PLANNINCp COMMISSION MEETING MINUTES
JUNE 6, 1991
The meeting was called to order by Chair Steigerwalt at 7:00 p.m. in the
City Hall Council Chambers.
Roll call of members was taken. Present: Whitehouse, O'Donnell,
Steigerwalt, Whittingham, Smith, Miller. Absent: Holberg.
Also present was Robert Erickson, City Administrator; Roder, Knutson, City
Attorney; Daryl. Morey, Assistant Community and Econonuc Development
Director; Jeff Oliver, Assistant Engineer; Mira. Holliday, Recording
Secretary.
The minutes of the May 16, 1991 Planning Commission meeting were approved
as written.
The public hearing to consider the application of Independent School
Distnct 194 for a minor comprehensive plan amendment to include property.
in the Year 2000 Urban Service Area as rt relates to public school
facilities and buildings on land located on the west side of Dodd
Boulevard, south of 192nd Street was opened. The City Attorney attested
that all legal notices had been duly published and mailed.
• Daryl Morey stated that the minor comprehensive plan amendment to bring the
high school site into the 2000 MUSA was mistakenly not included with the
ppublic hearing for the preliminary plat and conditional use permits. He
further stated that approval of the amendment is necessary to allow the
installation of sanitary sewer service to the new high school to occur.
91.52 Motion was made by Whittingham, seconded by Miller to close the public
hearing.
Roll call was taken. on the motion.. Ayes: Unanimous.
91.53 Motion was made by Whittingham, .seconded by Smith to recommend approval of
the application of Independent School District 194 for a minor
comprehensive plan amendment to include property in the Year 2000 Urban
Service Area as it relates to public school facilities and buildings on
land located on the west side of Dodd Boulevard, south of 192nd Street.
Roll call was taken on the motion. Ayes:. Unanimous.
The public hearing to consider the application of Kurt and Kenneth Larson
for the preliminary and final plat and planned unit development of four
townhouse lots to be known as Larson's Townhome Addition and for a rezoning
from R-2, Single Family Residential District, to R-5, Single and Two
Family, Medium Density Residential District, on land located on the south
side of 208th Street, east of Holiday Avenue was opened. The City Attorney
attested that all legal notices had been duly published and mailed.

Daryl Morey presented a review of the planning report dated May 29, 1991.
He discussed the. following:
Background
- Preliminary and final plat
- Lots and blocks
- Streets
- Easements
- Grading, drainage, erosion control and utilities
- Dakota County Soil and Water Conservation District recommendation
- Environmental Affairs Committee recommendation
- Park land dedication
- MUSA
- Parking
Landscaping
- Street vacation
- Rezoning
- Planned unit development
Mr. Morey stated that staff recommends approval of the Larson's Townhome
Addition preliminary and final plat, the vacation of a portion of East
Avenue, the rezoning from R-2 to R-5 of the to-be-vacated East Avenue and
• the planed unit development subject to six stipulations. Recommendation
number two was amended to read May 31, 1991 instead of May 29, 1991.
Mr. Ken Larson was present to answer questions of the Commission and
public.
The following residents expressed their concerns over the proposed
townhomes: George Beaumaster, Paul Beaumaster, Linda Becker, Vidas Voss,
John Marek. Their concerns included:
- Potential for increased traffic through the neighborhood
- Townhomes not compatible with single family neighborhood
- Lot size too small for proposed number of townhomes
- Potential for a decrease in surrounding. property values
- Process for rezoning R-5 area to R-2
- Possibility of townhomes becoming rental units
- Ownership of property after street vacation
- Sanitary sewer service
Robert Erickson explained that it appears the property had been rezoned six
or seven years ago. He stated that staff could investigate the history of
the property further and provide a more detailed historical prospective on
the rezoning to R-S. Mr. Erickson further stated that the developer will
pay the entire cost of the sanitary sewer service.

Mr. Larson described the floor plan of the townhomes and stated they are
being designed for retired persons. He also stated that the units will be
.owner occupied and that he has no intention of renting. the units.
The Commission held a discussion which included:
- Request for building elevation and landscaping plans
- .Requirements for outdoor. storage, accessory buildings, etc. for R-5
District
- Lot width for Lots 2 and 3
- Traffic and safety issues
- Square footage of lots
- Possibility of formation of an association for maintenance
- Drainage
- Exterior building types
- Concern over community opposition
It was the general feeling of the Commission that a neighborhood meeting
should beheld with Mr. Larson and possibly staff and that a landscaping
and building elevation plan be prepared for review at the next Commission
meeting.
91.54 Motion was made by Miller, seconded by Whitehouse to continue the ublic
hearing to the June 20, 1991 meeting. p
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the .application of Jeff Belzer for a planned
unit development-conditional use pernut amendment related to a car
dealership business expansion on land located in the southewest corner of
T.H. 50 and Cedar Avenue was opened. The Cittyy Attorney attested that all
legal notices had been duly published and mailed.
Daryl Morey presented a review of the proposed amendment,. outlining the
planning report of May 30, 1991. He discussed the background of the
.planned umt development-conditional use permit for Jeff Belzer to allow
the expansion of his existing Chevrolet dealership and establishment of a
new dealership at T.H. 50 and Cedar Avenue. He stated that the applicant
has proposed some minor .modifications to the origginal site plan approved by
the City Council last year. He discussed the modifications and stated that
staff recommends approval of the amendment. subject to the stipulation
listed in the May 30, 1991 report.
Mr. Dave Phillips, representing Jeff Belzer stated an internal addition is
being constructed for storage to get rid of the trailers now being ~ ed for
storage on the site.

The Commission held a discussion which included:
- Accesses to T.H. 50
- Future pavement of grass/mud area
- Timeframe for removal of land/sea containers
- "Future Auto Dealership" shown on site plan
91.55 Motion was made by Whitehouse, seconded by O'Donnell to close the public
hearing.
Roll call was taken on the motion. Ayes: Unanimous.
91.56 Motion was made by Whitehouse, seconded by Whittingham to recommend
approval of the application of Jeff Belzer for a planned unit
development-conditional use permit amendment related to a car dealership
business expansion on land located in the southwest corner of T.H. 50 and
Cedar Avenue subject to the planning report of May 30, 1991 with amendments
to the stipulations as follows:
1. Removal from the property of land/sea containers and semi-trailers
used for storage at the time of Certificate of Occupancy.
• 2. The May 30, 1991 site plan be revised to eliminate the 'T'uture Auto
Dealership" shown in dashed lines.
Roll call was taken on the motion. Ayes: Unanimous..
Under unfinished business, Robert Erickson updated the Commission on the
' proposed high school tune line.
91.57 Motion was made by O'Donnell, seconded by Whitehouse to adjourn the
meeting.
