.PLANNING COMMISSION MINUTES
FEBRUARY 1, 1990
The meeting was called to order by Chairperson Whittingham
at 7:00 p.m. in the Airlake Council Chambers.
Roll call of members was taken. Present: Whitehouse,
Miller, Holberg, Whittingham, Steigerwalt. Absent:
Langhorst.
Also present was Elliott Knetsch, City Attorney; Alan
Brixius, Consulting Planner; Jim Robinette, Community
Development Director; Daryl Morey, Assistant Community
Development Director and Mira Holliday, Recording Secretary.
90.19 Motion was made by Steigerwalt, seconded by Holberg to
approve the minutes of the January 18, 1990 Planning
Commission meeting.
Roll call was taken on the motion. Ayes: Holberg,
Whittingham, Steigerwalt. Abstain: Miller.
The public hearing to consider the application of the City
of Lakeville for an amendment to Section 11.11, Subdivision
of Two Family or Quadraminium Lots, of Ordinance 167, the
Zoning Ordinance was opened. The City Attorney attested
that all legal notices had been duly published and mailed.
Daryl Morey gave a review of the proposed amendment,
outlining the planning report of 1/26/90. He explained the
frequency of requests for two family lot subdivisions and
the manner in which they have been handled in the past. He
stated that there are instances where duplexes have been
built uncentered on 15,000 square foot lots. Under our
current ordinance, these lots could not be subdivided
because one lot would have an area less than the required
7,500 square feet. In order to avoid variance requests
(without an undue hardship) and subdivision requests with
bent or angled property lines, staff is seeking approval of
this amendment. The proposed amendment will allow a 10~
reduction in either lot area or lot width for duplex.

accommodate duplexes not centered on lots. It will also
continue to allow the majority of duplex subdivision
requests to be handled administratively. He recommended
approval of the amendment.

- Variances.
_ - Possibility of infringing on other developments in the
area.
- Instances where duplexes are built off center.
- Instances where the duplex lot is not yet developed upon.
Whitehouse stated that he felt the existing laws are
sufficient and is very concerned over construction companies
using the situation to their advantage in the event of new
construction. He was also concerned over a zoning change to
single family after a duplex lot is subdivided.
Staff explained that this ordinance amendment would only
apply to lots of record and that the zoning of the lots
would not change. Also, a single family home could not be
built on a subdivided duplex lot unless the lot was of
sufficient size to meet the minimum lot area requirement for
a single family home (now 11,000 square feet).
90.20 Motion was made by Holberg, seconded by Miller to chose the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
90.21 Motion was made by Miller, seconded by Whitehouse to
recommend approval of the application of the City of
Lakeville for an amendment to Section 11.11, .Subdivision of
Two Family or Quadraminium Lots, of Ordinance 167, the
Zoning Ordinance as amended.
Roll call was taken on the motion. Ayes: Unanimous.
Jim Robinette: gave a review of the Plymouth and Eden Prairie
tree preservation policies. He explained that there is a
provision in the City's Subdivision Ordinance which grants
the City the authority to require a tree preservation plan
as supplementary preliminary plat information. He further
explained how this matter pertains. to the pending Lake Villa
Golf Estates 6th Addition. He stated that staff will be
reviewing the Subdivision Ordinance along with reviewing.
policies of other cities and more information will be
brought before the Commission at a later date.

A discussion was held among the Commission and staff
concerning the existing developments and the amount of trees
being cut.. Whitehouse expressed the desire to have an
informal meeting on a date near Arbor Day and invite a
forester to speak to developers and any interested public.
The Commission stated they were in favor of a tree
preservation plan and thought it would be a good. idea to
place such information in the developer packets. They also
expressed the desire to .have someone from the DNR speak at
one of their regularly scheduled meetings.
Jim Robinette :gave an update on the proposed changes to the
storm sewer area charge, explaining .that charges increase
with increased construction costs and is assessed over a 10
year period. He stated that when development occurs on an
unplatted parcel, it is not assessed the storm sewer area
charge. A resolution is being considered by the City
Council that will rectify this situation as well as increase
the storm sewer area charge for 1990 to reflect increased.

90.22 Motion was made by-Holberg, seconded-by Miller to adjourn
the meeting.
Voice vote was taken on the motion.
