HomeMy WebLinkAbout12-05-91 CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES DECEMBER 5,1991 The meeting was called to order by Chair Steigerwalt at 7:00 p.m. Roll call of members was. taken. Present: Whitehouse, O'Donnell, Holberg, Steigerwalt, Whittingham, Smith, Miller. Also present was Roger Knutson, City Attorney; Bob Erickson, City Administrator; Mike Sobota, Community & Economic Development Director; Daryl Morey, Assistant Community and Economic Development Director; Jeff Oliver, Assistant Engineer; David Licht, Planning Consultant; Charlene Friedges, City Clerk. The minutes of the November 7,1991, Planning Commission meeting were approved as written. Mr. Morey presented a letter from Mr. Michael Tzenis withdrawing his request for a conditional use permit. Mr. Morey explained that the City Council approved the rezoning of his property from B-4 to R-1. Therefore, the property is no longer non-conforming and a conditional use permit to construct an addition to his home is not necessary. 91.140 Motion was made by Holberg, seconded by Smith to close the public hearing on the conditional use permit request of Michael Tzenis. Roll call was taken on the motion. Ayes: Unanimous. 91.141 Motion was made by Holberg, seconded by O'Donnell to accept the letter from Michael Tzenis, dated November 19,1991, withdrawing his conditional use permit application. Roll call was taken on the motion. Ayes: Unanimous. Chair Steigerwalt opened the public hearing to consider the application of Brown & Cris, Inc. for an amendment to an existing conditional use permit to allow the construction of a storage building on land located at 19740 Kenrick Avenue. The City Attorney attested that legal notices had been duly published and mailed. Mr. Morey provided an overview of the proposed conditional use permit amendment, outlining the planning report dated November 27,1991. He discussed the following: - History of the present conditional use permit - Building height and setbacks - Parking requirements - Outdoor storage - Building materials Mr. Morey stated the staff concurs with Brawn & Cris' goal to reduce and centralize their. existing materials and equipment stored outdoors in an r ~ PLANNING COMMISSION MEETING MINUTES DECEMBER 5,1991 • PAGE 2 effort to improve the overall appearance of the property and recommends approval of the conditional use permit amendment, subect to 11 stipulations as outlined in the planning report. The Commission members discussed the .following: - Pitch of roof and gauge of metal - Visibility of the building from I-35 and the frontage road - Cedar°siding consistent with the existing office building and in compliance with zoning ordinance requirements - Landscaping/screening - Property located outside of the 2010 MUSA The Commission discussed placing a time limit on the existence of the building, where, after a certain date, the building is either removed or an extension of the conditional use permit is granted by the City. Staff suggested the applicant submit a landscapingg plan, consisting of six-foot or larger conifers to screen the building from Kennck Avenue. The Commission questioned the type and quality of metal that would be used on the building. 91.142 Motion was made by Miller, seconded by Smith to continue the public hearing to allow the applicant an opportunity to submit a landscaping plan, meet • with City staff to reach a better understanding of the building code requirements for this type of building, and prepare cost estimates for providing exterior building materials in compliance with zoning ordinance requirements. Roll call was taken on the motion. Ayes: Unanimous. Mr. Morey presented the final plat of Country Pond South 3rd Addition, consisting of two single family residential lots on approximately three-quarters of an acre in the northwest corner of 173rd Street and Flagstaff Avenue. He provided an overview of the November 26, 1991, planning report as follows: - Consistency with approved preliminary plat - Park and trail dedication - Preservation of trees along Flagstaff Avenue Mr. Morey explained that a tree preservation plan is not required, since the trees do not meet the six-inch diameter requirement. Commissioner Miller suggested a hammerhead driveway be constructed on Lot 2, Block 1, for safer access onto 173rd Street. Staff e~lained that 173rd Street is presently considered a local street, and traffic volumes are not likely to change dramatically. However, staff recommended the garage and driveway be placed an the west side of the lot. Commissioner Miller felt • the hammerhead driveway should be constructed with the garage located on the west side of the lot. ~ A PLANNING COMMISSION MEETING MINUTES DECEMBER 5,1991 PAGE 3 91.143 Motion was made by Holberg, seconded by Miller to recommend approval of the final plat of Country Pond South 3rd Addition, subject to the following: Stipulation No. 3 shall read, "The driveway access for Lot 2, Block 1 shall be off of 173rd Street, and the garage and driveway turnaround shall be located on the west side of the lot". Stipulation No. 4 shall be added to read, "Every attempt shall be made to preserve the trees along Flagstaff Avenue on the east side of the plat". Roll call was taken on the motion. Ayes: Unanimous. Mr. Sobota stated the Environmental Affairs Committee tabled the final grading and erosion control plan for Daniels 2nd Addition. He explained that staff will be working with the developer to obtain an Army Corps of Engineers permit and review the tree preservation plan; therefore, he recommended the Planning Commission table consideration of the final plat. 91.144 Motion was made by Miller, seconded by Smith to table consideration of the final plat of Daniels 2nd Addition. Roll call was taken on the motion. Ayes: Unanimous. Mr. Licht presented for discussion the application of subdivision and zoning ordinance standards for development located in environmentally sensitive areas. He explained that staff has recently encountered a proposed development which, if strict standards of subdivision and zoning ordinances are followed, a major loss of trees and some impact on wetlands will be experienced. As a result, the developer in question has requested City consideration of reduced cul-de-sac right-of--way and pavement widths, along with reduced front yard setback requirements. The objective of these possible deviations is preservation of natural features. While this case is specific, staff feels that numerous similar situations maybe encountered in the future. As outlined in the November 14, 1991, planning report, Mr. Licht described a suggested policy which would apply in cases where the utilization of a cul-de-sac meets the general existing policy of the City. He emphasized that this. policy is preliminary and is being provided for discussion purposes: - Right-of-way dedication reduction possibly from 60 feet to 50 feet - Reducedpavementtyidths -from 32 feet to possibly 28 feet - Reduced front yard setbacks -from 30 feet to 25 feet or 20 feet in cases where garages are not fronted directly on the street frontage. The Commission members discussed eliminating on-street parking on one side of the narrower street and/or designating one-way traffic. They discussed the possibility of allowing reduced standards in the R-1 district, whereby • the developer of R-21and would have to rezone to R-1 to take advantage of the reduced infrastructure standards. They also discussed the possibility PLANNING COMMISSION MEETING MINUTES DECEMBER 5,1991 PAGE 4 of creating a sensitive development area overlay district that incorporates these reduced standards. The Commission members were concerned about density, especially if front yard setbacks and street rights-of--way are reduced. This could lead to the fronts of houses on opposite sides of the street being only 90 feet apart; 120 feet is the norm. The Commission members suggested increased sideyard setbacks in this instance to offset the front yard density increase. Commissioner Whitehouse requested a completion date of July 1,1992. The Commission received staff's banner sign status update and discussed the report briefly. Under new business, Commissioner Whitehouse asked about the lighting at Belzer Chevrolet, and staff explained that the lights which are aimed toward the Cedar Avenue/Trunk Highway 50 intersection will be moved.
