SPECIAL PLANNING COMMISSION MEETING MINUTES
OCTOBER 1, 1991
The meeting was called to order by Chair Steigerwaht at 8:50 p.m. in the
City Hall Council Chambers.
NOTE: The meeting was preceded by a presentation by the developer on the
proposed project.
Roll call of members was taken, Present: Whitehouse, Holberg,
Steigerwalt, Whittingham, Miller. Absent: O'Donnell and Smith.
Also present was Mayor Duane Zaun; Robert Erickson, City Administrator;
Roger Knutson, City Attorney; Michael Sobota, Community and Economic
Development Director; Keith Nelson, City Engineer; Jim Robinette, Public
Works and Environmental Resources Director; Alan Brixius, Consulting
Planner; Kyle Brown; Consulting Planner; Steve Michaud, Parks and
Recreation Director; Councilmember Pat Harvey; Councilmember Betty Sindt;
Councilmember Lynette Mulvihill; .Mira Holliday, Recording Secretary.
The public hearing to consider the application of Freeborn Mower, Ltd. for
a planned unit development concept approval for a golf course and
residential commumty and rezoning from R-2 Single Family Residential to
Planned Unit Development on approximately 280 acres of land located south
of County Road 46 and east of Ipava Avenue was opened. The City Attorney
attested that all legal notices had been duly published and mailed.
Alan Brixius presented an overview of the proposed planned unit development
concept and rezoning, outlining the planning report of September 26, 1991.
He discussed the following:
- Background
- Rezoning
- Comprehensive Plan consistency
- Land use compatibility
- Ownership
- Streets/layout
- Dots
- Trails/pedestrian circulation
- NSP easement
- Utilities
- Grading and drainage
- Wetlands
- Staging and timeline
- Lots and setbacks
- Clubhouse location and site plan
- Maintenance building location
- Screening/fencing by Crystal Lake Elementary School
- Tree preservation
- Slopes and sensitive environmental areas

Mr. Brixius stated that the concept is viewed as a very positive
contribution to the City. He further stated that staff recommends approval
of the rezoning and planned unit development concept plan, subject to
comments listed in the planning report of September 26, 1991 and the Barr
Engineering memorandum of September 26, 1991.
Members of the Crystal Lake Golf Estates development team were present to
answer questions. They included: Roger Olson, Jerry Pestorious, Doug
Durst, ownrs; Chet Harrison, Project Engineer; Jeff Hultgren, Project
Coordinator; and Dan Conway, THK, .Inc.
Public comment included:
Steven Stoberg of Ides Circle questioned future plans for Ides Circle.
Robert Erickson responded.
Tom McKasy, 801 E. Crystal Lake Road, representing the Crystal Lake
Homeowners Association made comments regarding the following:
- Concern over wetlands and sedimentation basins (especially during.
construction stage).
- Would like to see a specific party assigned responsibility through a
covenant should ecological .damage occur.
- Would like to see a ban on phosphate fertilizer after the golf course
is established.
. - Would like to see no new inlet drainage pipes put into Crystal Lake as
a result of the project.
Mr. McKasy further stated the suggestions of the association would be
sumbitted to the City in letter form..
.Chet Harrison, Project Engineer, addressed the drainage concerns. He also
discussed sanitary sewer plans for the area.: Keith Nelson discussed the
overall drainage flan in the Crystal Lake area in conjunction with the
County Road 46 unprovement project. Mr. Nelson also discussed the use of
phosphate fertilizer.
Jerry Wicklund of Lac. Lavon Way expressed his concern over the existing
ponds in the Bluebill Bay and Trotters Ridge areas.. He questioned who
would be responsible for maintenance of the future ponds. Staff responded.
Councilmember Pat Harvey indicated that in recent discussion with residents
of Trotters Ride and Bluebay Bay Estates regarding the accumlation of
sediment in then ponds, desire to have the sediment removed from the ponds
while preserving the aquatic growth (i.e. cattails) around the. perimeter.

Tim Lundahl, Chair of the Environmental Affairs Committee expressed concern
over the number and size of wetlands which will be impacted. He stated the.
Environmental Affairs Committee feels there are several problems yet to be
worked out. He stated he felt the Planning Commission should not recommend
approval of the project until these problems are resolved.
Staff noted that the Environmental Affairs Committee would be meeting on
site with the developer on October 8th.
.Jim Luckman, owner of a parcel of property on the southeast corner of the
golf course stated he had reached an understanding with the previous golf
course developer and was surprised to learn that his land was no longer
included in the concept. In response to Mr. Whitehouse's questions
regarding the use of his property for the golf course, Mr. Luckman stated
the current developer would have to pay a large sum of money to compensate
him for the loss of lots. Mr. Erickson informed Mr. Luckman that. his
property currently lacks access through the Crystal Lake Golf Estates
property.
Mr. Sobota distributed a memorandum and revised legal description
(Attachment A) at the request of the developer of the planned unit
development and rezoning area which does not include the Luckman property.
Tom Ryan of Ipava Avenue expressed concern over the installation of
sanitary sewer. He also stated he feels the City should not be involved in
negotiations for additional property needed for the "development. Robert
Erickson explained. that the developer has designed a sanitary sewer plan to
provide gravity sewer to parcels west of Ipava. Mr. Erickson also
described the City's interest in the purchase of the 17 acre parcel
Steve Hanson of Kenwood Trail expressed his concern over the impact on area
wetlands.. He further stated. the concept should not be approved until all
perimeters of the project are looked into. He stated the Army Corps of
Engineers, the Department of Natural Resources and the Audobon Society have
have concerns in regard to the project. He further stated that the
Commission should take the recommendation of Northwest Associated
Consultants and address the wetland .issue prior to recommendation of
approval.
Alan Brixius stated that Northwest Associated Consultants recommend that
the wetland issue be addressed before development stage. His firm is
.recommending approval of the concept stage at this time.
Robert Erickson presented documents which stated the Army Corps of
Engineers had issued a permit to the developer and that the Department of
Natural Resources had commended. the City regarding the drainage and erosion
control plans for County Road 46.
Bob Nicholson of the Environmental Affairs Committee expressed his concern
over the "fast track" of the project. He stated that flood plasn
management of the. area needs to be addressed.

Alan Brixius explained that concept approval is only for land use
arrangement in preparation for development stages. He stated that City
commissions Jcommittees will have three more opportunities to review the
project plans.
Roger Olson of the development team stated their water management
consultant will be present at the Environmental Affairs Comrruttee meeting
October 8th to address concerns relating to the wetland.
The Commission held a discussion which included:
- Design of project in relation to Crystal Lake Elementary School
- Transition of golfers from one neighborhood to another, especially
near Lac Lavon Drive near 160th Street.
- Sewer from clubhouse to 165th Street
- Lots sizes west of 165th Street
- NSP easement
- Tree preservation
Wetlands
- Wetland system impact plan
County Road 46 improvement project (traffic signal at Ipava]
Golf cart travel adjacent to County Road 46
- Main entrance of golf course (Ipava Avenue)
- Draintile
- Future public utilities
- Value of future homes
- Clubhouse design for future .expansion (parking}
- Use of phosphates
- R-7 area negotiations
- Screening along County Road 46 and interior streets
91.122 Motion was made by Whittingham, seconded Miller to close the public
hearing.
Roll call was taken on the motion. Ayes: Unanimous.
91.123. Motion was made by Whittingham,. seconded by Whitehouse to recommend
approval of the application of Freeborn Mower, Ltd. for a planned unit
development conceppt approval for a golf course and residential community
and rezoning from R-2 Single Family Residential to Planned Unit development
on approximately 280 acres of land located south of County Road 46 and east
of Ipava subject to the pplanning report of September 26, 1991, the Barr
Engineering re ort of Se tember 26, 1991, revised legal description
(Attachment A~ and the findings of fact.
Roll call was taken on the motion. Ayes: Unanimous.
