorney; David Licht, Planning Consultant; Alan Brunus, Planning Consultant; Michael Sobota, Community and Economic Development Director; Daryl Morey, Assistant Community and Economic Development Director; Jeff Oliver, Assistant Engineer; and Mira Holliday, Recording Secretary. The minutes of the April 18, 1991 Planning Commission meeting were approved as written. The public hearing to consider the application of Richard Clemmer for a conditional use permit to allow a bwlding expansion for an industrial business on anon-conforming lot located at 8984 215th Street was opened. The City Attorney attested that all legal notices had been duly published and mailed. • Daryl Morey presented a review of the planning report dated April 26, 1991. He stated that Dick's Sanitation Service currently operates out of an approximately 6,300 square foot metal building. and due to the extremely cramped office space, Mr. Clemmer is proposing to construct a 1,350 square foot brick office addition. Mr. Clemmer is also proposing to have customer and employee parking and driveway areas. Mr. Morey also chscussed the following: - Lot size and area - Parking and outside storage - Future metal building (not allowed by ordinance) - Landscaping - Drainage and utility easement Mr. Morey stated that staff recommends approval of the conditional use permit subject to the 7 stipulations as listed in the planning report dated April 26, 1991. Mr. Clemmer was present and commented on the landscaping and also expressed his concern over the staff recommendation that curbing be installed along the employee parking area located at the rear of the existing building. He also stated he would hke to keep the land/sea containers which he uses for storage of recyclable material. . There was no public comment. PLANNING COMMISSION MINUTES MAY 2, 1991 Page 2 The Commission held a discussion which included: - Type of construction (brick) - Availability of City sewer and water (approximately 1/4 mile from existing site) - Traffic patterns - Curbing around parking area - .Outside storage - Use of land/sea containers - Driveway access - Existing non-conforming lot - Handicapped parking Mr. Whitehouse requested that staff review ordinance restrictions regarding the use of trailer and land/sea containers for storage purposes. Staff indicated they would research the matter further before this item is considered by the City Council. 91.37 Motion was made by Miller, seconded by Smith to close the public .hearing. Roll call was taken on the motion. Ayes: Unanimous. • 91.38 Motion was made by Whittingham, seconded by Holberg to recommend approval of the application of Richard Clemmer for a conditional use permit to allow a building expansion for an industrial business on anon-conforming lot located at 8984 215th Street subject to the planning report of April 26, 1991 with the addition of stipulation number 8 being that one handicapped parking s ace be provided and stipulation number 9 being that the use of the land~ea containers be reviewed by the Building Official and Fire Marshal for compliance with code and ordinance requirements; and subject to the findings of fact. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of Merillat Corporation for a conditional use permit to allow a loading berth at the rear of a double frontage lot located at 21755 Cedar Avenue was opened. The City Attorney attested that all legal notices had. been duly published and mailed. Daryl Morey presented a review of the planning report dated Apri125, 1991. He stated the proposed loading berth is part of the 77,000 square foot building expansion currently under construction on the site. He further stated that the. proposed loading berth meets the requirements of the Zoning Ordinance. However, staff is concerned about the adjacent unpaved semi-truck parking area and the condition of the fence in that area of the site. Paving and curbing of this semi-truck parking area and repair of the fence will be regwired as part of the conditional use hermit. Mr. • Morey stated that staff recommends approval of the conditional use permit request subject to five stipulations listed in the Apri125, 1991 report. • PLANNING COMMISSION MINUTES MAY 2, 1991 Page 3 Jack: Matasosky of Appro Development, representing the applicant, was present and stated the applicant is m agreement with the stipulations of the planning report. There was no public comment. A brief discussion was held by the Planning Commission. 91.39 Motion was made by Holberg, seconded by Whittingham to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 91.40 Motion was made by Holberg, seconded by Whitehouse to recommend approval of the application of Merillat corporation for a conditional use permit to allow a loading berth at the rear of a double frontage lot located at 21755 Cedar Avenue subject to the planning report of April 25, 1991 and the findings of fact. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of Independent School District 194 for a preliminary flat and conditional use permit as it . relates to public school facilities and buildings to be located on the west side of Dodd Boulevard, south of 192nd Street was opened. The City Attorney attested that all legal notices had been duly published and .mailed. David Licht reviewed the site location. He gave a general overview of staff comments. He stated that staff is continuing to work with the School Board and architect and that changes need to be made to the current site plan. He briefly reviewed. the layout of the site, parking and access to the site. Bill Forbord, Chairman of the School Board made a brief statement, indicating the goal for occupancy of the new school is Fall, 1993. Kevin Sullivan, architect for the project reviewed the time schedule for the roject and expressed his concerns should the project be delayed. He also briefly discussed the grading for the project. - There was no public comment. Chair Steigerwalt tabled discussion of this item until later in the meeting in order to open the hearing on agenda item number seven. The public hearing to consider the application of Lakeville Community Corporation for a conditional use pernut for an ice hockey arena on land located west of Dodd Boulevard and north of T.H. 50 was opened, The City . Attorney attested that all legal notices had been duly published and mailed. David Licht reviewed the site plan for the proposed ice arena and recommended that no detailed comment be made until some resolution of issues with the high school site are made. t PLANNING COMMISSION MINUTES MAY 2, 1991 Page 4 There was no public comment. Mr. Jim Morrow of Lakeville Community Corporation was present to answer questions of the Commission. Mr. Whitehouse asked Mr. Morrow if the ice arena project was financially tied into the proposed new school or if the location is the only thing they have in common. Mr. Morrow responded that there is no financial ties between the School District and the ice arena project, only location. The Commission generally felt they needed further information before discussing this issue or offering a recommendation. 91.41 Motion was made by Whitehouse, seconded by Holbert to continue the public hearing regarding an ice hockey arena pending further information. Roll. call was taken on the motion. Ayes: Unanimous. The discussion of agenda item number 6 was continued. The Commission listed their general concerns as follows: • = Parking lot grades Walkways width - Access to the site - Fire and safety vehicle access - :Number of :ball fields and expense of maintenance - Runoff of chemicals used for ice removal into the holding pond - Close proximity of pond to the elementary school - Concern over general topography - Location of ice arena in relation to proposed school - Tree preservation - Location of stadium in conjunction with parking The Commission generally felt they could not make comment or recommendation until further information is received. Mr. Sullivan expressed his concern that the Commission had not received all the information provided to City staff. Mr. Erickson and Mr. Licht explained that all information submitted to staff is thoroughly reviewed before it is presented to the Planning Commission and City Council. They further explained that City staff has been working with the School District and architect on modifications to the proposed school plans and presentation of modified plans would be made after they have been adequately reviewed. Mr. Erickson further stated that, because time is of the essence for this project, a special Planning Commission meeting may be necessary. 91.42 Motion was made by Miller, seconded by Whitehouse to continue the public hearing pending further information. Roll call was taken on the motion. Ayes: Unanimous. PLANNING COMMISSION MINUTES MAY 2, 1991 Page 5 Under unfinished business, Mr. Erickson updated the Commission on the Schmitty and Sons bus garage expansion issue. Mr. Whitehouse expressed his concern over rodents at the Dick's Sanitation Service and other recycling locations. Dave Krings, Building Official stated he would check into the situation. Ms. Holberg expressed her concern over the speed of construction vehicles on 168th Street. Mr. Erickson stated he would look into the matter and notify the City Engineer and .Police Chief. There was no new business. 91.43 Motion was made by Whitehouse, seconded by Holberg to adjourn the meeting. Voice vote was taken on the motion.
