PLANNING COMMISSION MEETING MINUTES
AUGUST 15, 1991
The meeting was called to order at 7:00 p.m. by Chair Steigerwalt.
Roll call of members was taken. Present: O'Donnell, Steigerwalt,
VVhittingham, Smith, Miller. Absent: Whitehouse, Holberg.
Also present was Roger Knutson, City Attorney; Michael Sobota, Community.
and Economic Development Director; Daryl Morey, Assistant Community and
Economic Development Director; Dave Krings, Building Official; Alan
Brixius, Northwest Associated Consultants; Jeff Oliver, Assistant Engineer;
John Hennen, Planning Assistant/Zoning Enforcement Coordinator; and Mira
Holliday, Recording Secretary.
The minutes of the August 1, 1991 Planning Commission meeting were approved
as written.
Holberg arrived at 7:03 p.m.
Alan Brixius presented an overview of the final plat of Meadow Brook 3rd
Addition, outhrung the planning report of July 31, 1991.
Whitehouse arrived at 7:10 p.m.
Mr. Brixius discussed the following:
- Background
- Lots
- Blocks
- Setbacks
- Streets
- Floodplain
- Utilities
- Grading and drainage
- Parks and trails
- Cash escrow
- House plans
- Landscape plan
Mr. Brixius recommended approval of the final plat of Meadow Brook 3rd
Addition subject to the seven conditions listed in the planning report.
Warren Israelson reviewed the landscape plan for a berm on the east side of
the property {adjacent to the mobile home park}. He also reviewed house
plans for that area.
The Commission held a discussion which included:
Removal of silt fencing
Rear yard MWCC easement
- Decks possibly encroaching into the MWCC easement

- Maintenance of berm
- Future phasing
- Specification of plant sizes on landscape plan
- Drantile
- House plans (split entry)
- Location of shdmg glass doors -decks
- R-2 lot width requirements
- Trail easement on adjacent property to the north
- Possibility of blanket easement
- .Future enforcement of easement encroachment (future homeowners)
Mr. Brixius indicated that the MWCC easement was not shown on the
preliminary plat of Meadow. Brook and as such, the City Council was unaware
of its existence when they approved the preliminary plat.
Dave Krings stated that. there will likely be an enforcement problem as
homeowners may construct decks in the MWCC easement vcnthout a building
permit. He indicated that the developer should be responsible for
enforcing the fact that no decks or sheds are allowed in this easement, not
the City.
Jeff Oliver stated that side yard decks may fit on these lots if one lot in
this block is eliminated and the width of the remaining lots is increased.
The Commission generally felt that staff needs to have further input on the
house design.
91.92 Motion was made by Miller, seconded by Holberg to continue the review of
.Meadow Brook 3rd Addition final plat.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of the City of Lakeville for
an amendment to the Lakeville Subdivision Ordinance concerning final plats
was opened. The City Attorney attested that all legal notices had been
duly published and mailed.
Daryl Morey reviewed the pproposed amendment which would require all
preliminary platted lots to be final platted within two years after City
Council approval. The proposed. change would also give lots currently
preliminarily approved two years to become final platted or the preliminary
Mats would become void. The Commission held a brief discussion which
included:
- Number of preliminary plats currently in the City
- Notification of developers with prelinnary plat approval

Michael Sobota presented and reviewed a map of current developments,
discussing the status of preliminary plats, since the approval of a
moratorium for new plats on July 15, 1991.
91.93 Motion was made by Miller, seconded by O'Donnell to close the public
..hearing.
Roll call was taken on the motion. Ayes: Unanimous.
91.94. Motion was made by Miller, seconded by Whittingham to recommend approval of
the application of the City of Lakeville for an amendment to the Lakeville
Subdivision Ordinance concerning final plats as presented.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of the City of Lakeville for
an amendment to the Lakeville Zoning Ordinance concerning the definition of
dog kennel was opened. The City Attorney attested that all legal notices
had been duly published and mailed.
Mr. Sobota discussed the background of the current ordinance and the
proposed change, stating the zoning ordinance needs to be consistent with
the City Code which was recently amended by the City Council due to
enforcement problems. The Commission held a discussion. It was the
general feeling that more information was needed on the enforcement
issues. Comma sion members requested that the Animal Control Officer
attend a future meeting to discuss enforcement problems.
91.95 Motion was made by Holberg, seconded by Whittingham to continue the public
hearing.
Roll call was taken on the motion. Ayes: Unanimous.
Michael Sobota reviewed the dark dedication fee recommendations and asked
for comments from the Planning Conunission. A discussion was held. It was
the general feeling of the Commission that a five percent value of
commercial/industrial property would be a more fair approach for park
dedication.
John Hennen presented an overview of the tree preservation guidelines,
asking the. Commission for any recommendations. The Commission held a
discussion, asked questions of staff, and made several recommendations
which they would like to see incorporated into the guidelines.. The
recommendations are as follows:
- That tree replacement be guaranteed for one full growing season.
• _ Include specific tree species in the definition of significant tree
That tree wound dressing be available on site at all times during
development and building phases.
- That tree pruning must take place between April 15 and July 1.

- That builders be liable for tree damage caused by their
subcontractors.
- That undesirable trees be excluded from tree replacement.
Under unfinished business, Whitehouse asked for an update on the proposed
ice arena. Robert Erickson responded.
91.96 Motion was made by Whittingham, seconded b3' Miller to adjourn the meeting..
Voice vote was taken on the motion.
