PLANNING COMMISSION MEETING MINUTES
AUGUST 1, 1991
The meeting was called to order by Chair Steigerwalt at 7:00 p.m. in the
City Hall Council Chambers.
Roll call of members was taken. Present: Whitehouse, Holberg,
Steigerwalt, Smith, and Miller. Absent: O'Donnell, Whittingham.
Also present was Robert Erickson, City Administrator; Michael Sobota,
Community and Economic Development Director; Tom Scott, City Attorney;
Daryl Morey, Assistant Community and Economic Development Director; Jeff
Oliver, Assistant Engineer; Dave Krings, Building Official, and Mira
Holliday, Recording Secretary.
The minutes of the July 18, 199.1 Planning Commission were approved as
written.
The public hearing to consider the application of Independent. School
District 194 (ISD 194) for a conditional use permit amendment to expand an
existing adult basic education, preschool education, early childhood family
education and child care facility on land located at 17749 Juniper Path in
the Kenwood Center was opened. The City Attorney attested that all legal
notices had been duly published and mailed.
• Daryl Morey presented an overview of the proposed amendment, outlining the
planning report of July 26, 1991. He explained that ISD 194 had submitted
an application for an amendment to their existing conditional use permit to
allow the expansion of their existing Family Learmng Center. The Center
is proposing to expand in the Kenwood Center into a vacant bay adjacent to
their existing facility. Mr. Morey reviewed the following provisions the
Zoning Ordinance .requires as part of the conditional use permit for this
type o facility to locate in the B-4 Zoning District:
- Licensing
- Ages of children attending pre-school
- Hours of operation
- Attendance
- Lot requirements and setbacks
- Sewer and water
- Screening
- Parking
- Loading
- Signage
- Community pre-school, latch-key and adult education building/space
Mr. Morey stated staff recommends approval of the conditional use permit
amendment subject to the stipulations listed in the planning report of July
26, 1991.
Pete Martin of ISD 194 was present to answer questions of the Commission
and the public. The Commission held a discussion which included:

- Parking requirements
- Drop off parking spaces
- Possabilaty of staff parking in the rear of the facility
- Handicapped parking
- Capacity of building ,
- .Proper ventilation
- Outdoor play area expansion
- Adequacy of restroom facilities with increased number of students
- Security of smaller children
Building Official Dave Krings stated that inspections were conducted when
ISD 194 first occupied the facility and that modifications had been made.
He further stated that no permit would be issued for this expansion until
all required standards are met.
Staff suggested that a stipulation be added that would require ISD 194 to
submit a management plan for parking that would include classroom
scheduling and timing, faculty parking at alternate locations, cooperative
parking efforts with businesses m other locations, and field trip
departures from other locations. Mr. Martin made suggestions regarding
alternative timing for the arrival of students and the possibility of
• parking alternatives.
91.83 Motion was made by Holberg, seconded by Miller to close the public hearing
to consider the application of Independent School District 194 for a
conditional use permit amendment to expand an existing adult basic
education, preschool education, early childhood family education and child
care facility on land located at 17749 Juniper Path in the Kenwood Center..

91.84 Motion was made by Holberg, seconded by Miller to recommend approval of the
application of Independent School District 194 for a conditional use permit
amendment to expand an existing adult basic education, preschool education,
early childhood family education and child .care facility on land located at
17749 Juniper Path in the .Kenwood Center subject to the planning report of
July 26, 1991 with the revision of stipulation number two to include the
wording "with a minimum of six" and the addition of stipulation number.
four to read: a parking management plan be submitted to the satisfaction of
City staff to address the issues of: 1) scheduling and timing, 2) faculty
parking in alternate locations, 3} cooperative efforts with other
businesses and locations for parking, and 4) field trip parking. from other
locations, and subject to the findings of fact.

Sanitation Service for a conditional use permit amendment to allow an
accessory building for an industrial business on anon-conforming lot on
land located at 8984 215th Street West was opened. The City Attorney
attested that all legal notices had been duly published and mailed.
Daryl Morey presented an overview of the proposed conditional use permit
amendment, reviewing the planning report of July 26, 1991. He discussed
the following:
- Background
- Removal of the land/sea containers
- Construction of storage building
- Parking
- Revised site plan
- Extension of $15,000 letter of credit
- Alternatives if amendment not granted
Mr. Morey stated that staff recommends approval of the amendment subject to
the stipulations of CUP 91-06 being revised as per the planning report of
July 26, 1991.
Mr. Clemmer was present to answer an~ questions. of the Commission and
public. The Commission held a discussion which included:
- Exterior building materials for the storage building
- Parking
- Concrete curbing on tandem parking spaces
- Storage of trucks on site
- Underground tanks
- Storage of recyclable materials
91.85 Motion was made by Holberg, seconded by Miller to close the. public hearing
to consider the application of Richard Clemmer for a conditional use permit
amendment to allow an accessory building for an industrial business on a
.non-conforming lot on land located at 8984 215th Street West.
Roll call was taken on the motion. Ayes: Unanimous.
91.86. Motion was made by Holberg, seconded Miller to recommend approval of the
application of Richard Clemmer for a conditional use permit amendment to
allow an accessory building for an industrial business on anon-conforming
lot on land located at 8984 215th Street West subject to the planning
report of Julyy 26, 1991 with a revision to stipulation number one being the
addition of the wording "perimeter" parking spaces and a revision of
stipulation. number two bem~ the addrtionai wording "including Exhibit E,
Item A'; and subject to the findings of fact.

The public hearing to consider the application of Pete Spekman for the
vacation of an existing drainage and utility easement on land located at
9874 Upper 173rd Court was opened. The City Attorney attested that all
legal notices had been duly published and mailed.
Daryl Morey presented an overview of the proposed easement vacation,
reviewing the planning report dated July 25, 1991. He stated that Mr.
Spekman plans to construct a deck which would extend into the drainage and
utility easement, which covers most of the rear yard and the front and side
lot boundaries. He further stated. that a swimming pool is currently
located within the easement. Mr. Morey recommended approval of the
vacation subject to an engineering report dated July 24, 1991 which
recommends the vacation of the easements subject to Mr. Spekman dedicating
a ten foot drainage and utility easement on the front lot line and a five
foot drainage and utility easement on all other property lines. The
Commission. held a discussion. Dave Krings explained the background and
current drainage situation. The possible liability of the City should
there be water damage in the event of a heavy rainfall was discussed.
91.87 .Motion was made by Whitehouse, seconded by Holberg to close the public
hearing to consider the application. of Pete Spekman for the vacation of an

91.88 Motion was made by Holberg, seconded b~ Smith to recommend approval of the
application of Pete Spekman for the vacation of an existing drainage and
utility easement on land located at 9874 Upper 173rd Court subject to the
planning report of July 25, 1991 and the engineering report of July 24,
1991 with the additional stipulation of a ten foot drainage and utility
easement on the northwest property line.
Roll call was taken on the motion. Ayes: Unanimous.
T'he public hearing to consider the application of the City of Lakeville for
an amendment.. to the Lakeville Sign Ordinance concerning signage in
industrial zoning districts was opened. The City Attorney attested that
all legal notices had been duly published and mailed.
Daryl Morey reviewed the proposed amendment, outlining the planning report
of July 26, 1991. T'he Commission held a brief discussion. Commissioner
Smith expressed his concern over the current enforcement of the Sign
Ordinance. He listed several locations where violations of the Sign
Ordinance exist. Mr. Morey stated that staff is currently addressing this
issue. Mr. Sobota distributed a list of locations where banner signs are
displayed which staff is currently aware o£
91.89 Motion was made by Miller, seconded b Holberg to close the public hearing
to consider the application of the City of Lakeville for an amendment to
the Lakeville Sign Ordinance concerning. signage in industrial zoning
districts.

91.90 .Motion was made by Miller, seconded by Whitehouse to recommend approval of
the application of the City of Lakeville for an amendment to the Lakeville
Sign Ordinance concerning signage in industrial zoning districts subject to
the planning report of July 26, 1991.
Roll. call was taken on the motion. Ayes: Whitehouse, Holberg,
Steigerwalt, Miller. Nay: Smith
The reason for Smith's nay was he felt the ordinance should not be changed
until the current one is enforced.
A review and .discussion of a proposed amendment to the Zoning Ordinance
related to triangular and corner lots was held. Daryl Morey reviewed the
planning report of July 25, 1991. Staff stated the reason for the proposed
amendment would be to provide a more structured policy. The Commission
directed staff to set a date for apublic hearing to be held on the matter.
Under unfinished business, Mr. Sobota held a brief discussion regarding a
proposed subdivision ordinance amendment regarding preliminary plats.
Miller inquired on the applicability to adopted PUD's on preliminary
plats. Mr. Sobota stated he would check with the City Attorney regarding
this issue.
The discussion of banner signs throughout the City was continued.
91.91 Motion was made by Holberg, seconded by Miller to adjourn the meeting.
Voice vote was taken on the motion.
