HomeMy WebLinkAbout09-19-91 Y. 7 CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES SEPTEMBER 19, 1991 The meeting was called to order by Chair Steigerwalt at 7:00 p.m in the City Hall Council Chambers. Roll call of members was taken. Present: Whitehouse, O'Donnell, Holberg, Steigerwalt, Whittingham, Smith. Absent: Miller. Also present was Robert Erickson, City Administrator; Michael Sobota, Community and Economic Development Director; Jim Walston, City Attorney; Daryl Morey, Assistant Community and Economic Development Director; Jeff Oliver, Assistant Engineer; Don Gudmundson, Police. Chief; Melissa Corcoran, Animal Control Officer; Mira Holliday, Recording Secretary. The minutes of the August 29, 1991 and the September 5,.1991 Planning Commission meetings were approved as written. The public hearing to consider the application of the City of .Lakeville for an amendment to the Lakeville Zoning Ordinance concerning the definition of dog kennel was continued from the August 15, 1991 Planning Commission meeting. Daryl Morey introduced Chief of Police Don Gudmundson and Animal Control Officer, Melissa Corcoran. Ms. Corcoran stated that many Lakeville residents have three licensed dogs, which she feels is not a problem. If the current ordinance is enforced, residents owning three or more dogs would have to obtain a kennellicense. Daryl More explained requirements for obtaining a kennel license. Chief Gudmundson stated there are approximately 800 licensed dogs within the city (35 - 38% of Lakeville residents have ~etsj. He stated that from a police enforcement standpoint, a linut of three is preferable. He further stated that Lakeville licenses more dogs that any other city in Dakota County and that the standard requirement for a dog kennel is four or more dogs. The Commission held a discussion. The general feeling was that the ordinance should remain as is, but Commission members stated they would go along with the recommendation of the Police Department because of the increased enforcement and better. management of the animal control program. 91.113 Motion was made by Whittingham, seconded by Holberg to close the public hearing. .Roll call was taken on the motion. Ayes: Unanimous. 91.114 Motion was made by Smith, seconded by Whittingham to recommend approval of the application of the City of Lakeville for an amendment to the Lakeville Zoning Ordinance concerning the definition of dog kennel with revised language to read "more than three (3) dogs" rather than "four (4) or more dogs". • PLANNING COMMISSION MEETING MINUTES SEPTEMBER 19, 1991 Page 2 Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of Thomas Retka for a conditional use hermit to allow aone-story entrance for a single family residential dwelling to extend into the front yard setback on land located at 17575 Java Court South was opened. The City Attorney attested that all legal notices had been duly published and mailed. Daryl Morey presented an overview of the application, outlining the planning report of September 13, 1991. He discussed the following: - Background - .History - Total area of existing garage and third bay addition (792 square feet) - Zoning Ordinance requirements for lot area and setbacks Entryway projection into front yard Current setback of house Character of the neighborhood Mr. Morey stated that staff recommends approval of the conditional use permit request subject to the three stipulations listed in the September 13, 1991 planning report. .Mrs. Retka was present and stated she. was in agreement with the stipulations listed in the planning report. The Commission held a brief discussion and agreed that the proposed addition to the Retka home is an improvement. There was no public comment. 91.115 Motion was made by O'Donnell, seconded by Whitehouse to .close the public hearing. Roll call was taken on the motion.. The City Attorney attested that all legal notices had been duly published and mailed. The public hearing to consider the application of Reason Investment, Inc. for the preliminary plat of 76 single family residential. lots to be known as Dodd Ridge Third Addition and for a minor comprehensive plan amendment to include the property in the Year 2000 Urban Service Area on land located east of Flagstaff Avenue and south of 170th Street was opened. The City Attorney attested that all legal notices had been duly published ..and mailed. Daryl Morey presented an overview of the plat, outlining the planning report of September 13, 1991. He discussed the .following: • - Background - History - Developer bringing lots into conformance with R-2 District .requirements - Rezoning - Preliminary and final plat Lots/blocks - Streets - Grading, drainage and erosion control - Tree preservation - Environmental Affairs Committee recommendation - Parks and trails - MUSA Mr, Morey stated that staff recommends approval of the preliminary and final plats and the rezoning subject to the nine stipulations fisted in the September 13, 1991 planning report. Mr. Rezak and Mr. Suede, representing the developer, were present. • PL,~~NNING COMMISSION MEETING MINUTES SEPTEMBER 19, 1991 Page 4 The Commission held a discussion which included: - Driveways. onto 174th Street - Emergency overflow swales - Draintile in streets - Erosion control plaps - Dakota County Soil and Water Conservation District recommendations - Environmental Affairs Committee recommendations - Naming of Fishing Avenue (turns into 175th Street} Hammerhead driveways for Lots 1-7, Block 4 - Signage for Finch Path and Fireside Lane 91.117 Motion was made by Holberg, seconded by Whittingham to close both public hearings. Roll call was taken on the motion. Ayes: Unanimous. 91.118 Motion was made byy Holberg, seconded by Whitehouse to recommend approval of the application of Reason Investment, Inc. for a rezoning from R-5, Single and Two Family, Medium Density Residential District and R-3, High Density Single Family Residential District, to R-2, Single Family Residential District, on land located .east of Flagstaff Avenue and south of 170th Street. Roll call was taken on the motion. Ayes: Unanimous. 91.119 Motion was made byy Holberg, seconded by O'Donnell to recommend approval of the application of Reason Investment, Inc. for the preliminary lat of 76 single family residential lots to be known as Dodd Ridge Third Addition and for a minor comprehensive plan amendment to include the property in the Year 2000 Urban Service. Area on eland located east of Flagstaff Avenue and south of 170th Street subject to the planning report of September 13, 1991 with a revision to stipulation number 8 to read 'Implementation of the tree preservation plan dated 9/16/91"; and additional stipulations to read as follows: A driveway turn around shall be provided on Lots 1-7, Block 4; `No outlet" signs be installed for Finch Path and Fireside Lane; the streets be renamed so they are less confusing; and also subject to the engineering report of September 12, 1991 and the Dakota County Soil and Water Conservation report dated September 11, 1991. Roll call was taken on the motion. Roll call was taken on the motion. Ayes: Unanimous. 91.121 Motion was made by Whittingham, seconded by Holberg to adjourn the meeting. Voice vote was taken on the motion. Ayes: Unanimous.
